    This article aims to clarify the phenomenon of iconoclasm and how it impacts today’s society, in spite of the lack of research on this topic. After establishing its complex and sensitive nature, a first assessment containing types of iconoclasm and various motives of iconoclasts is presented. Different forms of iconoclasm are distinguished, explained and illustrated using examples. Special attention is given to the subject’s sensitivity in modern society while establishing the connection of the topic with identity in multiple shapes and forms. The article aims at contributing to a future multi-disciplinary debate.

    In this article, the authors draw on a netnographic study conducted between May and July 2019 on phishing on Telegram Messenger. The results indicate that Telegram, just like cryptomarkets and online forums, seems to function as a criminal marketplace. In the groups analyzed the authors see users who both offer and are looking for specific goods and services related to the crime script of phishing. Furthermore, the information on Telegram contains specific modi operandi that are offering comprehensive and step-by-step guides to successfully complete specific financial cybercrimes. Therefore, based on this explorative study the authors argue that Telegram can be seen as a digital offender convergence setting.

    The structural vulnerability of the port of Rotterdam to organized crime is dealt with in this article from a broader, historical perspective. Using examples from ports in Italy and the United States, among others, the author shows how at the end of the last century local criminal groups managed to gain a dominant position in the handling of good flows. The author discusses various research reports that have been published over the years on the import of drugs into the port of Rotterdam and other European ports. Drug traffickers turn out to respond very flexible to stricter controls by simply moving to alternative ports or opting for transferring drug loads to small fast boats in open water. The author emphasizes that ports should not be studied as isolated transition points, but must be considered as nodes in networks that extend far inland and abroad. This is the only way to see the broader strategic and tactical options for stopping or reducing drug trafficking. In addition, attention must be paid to the problem of corruption among port workers, police and customs officers.

    The Netherlands functions as an important source and transit country for international organized drug trafficking. This is in part due to its large logistical nodes in the world economy, like the airport and the seaport. Based on in-depth analyses of sixteen cases of the Dutch Organized Crime Monitor, this article explores how drug traffickers operate at logistical nodes, in particular airports. The results demonstrate that organized crime groups deploy mainly three types of tactics to traffic drugs, namely defying, avoiding, and neutralizing security checks. Occupational embeddedness is manifested through several job-related factors. Autonomy, mobility, and the similarity between legitimate duties and criminal activities facilitate discrete engagement in organized crime activities during work time. Port employees are also attractive to organized crime groups because of their job-related social capital and knowledge.

    Worldwide, the digitalization of society is proceeding rapidly and this brings new forms of crime. The threats arising from different types of cybercrime are real and constantly evolving, as the internet with its anonymity and borderless reach, provides new opportunities for criminal activities. This article describes some results from an international empirical study aimed to gather more insight on the link between cybercrime and organized crime as well as on the question whether cybercrime is organized. It shows how cybercriminals cooperate with each other and what this organization structure looks like.

    As an EU agency operating at the external borders of the EU, Frontex is actively involved in combating illegal migration. Since a rising number of migrants drown in the Mediterranean Sea or are pushed back to unsafe third countries, Frontex is being accused by human rights organizations for violating the fundamental rights of the EU. The Agency however maintains that it can’t be held accountable for human rights violations, as it is only assisting Member States, and not taking over their responsibility. This article analyses if this position is correct in the light of the growing tasks and mandate Frontex is granted by the EU.

    Dutch policies concerning the illegal stay of aliens are characterized by regular tensions between central and local governments. This article describes various concrete (proposals for) policy changes in the last twenty years and examines the reasons for these tensions while using the distinction between policy strategies based on denial versus strategies based on adaptation (Garland). When it comes to refugee policies, the central government works in the denial mode while local governments adapt and try to find solutions in order to bring problems under control. This attitude can be explained by the local governments’ duty to provide for in the case of humanitarian emergency situations.

    This article critically evaluates the recent developments in Dutch policy formation regarding Roma minorities from the perspective of the increased attention paid to their position at European level. First, the author discusses the so-called ‘Europeanization of Roma representation’, that is the post-1989 representation of the Roma as a European minority and the simultaneous large-scale, Europe-wide devising of development, inclusion, and empowerment programs meant for them. Thereafter, the author argues that some of the risks of the Roma’s Europeanization – such as the isolation and culturalization of policy formation and the diminishing of democratic accountability – have also and ambiguously affected Dutch policies meant for Roma, Sinti and caravan dwellers. By means of a brief analysis of recent policy developments, the author demonstrates that the Dutch shift towards a policy that, at least in name, encourages social participation, has actually tended to result into a one-sided focus on the Roma as a ‘problem group’ and ‘security threat’.

    During childhood, a child is entitled to receive special care and assistance. The child’s best interest should be a primary objective. The Dutch government has an obligation to guarantee the children rights. But do the closed youth care accommodations meet the requirements as stated in the International Child Rights Convention, as far as deprivation of liberty and treatment under coercion are concerned? The study concluded that some closed youth care institutions do not meet the requirements as stated in the above mentioned Convention. There is often no possibility of free expression, physical complaints may not be taken seriously, an adequate standard of living is not always provided and the level of education is often too low. Most of the minors indicate that they are bored during their stay in the accommodations. On this basis, limiting the fundamental rights of these youngsters is currently surrounded with inadequate guarantees.

