De afnemende rol van de rechtspraak: is vervanging van de rechter mogelijk en wenselijk?

Tijdschrift Justitiële verkenningen, Aflevering 4 2018
Trefwoorden judges, marginalization, administrative bodies, truth finding, legal protection
Auteurs Mr. dr. Marijke Malsch
SamenvattingAuteursinformatie

The last decades have shown a tendency in which tasks are transferred from the judge to other authorities, such as the police and public prosecutor, administrative bodies, administrative procedures, or private parties. The central question in this article is whether these authorities can really replace the court. A comparison is made between legal proceedings and procedures for other authorities on the following aspects: truth finding, openness and legal protection of the (vulnerable) citizen. The author also discusses a recent legislative proposal for an own budget for the Judiciary, which aims to strengthen the independence of the judge towards the two other state powers. It is argued that the courts should be also accessible in the case of relatively small offenses and for vulnerable citizens.

Ruim baan? Uitsluiting en zelfuitsluiting van de arbeidsmarkt

Tijdschrift Justitiële verkenningen, Aflevering 2 2018
Trefwoorden criminal records, screening, young adults, labor market, self-exclusion
Auteurs Dr. mr. Elina van ’t Zand-Kurtovic
SamenvattingAuteursinformatie

In the Netherlands, the number of criminal record screenings performed each year skyrocketed to more than one million. Yet, empirical evidence on its effects has been largely absent. In this article the author addresses parts of the findings of her PhD research, which aimed to fill this gap, by providing a subjective perspective of how having a criminal record impacts the process of re-entry into society, particularly into the labor market, for young adults. It is based on the lived experiences of 31 young adults having a criminal record who were followed during their process of reintegration into the labor market. The vivid, real-life stories of young adults’ strategies of dealing with the stigma of a criminal record, and how this subsequently influences their position in the labor market, highlight the counterproductive effects of increasingly widespread criminal record screening. They provide evidence that many young adults adopt self-exclusion as a strategy for avoiding rejection and exclusion.

‘Handelen naar Waarheid’ een jaar later

Tijdschrift Justitiële verkenningen, Aflevering 4 2017
Trefwoorden national police force, police reform, change, organizational dynamics, leadership
Auteurs Dr. N. Kop en Dr. P. Klerks
SamenvattingAuteursinformatie

The authors reflect on ‘Handelen naar waarheid’ (Acting on truth), an assessment of the state of criminal investigations in The Netherlands, which appeared in May 2016. This report, assigned by the police and public prosecution service and written by four inside experts, caused substantial turmoil in the police organization and beyond. The report addresses six domains: professionalism, attitude and behavior, direction and leadership, capacity for change, organizational structure and business management. The critical and transparent self-reflection by the police received praise from policymakers, journalists and academic observers. It also met with recognition and appreciation in the law enforcement community, in particular among investigators and prosecutors. In the wake of the report, a reform program was organized to modernize both the police and the prosecution service in order to increase the quality and effectiveness of their work. Such reform is deemed necessary because crime problems have become ever more complex and citizens increasingly organize their own (counter-)investigations. The authors conclude that in spite of many recent initiatives, truly innovative practices remain scarce. Also, the crucial ambitions to increase the educational level of investigators and the organizational culture are still far from realized.

Over verantwoordelijkheid en ruimte van reclasseringswerkers

Tijdschrift Justitiële verkenningen, Aflevering 4 2012
Trefwoorden professionalism, probation history, probation workers, evidence-based practice
Auteurs Drs. A. Menger en Dr. A.G. Donker
SamenvattingAuteursinformatie

In this article, the authors question the relation between professionalism in Dutch probation work and the tendency to create protocols for work processes that used to be under the rather autonomous control of the professionals themselves. Starting point is the professionalism model of De Jonge, placing professional space as key element of professionalism under the restriction that there is an acknowledged societal position as well as an explicitly recognized knowledge base for the professional. A brief historical overview of the probation work itself and the way it has been organized over the decades is described, resulting in the identification of five decisive developments in the initial (but recently changing) perception among Dutch probation workers of gradually restricted professional space despite the growing body of knowledge.

Hoog betrouwbaar organiseren in het OM

Beelden uit parketten

Tijdschrift Justitiële verkenningen, Aflevering 4 2012
Trefwoorden Public Prosecutor’s Office, high reliability organization (HRO), HRO principles, professional culture, error prevention
Auteurs H. de Bruine, H. Fijn en P. de Beer
SamenvattingAuteursinformatie

This article deals with possibilities for the Public Prosecutor’s Office in the Netherlands to learn from high reliability organizations (HROs). The authors draw a picture on the basis of information, gathered between 2008 and 2010. While dealing with mistakes or faults much emphasis is often laid upon a professional attitude, written handbooks and discipline as essential conditions. The experience with HROs shows that at the same time mental processes are needed for fast detection and containment of developing problems. These mental processes, heaped together as ‘collective mindfulness’, refer to the picking up of weak signals and the resilient reacting upon incidents. The authors show to what extent the Public Prosecutor’s Office makes use of these processes. The level of training and education and the ‘hands on’ mentality of the average Public Prosecutor build a firm foundation for reliability. Reflection and to what extent knowledge is shared seem liable for improvement. Adapting (elements of) the HRO philosophy may prove an effective way to foster the actual exchange and use of knowledge within the Public Prosecutor’s Office and thus raise its reliability.

Juridische overwegingen aangaande de ISD-maatregel

Tijdschrift Justitiële verkenningen, Aflevering 2 2009
Auteurs K.D. Lünnemann
SamenvattingAuteursinformatie

The primary objective of the ISD Order is to reduce public nuisance caused by extremely persistent offenders. Another objective is to reduce recidivism. Recidivism can be prevented by influencing behaviour, with due regard to any personal issues involved. In this article the author looks at the arguments the judiciary uses to impose or end an ISD Order. The author notices that the judiciary views ISD Orders as a last resort: an order is given only in the absence of alternatives, and with the requirement attached that ISD subjects are to be put on a programme. The judiciary considers rehabilitation within an ISD framework to be extremely important. The orders are almost invariably imposed for two years, with no deduction of the pretrial detention period. There is reason to terminate the order if the recidivism risk has receded, but there may be other termination grounds, outside the control of the ISD subject, such as negligence on the part of a government agency.
