    Last year, Dutch parliament approved the proposal for a new Intelligence and Security Services Act (Wiv 2017). This law will replace the current Intelligence and Security Services Act 2002 (Wiv 2002). The Wiv 2017 should be considered feasible with effect from 1 May 2018. Before that time however, an advisory referendum on the new law will be held on 21 March. This article first discusses the nature of the law and the need for innovation. Subsequently, a comparison of both laws takes place in general terms, with regard to the powers of the intelligence and security services, the safeguards, the supervision, the complaint handling and the international cooperation between intelligence and security services. It is argued that the extension of the powers of the services in the Wiv 2017 is only limited in scope, while the safeguards have been considerably strengthened. The introduction of a binding judgment in complaint handling also contributes to a better and more effective legal protection for citizens.

    Currently, there is a vivid debate in the Netherlands about the possible non-existence of free will and its implications for criminal law, in particular for the concept of ‘criminal responsibility’. Especially forensic psychiatrists who advise the court on a defendant’s legal insanity feel uneasiness because of this discussion on free will. In this contribution the author suggests to reconsider the current practice in the Netherlands in which psychiatrists explicitly advise the court on legal insanity and to consider the option to leave the judgment on legal insanity entirely to the judge. Meanwhile, of course, psychiatrists will have to inform the judge about the defendant’s mental condition at the time of the crime and its influence on the defendant’s behaviour. If needed, in order to optimize communication between the medical domain (psychiatrist) and the legal domain (judge), a legal insanity standard could be developed and introduced.

Prof. dr. Gerben Meynen is als bijzonder hoogleraar forensische psychiatrie verbonden aan de Universiteit van Tilburg.

    In Dutch history five cases are known of animals that received the death penalty after ‘committing a crime’. Nowadays it sounds rather strange to present animals as offenders. Does that mean that no contemporary examples can be found of animals being presented as offenders? Before answering that question some outlooks on judicial and criminological ideas are presented on offending by human and other animals. Next the debate on invasive exotic species and the threats to biodiversity, health and other risks, and the discussion about the dangers regarding pit bulls is described in order to illustrate that in this day and age there still seems to be a risky anthropomorphic and anthropocentric tendency to present animals as offenders.

Dr. Janine Janssen is hoofd onderzoek bij het Landelijk Expertise Centrum Eergerelateerd Geweld, dat is ondergebracht bij politie Haaglanden. Daarnaast is zij geïnteresseerd in de positie van dieren in de criminologie. In 2008 publiceerde zij ‘Hondenbaan’, over de geschiedenis en de werkzaamheden van de politiehond (Den Haag, politie Haaglanden).
