    This contribution treats debt recovery as an important cause for the emergence and worsening of the debt problem. It is explained that when a bailiff seizes wage, the debtor often has too little left to live on. In addition to seizure of wage, the bailiff can also seize the bank account or seize household goods in order to sell these. The author describes how this can lead to new debts and what legislation is being prepared to modernize this situation. In case of problematic debts, multiple creditors are collecting from the same debtor, which requires coordination. The recovery by creditors facilitated by the current rules focuses on the claims of individual creditors. However, as soon as problematic debts are involved, an integrated approach is necessary, in which the common interest, the interest of all creditors and that of the debtor, takes precedence over self-interest.

    This article outlines the need in the Netherlands for socially effective justice that better resolves citizens’ problems. The author argues that new forms of dispute resolution should be integrated in the justice system. The author first describes various types of innovations. Then he outlines the obstacles to innovations. A major obstacle is that many stakeholders in the existing legal system are simultaneously the gatekeepers for the admission of innovations. It is necessary to create an infrastructure that welcomes, reinforces, tests, finances and imports new treatments for legal problems.

    How to make empirical legal research successful? This article seeks to find an answer. It does so by building on experiences in the US with empirical legal research. Three themes are identified that should be considered when thinking about advancing empirical legal research in the Netherlands, and possibly in other countries. First, empirical legal research should address topics that the legal community can relate to and that are considered relevant. Second, empirical legal research should educate the legal community about the possibilities and pitfalls of empirical legal research in addition to conducting empirical legal research. Third, legal scholars should be educated in conducting empirical legal research. The combination of these three elements is likely to determine empirical legal research’s success.

    In the Netherlands new criminal law measures will be introduced to prevent and combat bankruptcy fraud. In this article the author argues that the emphasis on criminal law measures is not sufficient to effectively tackle the phenomenon of bankruptcy fraud because prosecution and punishment always occur after the damage is done. What is needed is an integrated approach realising preventive measures, such as tools to detect fraud at an early stage. Fraud is, after all, characterised by typical behaviour that throws up digital red flags. After detecting those red flags subsequent action can be taken to stop the fraud. Also modernising the Trade Register would contribute considerably to the protection of creditors.

    Food fraud is as old as mankind but has advanced in the last decades. Fraud regarding the gross composition of food has progressed in the direction of the addition of unconventional adulterants. Furthermore, consumers are more and more interested in how and where their foods are produced and pay price premiums for organic foods, fair trade, animal welfare considering, and sustainable food products. Since these products are very similar to their conventional counterparts in terms of composition, they provide an additional challenge. The knowledge regarding occurrence, type of meat fraud, causes and damage caused to the sector is limited. There is a need for extensive identification of the vulnerabilities and criminogenic factors. These insights offer leads for detection and prevention. The article deals with a first step into the inventory of these vulnerabilities and factors affecting meat fraud, by assessing fraud risks related to products, companies and the meat supply chain.

    This article seeks to aid understanding of the ways in which different policy purposes, approaches and legal options can be combined in the design of better legislation, using Australia’s recently passed Public Interest Disclosure Act 2013. It provides a guide to key elements of the new legislation, as an example of legislative development taking place over a long period, informed by different trends. In particular, it is one of the first national laws to seek to integrate divergent approaches to the ‘anti-retaliation’ model of whistleblower protection, including its place in the employment law system, it sets new standards for the role of ‘public whistleblowing’ in such a regime, and provides new responses on basic questions of coverage, including which individuals are able to gain the benefit of the legislation. This provides lessons as to how different legal approaches might be better integrated, in pursuit of a clearer understanding of the interface between whistleblowing and other integrity reforms.

Alcohol en agressie: een complexe relatie

    Not everyone using alcohol turns aggressive. The effect of a substance like alcohol works differently for different individuals. This is not only due to the substance itself, but also to the drinker's attitude, state of mind and personality, as well as the physical, social and cultural settings in which drinking occurs. The relation between alcohol consumption and aggression is therefore a complex one. Moreover alcohol consumption often takes place in settings and situations where other aggression stimulating factors are present. This article explores the relation between alcohol and aggression on the basis of existing literature. Attention goes to the effects of the substance itself, the drinker and the context in which the drinking takes place.

    Intervention teams are among the most discussed tools in the current process of securitisation. Their integrated approach takes into account all underlying causes of insecurity and quality of life. For a more effective approach authorities and organisations have to cooperate and let go of their mutual boundaries. But can the participants put aside their differences in perspectives and policies? This article discusses the goal of ‘ontkokering’ (‘decompartalisation’), this was done through a study of the practices of intervention team SIP in Amsterdam. On basis of thirteen interviews and observations the authors argue that there are three main mechanisms or ‘molar barriers’, which conserve the old structures in the integrated approach of the intervention team: ‘methodical robustness’, ‘institutional robustness’ and ‘financial robustness’.