    The Dutch Code of Criminal Procedure and the related guidelines of the College of Procurators-General are for all sorts of historical and ideological reasons heavily restrictive when it comes to the use of cooperative witnesses in criminal proceedings. What strikes most is that even in very serious cases it is not possible to grant a witness complete or partial immunity in exchange for his important cooperation. This contribution describes the problems arising sometimes in criminal cases wherein prosecutors, despite the existing narrow framework, make a deal with such a witness. The article outlines not only the historical and international background of the use of cooperative witnesses, but also its contemporary legal framework in the United States, Italy, the United Kingdom and Germany. The outcome of this comparative exercise is that at least the current legal provisions should be evaluated and that this evaluation should take into account the system and experiences in other countries as well as the problems of serious crime in the Netherlands and the leniency policies that govern the efforts to contain serious white collar crime like e.g. cartels.

    Because of the special characteristics of the Internet, cybercrime inherently crosses national borders and has fewer natural barriers than classic cross-border crime. This triggers the question whether criminal law with its traditional national focus is able to combat cybercrime. Can legislatures respond to technological change with sufficient speed in an internationally aligned approach? This article tries to answer this question by mapping the dynamics of cybercrime law, focusing particularly on the interplay between European and Dutch legislative initiatives. It shows that the dynamics consist of a European framework of minimum standards on major issues, with much room for national legislatures to interpret the standards and to add initiatives of their own where the European framework remains silent. Although this has worked well so far, if cybercrime continues to transform into large-scale organised crime, a step-change in the dynamics towards more steering European approaches may be necessary.

    Intervention teams are among the most discussed tools in the current process of securitisation. Their integrated approach takes into account all underlying causes of insecurity and quality of life. For a more effective approach authorities and organisations have to cooperate and let go of their mutual boundaries. But can the participants put aside their differences in perspectives and policies? This article discusses the goal of ‘ontkokering’ (‘decompartalisation’), this was done through a study of the practices of intervention team SIP in Amsterdam. On basis of thirteen interviews and observations the authors argue that there are three main mechanisms or ‘molar barriers’, which conserve the old structures in the integrated approach of the intervention team: ‘methodical robustness’, ‘institutional robustness’ and ‘financial robustness’.

    This paper focuses on how organized crime in Bulgaria uses political corruption to achieve its goals. It focuses, though, on one specific type of criminal structures, the ones controlled by former security officers. More specifically it analyzes the criminal careers of two well known Bulgarian crime figures and former security officers. The way they use the instrument of corruption changes though the years when they evolve from relatively unimportant racketeers into powerful local oligarchs.

    The Act introducing the Institution for Persistent Offenders Committal Order (ISD Order) took effect on 1 October 2004. The origins of the ISD Order are in safety policy. The order had a strong focus on imprisonment of persistent offenders. It can be seen as an exponent of the risk-oriented attitude towards safety, which has been predominant in recent years. At the start treatment of persistent offenders was of secundary importance and was only available for those who were motivated. But the ISD measure has had to deal with major problems in practice. The imprisoned ISD population proved to be one with complex problems like addiction, psychiatric illnesses and sometimes low intellectual abilities. The ISD institutions are ill-equipped for handling these people. The problems led to a slightly different attitude which is more oriented towards resocialization. Improvements are going on now, a process facilitated by a considerably improved co-operation between agencies around the ISD.

    Cross-border police cooperation, in any case against political adversaries, has always been an important component in the foreign policy of European states, especially when police forces were established in their colonies during the nineteenth and twentieth centuries. Against this background it was quite astonishing, because very artificial, that in the Maastricht Treaty a rather clear distinction was made between a second pillar (foreign and defense policy) and a third pillar (justice and home affairs, later on called police and judicial cooperation). Over the years this gap has been bridged from two sides: on the one side the geographical enlargement of the European Union into Central and Eastern Europe asked for the integration of police and judicial cooperation in the related policies vis-à-vis the (new) member states; on the other side the enlargement of the political and military role of the European Union on the international stage, reinforced by the 9/11 attacks on the United States. The proposal in the The Hague Program (2004) that it is necessary to develop a coherent strategy with regard to the ‘external’ aspects of the European Union policy in the area of freedom, security and justice, has led to the formulation of such a strategy by the member states. This strategy partly focuses on the containment of serious general problems like the containment of terrorism and organized crime and partly on the reinforcement of criminal justice systems in, respectively the strengthening of police and judicial cooperation with specific important third states. The Stockholm Program sticks to this format, but underlines the necessity to reinforce the coherence between the ‘external’ freedom, security and justice policy of the European Union and the police missions it organizes in a number of weak, failing or failed states.

    In this essay the author looks back at ten years of rule of law foreign assistance in Afghanistan. She first surveys the elements that make Afghanistan particularly challenging as a development. This is followed by a brief outline of foreign donor-assisted efforts at rule of law reform in the last decade. The features of law and legal systems in Afghanistan that are salient for would-be foreign reformers are analyzed. The concept of judicial independence serves as example of well-intentioned rule of law interventions that have not fared well in this complex environment. The author argues that better prepared international advisors with a better grasp of legal history and comparative law may have produced stronger outcomes. Ultimately, however, a pre-post-conflict setting constrains conventional rule of law programs in important ways and calls for more realism about what can be achieved, within what time frame and with what degree of sustainability.
