In the past five years, the Council of State, the National Ombudsman and several academics have criticized the way in which new legislation has been made. In their view, principles of law and the rule of law are insufficiently uphold due to an instrumentalist view on law. This criticism urged the authors to conduct an empirical study into the question how legislative drafters deal with legislative plans which are problematic from a legal or rule of law point of view, and how they justify their role in the legislative process. This study is explorative and qualitative in nature. During the summer of 2018, 24 legislative lawyers from five different Dutch ministries have been interviewed. The results show that the role of legislative lawyers can best be characterized as constructively critical. As their tasks encompass much more than solely the actual drafting of legislation, they more and more resemble their colleagues from the policy department. The authors suggest that legislative lawyers should articulate their distinctive professional ethics in order to strengthen the checks and balances within the ministries. |

This article analyzes the relation between law and citizenship on the basis of five modalities. This analysis is premised on the observation that citizenship plays a central role in the contemporary debate about the development of political communities. Furthermore it is obvious that citizenship is inextricably linked to law, but it is not easy to get a clear and complete picture of this link. This is due to, on the one hand, the versatility of the concept of citizenship, and the versatility of the phenomenon law on the other. In short, the relation between law and citizenship is multifaceted, which the typology of modalities is meant to reveal. |

In the Netherlands, the way in which judges behave and communicate during hearings is increasingly being emphasized. This is related to the implementation of post-defence appearance in Dutch civil hearings (comparitie na antwoord) and a more general, albeit cautious, shift from dispute resolution, focused solely on resolving the legal aspects of a case, towards broader conflict resolution, in which other aspects of a case are considered too. This article compares how six judges managed a civil hearing of the same case. It seeks to explain the different outcomes that resulted from these judges’ hearings (i.e. settlement/judgement/referral to mediator) and seeks to identify what different ways of managing hearings imply for a possible shift from dispute resolution to conflict resolution. The empirical study found that the judges’ preparation of the case and their way of beginning and structuring the hearing were very similar; they also discussed similar subjects. Differences were found in how the judges interacted with the parties; the skills they used during hearings; how they used a specific skill; and in how they guided parties in the decision-making process about the outcome. No strong correlation emerged between a specific type of hearing management and the type of outcome selected. Interviews with the judges suggest that the explanation for the different outcomes lies partly in the judges’ personal views (on the appropriate outcome). Such beliefs influence how the judges manage a civil hearing, and indirectly the outcome of a case as well. These findings imply that for a shift from dispute resolution to conflict resolution to materialize, this will require judges to develop a common understanding of their responsibilities and to enhance their skills. They will also need to verify their assumptions more, so that the parties’ needs and the judge’s personal beliefs are better matched. |

Most research on food safety has focussed on direct forms of food safety regulation. This paper explores the opportunities for product liability law to encourage food safety measures within firms. It aims to contribute to the discussion on the role public and private actors could have in providing an effective food safety system. Liability law is assumed to promote food safety. The author distinguishes three ways in which liability law could act as an incentive for firms to implement enhanced food safety controls: liability claims, liability insurance and direct effects of liability law on management strategy. The paper concludes that the assumption that liability laws make firms sensitive to prevention of food safety risks is too optimistic. However, liability law could stimulate a culture within firms to take responsibility for food safety. Existing economic and legal analysis could gain from a sociological analysis of the actual impact of liability on company decisions. |
