Publieke waarden of publiek conflict: democratische grondslagen voor de slimme stad

    Public values and citizen participation are key terms in smart city discourse that are propagated by all its actors, from governments to corporations and civil society. Nevertheless, the design and development of smart cities are hardly ‘public’ as some publics and some forms of participation are never included. This is particularly visible in current protests against a key enabling technology for smart cities, 5G. These contestations tend to be considered ill-informed and irrational, while their methods are seen as conflictual rather than helpful. In this article the author argues that the public value approach to smart cities is rooted in a deliberative perspective of democracy, while the tensions that are produced by 5G and other forms of anti-technological protest are better understood as part of agonistic democracy. Such conflicts about the new smart technologies that are currently hidden from public sight need to be articulated and constructed as contentious issues for electoral politics, in order for the smart city to acquire its democratic legitimacy.

    This article deals with the relationship of smart security technologies to broader modes of exercising power and subjugating individuals. It claims that the notion of psychopower is precisely what is missing from post-Foucaultian accounts of the smart city. In the article psychopower is defined as the manipulation of our consciousness in order to channel our desires toward ‘normal’ social behavior, drawing a line between what is ‘acceptable’ and what is ‘unacceptable’. Psychopower raises a series of concerns related to its democratic legitimacy and accountability as behaviorally informed conditioning of the mind runs the risk of constant surveillance, where human agency is diluted in a techno-utopian vision that promises to improve city-wide efficiency, decision-making, and security.

    The recently cancelled Quayside smart city project in Toronto by Sidewalk Labs is an example of a top-down, tech-driven, intransparant model of a smart city, where government and citizens got sidetracked in the planning process. This article analyses what went wrong and proposes an alternative approach. Experts in the field – from data scientists to philosophers, sociologists and activists – propose a different kind of smart city. The open smart city is based on principles of open data, public digital infrastructure, and civic participation. It uses technology to strengthen public values, civic participation and human rights, instead of undermining them.

    This article focuses on the challenges associated with public-private partnerships in tackling drug crime in the port of Rotterdam. The authors identified the actors involved in the fight against drug crime and, more generally, security in the port. The authors show how these various actors view the subject of drug crime (so-called mentalities), what they set as objectives (finalities) and how they try to achieve these objectives. Subsequently the various aspects of the interactions between these actors are being analyzed. The article is empirically based on 76 interviews with public and private actors in the port of Rotterdam, that were conducted in the period from January 2018 to February 2019, and an analysis of literature, news items, government reports and other documents.

    Little is known about how ex-prisoners’ parole supervision experiences relate to desistance. The aim of this article therefore is to gain insight into the nature of release conditions and parole supervision of ex-prisoners and parolees’ perceptions of their supervision related to the desistance process. A total of 23 Dutch parolees were interviewed in depth at three waves starting in prison up to one year after their release, and the 69 interviews were combined with their parole files containing information about conditions, violations and sanctions. Parole files revealed the practice of highly engaged parole officers, who worked with parolees to strengthen factors known to foster desistance. However, the interviews showed that most parolees found their parole experience predominantly surveillance-oriented and not very helpful for desistance. Parole was experienced as most beneficial when parole officers used their discretionary power to adjust conditions creating ‘space’ for trial-and-error.

    In this article the author asserts, based on his own experiences in this field, that the independence of research and researchers is not a given, but must always be conquered and defended. He relates the necessity of doing commissioned research to developments in Dutch legal academia and describes its strengths and weaknesses. He then makes the comparison with ‘pure’ academic research. He shows that most lecturers must fight and defend their independence against all sorts of developments within the modern university. There is not much room anymore to do one’s own free research. He concludes that neither academic nor commissioned research takes place in a vacuum without power relations.

