Drugssmokkelaars en de deur in de haven

Tijdschrift Justitiële verkenningen, Aflevering 5 2019
Trefwoorden book review, cocaine smuggling, harbor, corruption, customs
Auteurs Dr. Barbra van Gestel
SamenvattingAuteursinformatie

In this article, a recently published Dutch book on corruption in the port of Rotterdam is reviewed. De Schiedamse cocaïnemaffia. Een corrupte douanier, doorgewinterde criminelen en duizenden kilo’s coke was written by journalist Jan Meeus from NRC Handelsblad. The book can be seen as a case study of a customs officer – Gerrit – who fell for the big money. It gives a good insight into the connection between the legal and the illegal world and how this is experienced by those involved. The information in the book is based on seven large criminal files and dozens of conversations with people mentioned in those files. Meeus also attended the criminal proceedings intensively. It is now known that the film rights of the book have been sold and that Meeus will be writing the screenplay for the feature film together with director Jean van der Velde.

Hoe de criminele ladder naar de ondergang leidt

De verschillende types slachtoffers van liquidaties in de Amsterdamse onderwereld

Tijdschrift Justitiële verkenningen, Aflevering 5 2017
Trefwoorden contract killings, typology of victims, Amsterdam, criminal underworld, criminal investigation
Auteurs P. Vugts en H. Kras
SamenvattingAuteursinformatie

More than twenty criminals from Amsterdam were killed since 2012 in fierce conflicts in the criminal scene. The victims, mostly young men, can be divided into four categories. The assassins are young, often with a low intelligence, and easy to contract. They hope to give their criminal career a boost by killing. Their main motives are status and money. If the organization fears that they know too much and might inform the police, this can be a motive to kill them. Sometimes fear of betrayal of the organization is a motive for murder. The middlemen are important, because the ‘high profile targets’ want to stay out of sight of the assassins. The middlemen already have a rather secure position, although subordinate to the top. The motive to have them killed is often distrust and the fear that they know too much and would be able to tell the police too much. Revenge by another group is also an important reason they get killed. The high profile targets are top criminals in their thirties or forties mostly and in charge of the drug trafficking. The motive to have them killed is to gain influence and obtain a stronger, strategic position in the market, or – again – revenge. Rivals who are afraid to be killed, sometimes choose to be the first to act. The final category is formed by the victims killed by mistake. Recently at least three people were killed by assassins who thought they were shooting at a criminal target in the conflict. Just by mistake, because the victim drove the same kind of car, for example.

SamenvattingAuteursinformatie

In recent years the total number of violent robberies in the Netherlands has gone down sharply, but the number of robberies on private homes doesn’t decline. Especially robberies on private homes of the elderly are notorious for the level of violence used by the attackers, while the loot is often negligible. In this article the authors investigate this offense. Chances of becoming a victim are very small, but people who are robbed in their own homes often face severe violence. On the one hand these high violence levels and consequential injuries are related to the age of the victims: the elderly resist the attackers more than younger people do, and because of their age they are more vulnerable to physical attacks. On the other hand the high levels of violence are typical of (all) robberies on private homes: the unknown space and the unpredictable behavior of residents contribute to this. Most of these robberies are poorly planned and executed. This also explains why so many of these incidents turn nasty. The elderly are not specially targeted, the reasons they are robbed do not differ from other robberies on private homes: the attackers expect an easy accessible and substantial loot. In many cases both assumptions turn out to be wrong. Risk factors and prevention options are discussed.

Wilsvrijheid en strafrechtelijke verantwoordelijkheid

Een rondgang langs fysicalisme, connectionisme en belichaamde cognitie

Tijdschrift Justitiële verkenningen, Aflevering 1 2013
Trefwoorden free will, criminal responsibility, fysicalism, connectionism, embodied cognition
Auteurs F. de Jong
SamenvattingAuteursinformatie

In this article, the author defends two propositions related to the concepts of free will and criminal responsibility. Free will is defined as the capability of distancing oneself from one’s immediate surroundings and reflect on impulses. The first proposition is that it is a mistake to suppose – as do many neuroscientists adhering to objectivist theories on the human mind – that the concept of free will refers to a postulated natural phenomenon, the existence of which could, in principle, be established or falsified. Instead, the concept of free will constitutes a practice; it is a human artefact that is part and parcel of the differing means by which mankind structures intersubjective life. The second proposition is that the criminal law legitimately presupposes that persons normally act out of free will and that they, consequently, are morally responsible and accountable for the wrongful actions they perform. The author claims that his arguments for both propositions are supported by insights from the neuroscientific fields of connectionism and embodied cognition.

The Bank of England depleted its open market portfolio by secretly sterilising large gold inflows. Thereafter interest rates were influenced by falsifying reported gold flows. The false reporting was a tightly kept secret, hidden from members of the Bank of England's highest governing bodies. The false reporting obscured the instability of the gold standard and supported monetary policies that degraded British economic performance and increased world financial fragility in the critical early years of the Great Depression. The episode supports the view that the interwar gold standard was not a system guiding policy, but was manipulated to enforce a dysfunctional classical orthodoxy.

Een som van misverstanden

Het kabinet-Den Uyl en de immigratie van Surinamers

Tijdschrift Justitiële verkenningen, Aflevering 2 2010
Auteurs J.M.M. van Amersfoort
SamenvattingAuteursinformatie

In 1973 a new Dutch cabinet was formed. One of the central points of its programme was to revise the relations with the former Dutch colonies in the West Indies to be able to stop the immigration from Suriname. This immigration was seen by this government as a serious threat to Dutch society. In reality the migration was modest in numbers and consisted for a good deal of middle class people. In 1967 there were 13.000 Surinamese in the Netherlands. But the immigration had gained momentum and in 1972 there were 51.000. The cabinet launched a vigorous campaign to change the relations with Suriname and close the border for immigrants. The outcome of this policy was that there were 110.000 Surinamese in the Netherlands in 1975 and the immigration caused indeed problems that were unknown before. In this article the reasons for the complete failure of the anti-immigration policy are analysed.
