In Circles of Support and Accountability (COSA) a group of trained and supervised volunteers support a medium to high-risk sex offender in his process of re-entry after detention. Sex offenders participate on a voluntary basis. Circles have a double aim: the prevention of new sexual offences and the rehabilitation of the sex offender. Circles offer social inclusion and support for behavior change, and monitor risk. They are embedded in the professional network of sex offender after care. Through a professional circle coordinator relevant information is circulated between the circle and professional agencies, to enable adequate support and interventions. Effect studies show that COSA contributes to a reduced risk of reoffending. The model was developed in Canada almost 25 years ago and has been picked up by a growing number of countries in Europe, the America’s, Asia, as well as Australia and New Zealand. Variations in the model become apparent and raise questions about the essentials of COSA. |

This article relates the geographical allocation of Courts to access to justice. Travel distances within the Dutch system are higher than in surrounding countries, but still not extremely high. The scale of the Dutch Court organizations however, is extreme. On average, a Court location that handles small claims has jurisdiction over a territory with over half a million inhabitants. This large number of inhabitants automatically translates to large numbers of cases, and large bureaucracies, employing 500 to 1,000 people (judges, court staff, support) each. Do travel distances to the Courts actually have an impact on the use of the Court system? Two recent studies find no support for a popular belief that defendants will be less determined to defend themselves when the travel distance to the court is longer. They do show however that the number of cases brought to Court by local plaintiffs drops when ‘their’ local court closes down. |

This paper looks at the number of administrative sanctions for minor offences since 2005. Administrative sanction can be divided into two categories: restorative sanctions and punitive sanctions. Information is limited and dispersed. The number of offences handled by welfare agencies has decreased with 21% in the period 2005-2016. In the same period the number of administrative sanctions for traffic offences imposed by the police/public prosecutor have decreased with 14% (mainly originating from automated traffic cameras). Also administrative sanctions imposed by supervisory financial agencies have decreased with 58%. For some organisations the observation period is a shorter. In the period 2011-2016 the number of administrative sanctions for traffic offences imposed by municipalities has increased with 41% and the number of administrative sanctions imposed by supervisory non-financial agencies have decreased with 47%. There is no information available on administrative sanctions for tax fraud. |

Although traditionally, it has been argued that intelligence and security services can barely be discussed in public – a veil of secrecy makes a thorough and informed debate almost impossible, the outside world is ignorant, say the insiders – we argue that today’s mature civil society does not accept that anymore. Although the government has struggled to address social anxiety and political criticism in the past decades, communication and strategic discussions have never received proper attention. Due to the technological changes, affecting the intelligence practice as well as daily life of citizens, the authors argue that the positioning of intelligence and security services in the broader democratic state should receive structural attention and sustainable communication efforts. |

In the regulation of private law relationships, the concept of informed choice-making is an important point of departure for policymakers. As a result, professionals and traders are often under a legal duty to offer certain information to the public in order to inform, persuade or warn against dangers. Policymakers and academics alike tend to refer to findings from purely experimental studies to underpin the effects and overall effectiveness of such information duties. This contribution argues that such studies have limited value as a basis for policymaking. Moreover, it is argued here that policymakers may in fact benefit from practice-oriented research which lacks significant findings. |

As an EU agency operating at the external borders of the EU, Frontex is actively involved in combating illegal migration. Since a rising number of migrants drown in the Mediterranean Sea or are pushed back to unsafe third countries, Frontex is being accused by human rights organizations for violating the fundamental rights of the EU. The Agency however maintains that it can’t be held accountable for human rights violations, as it is only assisting Member States, and not taking over their responsibility. This article analyses if this position is correct in the light of the growing tasks and mandate Frontex is granted by the EU. |

In light of the high numbers of persons entering the EU via the southern borders and the current uneven distribution of asylum seekers (five Member States of the EU currently received in 2014 more than 70% of the total amount of refugees), there is a clear and urgent need for the EU ministers to ensure a fairer distribution of asylum seekers within the EU. The Dublin Regulation’s system of allocating the responsibility for an asylum request does not offer a solution for this challenge, also because Member States cannot have a blind faith in the standards of a number of states for processing asylum requests. There are significant differences in the application of the law and the procedures. |

