    This article maps the current Dutch practice on statelessness, and tries to expose the current issues in particular. The published legislative proposal for a statelessness determination procedure in September 2016 is an attempt by the Dutch government to solve part of these problems after wide criticism from, among others, the Advisory Committee on Migration Affairs (ACVZ) in 2013. The introduction of a statelessness determination procedure is a long awaited development and a step in the right direction with a view of improving current practice and law for stateless persons residing in the Netherlands. However, significant deficiencies in the legislative proposal risk to greatly undermine the operation and value of the new procedure, especially for those currently left in limbo and excluded from society. This article focuses on the shortcomings in the procedure and provides recommendations how to revise these to ensure that stateless persons are enabled to demonstrate their statelessness adequately and obtain the rights associated with it as intended in the Statelessness Conventions signed by the Netherlands.

    While reflecting on gender issues transgender persons and their issues are often neglected. Government institutions on various levels don’t know how to handle their gender nonconformity as neither male nor female. Also they are often targets of inappropriate police and judicial measures. Transgender persons are often sceptical and cautious when interacting with those professionals: a fair and respectful treatment is not to be expected. In this article the author takes on to explore this blind spot. She presents the results of a survey on the transgender discrimination and violence by police and judicial institutions in Germany. The author points out that this is a result of the ongoing structural discrimination of gender non-conform persons in a binary gender system. This topic is part of her PhD thesis on the experience of discrimination and violence of gender non-conform persons in general. Her qualitative study is based on narrative interviews and a group discussion with gender non-conform persons in Germany.

    Responsibility of the prisoner for his own rehabilitation is a central element of ‘Modernising Imprisonment’, the masterplan that aims to reform the execution of the prison sentence in the Netherlands. The Secretary of Justice strives for an individual approach based on the points of departure of the Life Course Approach in criminology. This method is designed in different ways. A central element is that rehabilitation will only be offered in the near future to prisoners that show responsibility for their rehabilitation. Based on this starting point, a far-reaching system of advancing and degrading is introduced. Prisoners can deserve freedoms by showing responsible behaviour, but loose them again in case of irresponsible or unmotivated conduct. Three objections against this aspect of Modernising Imprisonment are discussed. First, the rehabilitation principle itself does not allow for such a far-reaching exclusion of categories of prisoners. Second, the high demands put on prisoners are not realistic given the characteristics of the prison population. Third, the assumption that a strict system of advancing and degrading will increase the effectiveness of sentencing is not well founded and cannot be derived from research.

    The fact that the Netherlands have abolished the death penalty in 1870 does not imply that this criminal sanction doesn't affect the Dutch legal order anymore. As a member of the international ‘legal family’ The Netherlands are confronted regularly with the continuing existence of capital punishment abroad, for instance when a Dutch national is sentenced to death in a foreign country. The (threat of a) death penalty is an important factor when Dutch administrative or judicial authorities have to decide on matters concerning the admission or expulsion of foreign citizens or the extradition of suspects to countries where they run the risk of being sentenced to death. In the Netherlands the enforcement of life sentences can get the character of a suspended death sentence when time and again pardon is denied and the convict will die a prisoner. Long-term prisoners suffer a kind of civil death, being cut off from their families, friends and other social contacts. In sum: enough reasons to focus once more on the ultimate criminal sanction.

‘Als het hier niet lukt, dan maar in Marokko?’

Vormen van kapitaal in transnationale Nederlands-Marokkaanse echtscheidingen

    During a transnational divorce, spouses can get into contact with two different legal systems, each with its own procedures, courts and documents. This article focuses on transnational divorces between the Netherlands and Morocco. In these divorces Moroccan and Dutch family law interact in several ways. First of all, as determined by Dutch Private International Law, Moroccan family law can be applied in the Netherlands, by Dutch judges. Especially with regard to the division of property, the Dutch and Moroccan family law systems can produce significantly different outcomes. Moreover, a divorce from Morocco is not automatically valid in the Netherlands and vice versa. Using four examples of Dutch-Moroccan divorce cases the author shows how, in this complicated situation, spouses in transnational marriages make use of economic, social and cultural capital in both countries to obtain their divorce.


I. Sportel
Drs. Iris Sportel is als promovendus verbonden aan de vaksectie rechtssociologie van de Radboud Universiteit Nijmegen.

    In the nineteenth century in the Netherlands, tramps and beggars were sent to Veenhuizen to work there as a form of punishment and rehabilitation. To investigate the background of these banished men, the authors drew a systematic 5% sample out of 6.000 men who were banished between 1896-1901. Using information from the so-called ‘signalements’-cards that were compiled, the authors found that the Veenhuizen men were not uneducated, unskilled workers, but on the contrary, often had some kind of (semi-)skilled profession. Many did not have a permanent abode, and only a few had (ever) been married. At on average 45 years of age, the Veenhuizen convicts were old for the era they lived in. As such these men lacked and had probably at some point in their lives lost societal as well as social ties, and had gone adrift.
    Recidivism was high. While the Veenhuizen measure may have been effective in delivering society from the blemishes that these men represented, but in general it didn't turn these men into fully participating citizens.

Prof. dr. mr. Catrien Bijleveld is hoogleraar Methoden en Technieken van Criminologisch Onderzoek aan de Vrije Universiteit in Amsterdam en senior onderzoeker bij het Nederlands Studiecentrum Criminaliteit en Rechtshandhaving in Leiden.

    This article analyzes how football game situations, especially those where players get injured, are posted within the law. In the Netherlands sport rules are not regulated in specific laws. An incident in the soccer pitch should be approached by the ordinary law: criminal law as well as liability. An important standard laid down in jurisdiction is that sport participants accept a certain risk to get hurt.
    A conviction on the basis of criminal law occurs not very often, because it is hard to prove that the accused in a game situation had the intention to cause injury. The author gives an outline of the disciplinary rule structure of Dutch football. The Dutch football association KNVB has an important role in this structure. Every football player is a member of his own club as well as a member of the KNVB. As a consequence the club as well as the KNVB has the authority to take disciplinary action against football players breaking the rules. The disciplinary system and rules are different for professional and amateur football.

    This article presents a short historical introduction of the Dutch radical movement in the 1840s. What kind of people were these radical-democrats? Where did they come from? And what did they want? Moreover, this case study shows how government framed these radicals, and what actions were taken against them. It becomes clear, that from a historical perspective the continuity and similarities between the 1840s and the present are at least as remarkable as the differences.

    In recent years it has become popular in political discourse and academic literature to talk about the blurring boundaries between transnational terrorism and organized crime. In addition, the terrorist attacks of 11 September 2001 have instigated a debate on the link between transnational terrorism and state failure. This article scrutinizes this so-called ‘black hole’ thesis and its relationship to the crime-terror nexus by addressing the political significance of such conceptual blurring within an international context that is increasingly characterized by uncertainty and uncontrollable risks.