    Governments have a great need for policy-relevant research. The Dutch government obtains part of this research from the so-called state knowledge institutions: public research organizations that support ministries in the preparation and implementation of policy. To be able to provide reliable research, state knowledge institutions must be able to act independently and with integrity. But to be policy-relevant, they must maintain in close contact with ministries. Proper handling of this tension does not only requires ‘hard’ formal rules, procedures and codes of conduct, but also ‘soft’ informal institutions, such as awareness, dialogue, education, and culture. Implementing this is a shared responsibility of both the research organizations and the ministries.

    In Dutch courts several pilots are being carried out in order to enhance the quality of civil procedure. The main focus of the pilots is to speed up the procedure and make it more cost-effective, while ensuring the procedure is easily accessible and is overseen by a mediating judge in a nearby court. This focus largely corresponds with aspects of the civil procedure that the courts and the minister of Justice have identified as in need of attention. The courts and the minister have focused on different specific problems and propose different solutions, however, and neither aims to address the quality of civil procedure as a whole. It is doubtful whether the proposals for improvement, put forward by the courts and the minister, can address the concerns they have intended to resolve and whether the overall quality of the civil procedure (for all civil cases instead of the simple ones) will be improved. Solutions to the problems of the civil procedure cannot be devised without first developing a clear picture of the problems people experience with civil procedures and the courts.

    Socially effective justice requires innovative legislation that allows the judge to experiment with simple procedures that bring parties together in order to prevent escalation of disputes. For that reason, the Dutch government has enabled experiments with low-threshold local civil courts. This article focuses on the experiences with such a court in Rotterdam. The court provides a simple, fast and cheap procedure with the aim of reaching a solution to the dispute in joint consultation. The article provides insight into the nature and the number of disputes that have been dealt with up to now.

    The last decades have shown a tendency in which tasks are transferred from the judge to other authorities, such as the police and public prosecutor, administrative bodies, administrative procedures, or private parties. The central question in this article is whether these authorities can really replace the court. A comparison is made between legal proceedings and procedures for other authorities on the following aspects: truth finding, openness and legal protection of the (vulnerable) citizen. The author also discusses a recent legislative proposal for an own budget for the Judiciary, which aims to strengthen the independence of the judge towards the two other state powers. It is argued that the courts should be also accessible in the case of relatively small offenses and for vulnerable citizens.

    This article describes the backgrounds, the development and first findings on youth courts in the Netherlands. A Dutch version of the USA youth courts was developed and piloted in 4 Amsterdam schools. Cases referred are small (partly illegal) incidents committed in the school environment. The Dutch youth court practice is described against the background of transformational change in society and the development of restorative justice and (peer oriented) development of citizenship. Although the model is still in development and schools are somewhat reluctant to deliver and refer cases, practice is growing.

    In mid-August 2017, the Minister of Justice and Security prohibited the controversial preacher Jneid from exhibiting in the vicinity of ‘his’ bookshop, annex mosque in the Schilderswijk in The Hague. By means of this ban, the minister wanted to prevent Jneid from carrying out his ‘intolerant’ message any longer in an environment where many young people are susceptible to radicalization. The Temporary Act on Counterterrorism was supposed to provide an adequate basis for such a ban. This article argues that a measure restricting the freedom of movement with the aim of preventing someone from conveying his message is against the constitutional prohibition of censorship and may therefore not be imposed.

    There are different types of banning orders (criminal, administrative and private banning orders) and also various procedures for imposing these orders. According to the case law of the European Court of Human Rights (EctHR) it is unlikely that the private banning orders can be labelled as a criminal charge. The nature of the private banning orders is not punitive. These orders are to be regarded as recovery sanctions. However, applying the ‘Engel criteria’ will lead to the conclusion that some criminal banning orders are to be considered as a criminal charge. Accumulation between criminal and private law banning orders might be troublesome, but it is possible. It is recommended that the Public Prosecution Service is cautious when it comes to demanding a criminal banning order, when a private banning order has already been imposed.