This article provides an overview of the current socio-economic and political situation of the Roma in Europe, the continent's largest and most marginalized minority. While a host of new regulations and initiatives on different levels of government have been issued in order to foster the social inclusion of the Roma in various areas of life, the situation on the ground remains far from hopeful. Poverty and discrimination continue to be huge problems in most of the countries where Roma live. New avenues for political and social mobilization have become available to Roma activists and politicians. Yet also in this area important challenges remain. The recent popularity of extreme right-wing populist responses to Roma mobilization and migration has created important obstacles to the full participation and equal citizenship of Roma in our contemporary societies. |

This article sheds light on an aspect of honour-based violence (HBV) that is rarely addressed: male victimisation. HBV is usually regarded as violence inflicted on women by men. Police cases of male victimisation of HBV and scarce literature on this subject illustrate the ways in which men can become victims of violence. Men can be victimised in the same way that women are, for example when they commit adultery, are openly homosexual, or through conflicts about the choice of a partner. A specific and contested form of male victimisation occurs when their families pressure them to commit violence in order to restore family honour. Men are less likely than women to claim victim status and their victimisation of HBV is therefore possibly underreported. The authors do not argue to neglect female victims, but to expand hegemonic images of HBV and gender roles to include male victimisation. More insight into these matters is necessary to ensure the right support for each victim of HBV and to enable men and women to resolve these conflicts together. |

A comparison between life prisoners and long-term forensic psychiatric inpatients shows, besides differences in legal position, important similarities. Therefore the results of an experiment with regime changes in the long-term ward of Dutch forensic psychiatric institutions might also be relevant for the regime of life prisoners. The experiments are partly based on the ideas of Andrews, Ward and Bonta. The fundamental idea is to give inpatients a sense of control over their life environment by granting them as much responsibility as possible for practicalities, by communicating with their representatives regularly and taking a positive attitude towards inpatients’ preferences and requests. First experiences show that the new approach seems to have a positive impact on inpatients. They suffer less from depression as well as aggressive moods, which contributes to a better atmosphere in the institution. Stressing the tentative nature of this observation the author indicates that the hypothesis on the beneficial effects of active influence on the life environment might be verified by research currently in progress. |

The Dutch Code of Criminal Procedure and the related guidelines of the College of Procurators-General are for all sorts of historical and ideological reasons heavily restrictive when it comes to the use of cooperative witnesses in criminal proceedings. What strikes most is that even in very serious cases it is not possible to grant a witness complete or partial immunity in exchange for his important cooperation. This contribution describes the problems arising sometimes in criminal cases wherein prosecutors, despite the existing narrow framework, make a deal with such a witness. The article outlines not only the historical and international background of the use of cooperative witnesses, but also its contemporary legal framework in the United States, Italy, the United Kingdom and Germany. The outcome of this comparative exercise is that at least the current legal provisions should be evaluated and that this evaluation should take into account the system and experiences in other countries as well as the problems of serious crime in the Netherlands and the leniency policies that govern the efforts to contain serious white collar crime like e.g. cartels. |

Based on different criminological theories in combination with the unique characteristics of the Internet, it is assumed that there are significant differences between cyber criminals and traditional criminals. This article compares the characteristics of fraudsters who use the Internet to execute their scams (e-fraudsters) and fraudsters who do not use the Internet (classic fraudsters). The personal characteristics, social economical background and criminal careers are compared. The main conclusion is that e-fraudsters are not ‘new’ criminals that only commit crimes because of the perceived benefits of the Internet. But the use of the Internet does make the perceived consequences of committing a fraud offense less severe, so offenders who use the Internet will commit fraud offenses earlier in life. Internet provides the opportunity for fraudsters to commit frauds at a younger age. |
