    Criminal law is embedded in a specific view of man and the world. This thesis implies that a change of the view of man and the world leads necessarily to a change of criminal law. Since our view of man and the world is constantly changing, the same applies for our law governing wrongful conduct. In this article is described how our view of man and the world has changed through the ages (during pre-modernity and modernity) and what changes have occurred under the influence thereof. Given the limited size of this article, a macro-perspective is utilized. At the end of the article, the author advocates a new (trans-modern) view of man and the world and a new corresponding law governing wrongful conduct.

Mr. dr. Jacques Claessen is als universitair docent straf(proces)recht verbonden aan de Faculteit der Rechtsgeleerdheid van de Universiteit Maastricht. Daarnaast is hij rechter-plaatsvervanger bij de Rechtbank Limburg en redacteur van de Nieuwsbrief Strafrecht en het Tijdschrift voor Herstelrecht.

    In the Netherlands new criminal law measures will be introduced to prevent and combat bankruptcy fraud. In this article the author argues that the emphasis on criminal law measures is not sufficient to effectively tackle the phenomenon of bankruptcy fraud because prosecution and punishment always occur after the damage is done. What is needed is an integrated approach realising preventive measures, such as tools to detect fraud at an early stage. Fraud is, after all, characterised by typical behaviour that throws up digital red flags. After detecting those red flags subsequent action can be taken to stop the fraud. Also modernising the Trade Register would contribute considerably to the protection of creditors.

    The Dutch Code of Criminal Procedure and the related guidelines of the College of Procurators-General are for all sorts of historical and ideological reasons heavily restrictive when it comes to the use of cooperative witnesses in criminal proceedings. What strikes most is that even in very serious cases it is not possible to grant a witness complete or partial immunity in exchange for his important cooperation. This contribution describes the problems arising sometimes in criminal cases wherein prosecutors, despite the existing narrow framework, make a deal with such a witness. The article outlines not only the historical and international background of the use of cooperative witnesses, but also its contemporary legal framework in the United States, Italy, the United Kingdom and Germany. The outcome of this comparative exercise is that at least the current legal provisions should be evaluated and that this evaluation should take into account the system and experiences in other countries as well as the problems of serious crime in the Netherlands and the leniency policies that govern the efforts to contain serious white collar crime like e.g. cartels.

Prof. dr. em. Cyrille Fijnaut was tot voor kort als hoogleraar internationaal en vergelijkend strafrecht verbonden aan de Universiteit van Tilburg. Hij is thans voorzitter van de Toegangscommissie van de Commissie Evaluatie Afgesloten Strafzaken (CEAS).

    How to understand the disintegration of the Dutch Caribbean? The Kingdom of the Netherlands comprising three countries - the Netherlands, the Netherlands Antilles, and Aruba - will be reordered. The Netherlands Antilles will cease to exist as a separate country. Curaçao and Sint Maarten will acquire country status within the Kingdom of the Netherlands, just as Aruba did in 1986, though theirs will be of a different status and with less autonomy. The islands Bonaire, Sint Eustatius and Saba, the so-called BES islands, will be integrated into the Netherlands as public authorities (openbare lichamen); as such the BES islands will be administered by the Netherlands while retaining local government functions (just as municipalities in the Netherlands).
    This article outlines the history behind these changes and the factors that are at play. However improbable the Dutch Caribbean hypothesis, the Kingdom facilitates a connection of these islands with the international world. Against all odds and populist opponents, the Dutch Caribbean is a challenge to square the circle, a complex pact, impossible to balance, which will never come to a definitive conclusion.

Dr. Lammert de Jong is bestuurskundige en was tussen 1984 en 1998 geruime tijd Vertegenwoordiger van Nederland in de Nederlandse Antillen. Hij werkt deze dagen aan een boek Being Dutch, more or less. True Dutch is not the issue, so what is? Oplevering jaarwisseling 2009/2010.

    This article focuses on the current measure for persistent offenders (ISD-measure), by taking into account three equivalent penal sanctions that have been developed in the Netherlands from 1886 onwards. First, the penalty of a labour colony for vagrants and the like for three years at most. Second, the measure to keep the habitual offenders in additional, preventive custody for five to ten years. Finally, the measure of two-year detention for drug addicted offenders. In the article it is argued that in spite of the differences in (judicial) elaboration, all three former existing sanctions have the same legitimating fundamental principle as the ISD-measure. That is, the notion that certain offenders are a danger to society, due to their persistent criminality and nuisance causing lifestyle. The primary objective of all these penal sanctions is therefore a long term protection of society from this danger. In this sense, the ISD-measure makes clear that present state-policy is above all one of sheer deprivation of freedom.


S. Struijk
Mr. Sanne Struijk is wetenschappelijk docent strafrecht aan de Erasmus Universiteit Rotterdam. Zij schrijft een proefschrift over de strafrechtelijke aanpak van veelplegers, bezien vanuit de (historische) mogelijkheden van het Nederlands wettelijk sanctiestelsel tot recidive- en overlastbestrijding.
