    This article collects publications in this journal about the emergence and effects of legislation. It covers the developments and results of research of the last four decades. First it is concluded that there has been considerable attention to the subject. Second a clear broadening and (theoretical) deepening from different perspectives can be observed. Social-legal research of legislation also appears to have specific characteristics. Subsequently, various points of attention are pointed out, such as more attention to the relationship between legal characteristics and effects, more variation in research methods and more systematic theory-driven research. Finally, attention is drawn to the relationship between (the working of) legislation and social transformations such as globalization, digitization and the increasing and profound influence of social media in society.


Bert Niemeijer
Bert Niemeijer is rector van de Academies voor Wetgeving en Overheidsjuristen in Den Haag en bijzonder hoogleraar Empirische Rechtssociologie aan de Vrije Universiteit Amsterdam. Hij is lid en voorzitter van de redactie geweest en is op dit moment lid van de redactieraad.

    Judges in the Netherlands have recently expressed their concerns in the media over the organization of the judiciary and the pressure to deliver output. At the same time, they consider themselves highly loyal to their work. In this article we explore this seeming contradiction by studying the developments in the selection, training and organisation of the judiciary and considering the consequences that these developments could have on the loyalty of judges. In doing so, a distinction is made between loyalty to the profession, to the organisation and to colleagues. We follow Hirschman's theory on Exit, Voice and Loyalty and determine that the act of judges expressing their concerns (instead of exiting the judiciary) is essentially a sign of their loyalty. However, we reason that this displays more loyalty to the profession than to the organisation. Due to changes in the selection and training of judges, more candidates who were formerly employed in other settings, e.g. in advocacy, will enter the profession. With their socialisation taking place in a more business-like setting, where values such as efficiency and productivity are significant, it is expected that they will be more willing to accept the new public management values which are criticized by the present generation of judges.


Nina Holvast
Nina Holvast is promovenda bij het Paul Scholten Centrum van de Universiteit van Amsterdam. Zij schrijft een rechtssociologisch proefschrift naar de rol van juridische ondersteuning in het rechterlijk besluitvormingsproces. Over dit onderwerp verschijnt binnenkort: ‘Considering the consequences of increased reliance on judicial assistants: a study on Dutch courts’ in International Journal of the Legal Profession.

Nienke Doornbos
Nienke Doornbos is universitair docent en onderzoeker bij de Faculteit Rechtsgeleerdheid van de Universiteit van Amsterdam. Zij doceert de minor Rechtswetenschappelijk onderzoek en het vak Recht en menselijk gedrag. Haar onderzoek richt zich onder meer op organisatorische kanten van rechterlijke besluitvorming en op toezicht en tuchtrecht binnen de advocatuur.

    The distance between the public and the judiciary takes two forms: a punitivity gap and an accessibility gap. This article discusses both types of gap and elaborates on the issue of whether the existence of these gaps influences confidence in the judiciary. From the literature, it appears that the public is generally of the opinion that courts sentence too leniently. However, experiments show that when citizens receive information on a specific case, they become less punitive. Information provision may also help to bridge an accessibility gap, as does actual citizen involvement in the administration of justice. The relation between the gaps discussed and confidence in the judiciary is not clear as yet. The article discusses methods generally used to assess confidence and suggests that confidence may be increased by a reduction of the two gaps.

    Transparency of institutions like the judiciary is often assumed to increase confidence. However, a recent survey concerning opinions about the judiciary showed that in many cases one trusts the judiciary without having any special interest in the judiciary itself. It revealed that confidence in the judiciary depends on various factors like anomy, social trust, general institutional trust, personal experience and feelings about a fair chance in a hypothetical case for court. And transparency will not easily change these factors. Furthermore, providing information can both strengthen and weaken confidence due to the personal backgrounds of those receiving the information. Finally, this paper discusses whether strategic and positive information that is needed to increase confidence allows for drawing one’s own conclusions as transparency promises.

(Kagan and Skolnick 1993: 85) The empirical study of the relation between the way a law comes into being and its effectiveness in practice is an underdeveloped subject in the sociology of law. In this article this relation is studied with respect to smoking bans in the Netherlands. The focus is on private companies in general, with special attention for Dutch cafés, bars, hotels and restaurants (where such a ban was recently introduced). Dutch smoking bans in private establishments were only enacted after the government was convinced of public support and after a period of selfregulation. This proved to be a good preparation. The general picture of the relation between the emergence and the effectiveness of smoking bans in Dutch hotels, restaurants etc. is much the same. However, there is one sector - bars, pubs and the like – in which the smoking ban has encountered problems. In this sector a fourth of the establishments refuse to comply. A question addressed in this article is whether the legislator acted too precipitously with respect to this sector. This is obviously the case: there is less public support for smoking bans in such establishments and there had not been a preparatory period of selfregulation.

Heleen Weyers
Heleen Weyers is universitair docent bij de vakgroep Rechtstheorie van de faculteit Rechtsgeleerdheid van de Rijksuniversiteit Groningen. Ze promoveerde op een onderzoek naar de totstandkoming van de euthanasieregelgeving in Nederland. Sindsdien publiceert zij onderzoek waarin de verklarende kracht van veranderingen in waardes en vertrouwen voor de totstandkoming van dit type regelgeving wordt onderzocht.