    This article maps the current Dutch practice on statelessness, and tries to expose the current issues in particular. The published legislative proposal for a statelessness determination procedure in September 2016 is an attempt by the Dutch government to solve part of these problems after wide criticism from, among others, the Advisory Committee on Migration Affairs (ACVZ) in 2013. The introduction of a statelessness determination procedure is a long awaited development and a step in the right direction with a view of improving current practice and law for stateless persons residing in the Netherlands. However, significant deficiencies in the legislative proposal risk to greatly undermine the operation and value of the new procedure, especially for those currently left in limbo and excluded from society. This article focuses on the shortcomings in the procedure and provides recommendations how to revise these to ensure that stateless persons are enabled to demonstrate their statelessness adequately and obtain the rights associated with it as intended in the Statelessness Conventions signed by the Netherlands.

    Individuals with a mild to borderline intellectual disability (MBID) are thought to be over-represented in the criminal justice system. The current article reviews research on the associations between executive functioning with antisocial behavior and MBID. Associations with executive functions such as working memory, inhibition, planning and cognitive flexibility, as well as punishment and reward sensitivity, are described. Working memory appears particularly strongly associated with antisocial behavior as well as with MBID. Research on MBID to date, however, almost exclusively focused on children and adolescents. More research on these issues could provide practical information for supervision as well as aid the adaptation or development of interventions for this population, and provide tools to allocate individuals to interventions tailored to their specific needs.

    Drawing on material from her extensive study of Russian organized crime, the author sketches a portrait of Semjon Mogilevitsj. This Russian ‘godfather’ enjoys the reputation of being the smartest and highest educated mafia boss worldwide. Indeed Mogilevitsj obtained a master’s degree in Economics with good results, but this alone doesn’t explain his phenomenal successes in criminal as well as in legal business. Describing the steady expansion of his criminal activities from Russia into Israel, the United States, Eastern Europa, Italy and Canada, the author suggests that the social and economic circumstances in Russia just before and during the collapse of the Soviet Union might have served as an ideal playing ground for Mogilevitsj to develop the specific social intelligence and skills needed to successfully run a criminal organization.

    In criminological literature there is an ongoing discussion about the relation between intellectual disability and criminality. Because of differences of definitions and measurement methods prevalence figures may vary. Recent assessment of prevalence in the Netherlands using a valid Dutch screener (the SCIL) reveals a relatively high percentage of people with mild intellectual disability and borderline intelligence in the Dutch criminological system. People with mild intellectual disability and borderline intelligence cannot be considered as belonging to one group. Five typologies with even more subtypes based on mixed characteristics can be distinguished. A need for early detection and personalized interventions is stressed as is treatment based on the specific characteristics of these subtypes.

    In recent years, there are signs that young people with a (mild) intellectual disability are overrepresented in the criminal justice system. It turns out that especially a large majority of the repeated offenders have an intellectual disability. Therefore it would be relevant to know whether and when an intellectual disability is recognized by professionals in the criminal procedure. What is the impact of not recognizing the specific disability on the offender in the criminal justice procedure and on recidivism? The author focuses on a rather new accelerated out-of-court settlement of criminal cases, the so-called ZSM method. She concludes that the high speed of this procedure increases the vulnerability of suspects with a (mild) intellectual disability, especially because the various professionals involved in this procedure seem to lack substantial awareness of the problem. This situation increases the risk of false confessions and witnessing and might also contribute to recidivism.

    There have been little to no empirical research conducted on trust of Dutch citizens in the police. This study is a step towards filling this gap. We used semi-structured interviews, questionnaires and observations to examine to what extent citizens’ trust in the police is determined by perceptions of the effectiveness of the police to reduce crime and disorder and perceptions of procedural justice. Research was conducted in Bloemhof, a superdiverse neighbourhood in Rotterdam. The results indicate that in superdiverse neighbourhoods perceived responsiveness is the cornerstone for explaining police trustworthiness. Implications for policy reform are discussed.
