John Griffiths’ streven naar een theoretisch kader voor de rechtssociologie

    This contribution focuses on John Griffiths’ relentless attempt at developing a general theoretical perspective for socio-legal studies. Hence, attention to Griffiths’ important contributions to legal pluralism and the social working of law approach is paid only in passing. Similar to a much earlier assessment, the analysis of Griffiths’ proposal in this contribution is quite critical. Measured against five criteria this author deems important for any socio-legal theoretical framework, the verdict is that Griffiths’ proposal falls short of all of them. The analysis itself focuses primarily on Griffiths’ attempt to redefine the subject for socio-legal studies in terms of social control, the way he uses the concept ‘law’, and his primary focus on rules and rule following. One overall conclusion is that Griffiths remained a legal scholar to a much greater extent than he would have liked.


Roel Pieterman
Roel Pieterman (1953) is hoofddocent rechtssociologie aan Erasmus School of Law. Zijn onderzoeksbelangstelling is vooral gericht op de politiek-juridische omgang met ‘risico’s’. In die lijn schreef hij De voorzorgcultuur (2008) en Gewicht zit niet tussen je oren (2017). Zijn voornaamste onderwijstaak betreft het verzorgen van inleidend onderwijs in de rechtssociologie. In die lijn heeft hij, vooral in de jaren 1990, veel gebruikgemaakt van de door John Griffiths geredigeerde ‘RUG-bundel’. In die periode hield hij zich, evenals John, bezig met onderzoek naar een geschikt theoretisch kader voor de rechtssociologie. Het resultaat daarvan publiceerde hij in 1998 in Recht der Werkelijkheid. In dat tijdschrift discussieerde hij in die periode diverse malen met John over de vraag wat een goede benadering zou zijn.

The precaution controversy: an analysis through the lens of Ulrich Beck and Michel Foucault

    According to the precautionary principle lack of scientific evidence for the existence of a certain (environmental) risk should not be a reason not to take preventative policy measures. The precautionary principle had a stormy career in International environmental law and made its mark on many treaties, including the Treaty on the Functioning of the European Union (TFEU). However it remains controversial. Proponents see it as the necessary legal curb to keep the dangerous tendencies of industrial production and technology in check. Opponents regard it with suspicion. They fear it will lead to a decrease in freedom and fear the powers to intervene that it grants the state. In this article the principle is reviewed from the perspectives of Ulrich Beck’s ‘reflexive modernisation’ and Michel Foucault’s notion of governmentality. It is argued that from Beck’s perspective the precautionary principle is the result of a learning process in which mankind gradually comes to adopt a reflexive attitude to the risks modernity has given rise to. It represents the wish to devise more inclusive and democratic policies on risks and environmental hazards. From the perspective of Michel Foucault however, the principle is part and parcel of neo-liberal tendencies of responsibilisation. Risk management and prudency are devolved to the public in an attempt to minimise risk taking, while at the same time optimising production. Moreover, it grants legitimacy to state intervention if the public does not live up to the responsibilities foisted on it. Both perspectives are at odds, but represent different sides of the same coin and might learn from each other concerns.

    Seeing that the role of opinio juris in the identification of customary international law is essentially contested, this contribution seeks to explain how this concept plays a fruitful role in legal doctrine despite of, or perhaps even due to, this essential contestedness. To that effect the paper adopts a constructivist perspective, primarily drawing from Bourdieu’s theory of practice and Berger & Luckmann’s ideas about institutionalization. In this perspective, contested concepts such as opinio juris are conceived of as multifaceted tools of knowledge production in the hands of members of epistemic communities.


Associate Professor Olaf Tans
Olaf Tans works as legal philosopher and political scientist at Amsterdam University College and the Centre for the Politics of Transnational Law. His contribution to this special issue is part of a research line focusing on the social construction of normativity in legal doctrine. He has also published about constitutionalism, citizenship, democracy, and most recently (e.g. in Ratio Juris and Law & Literature) about the use of foundational narratives in public deliberation and law-finding.

    In continental Europe, post-war sociology of law passed through diverse phases, swinging between grand theorizing and empirical research. In the last two decades, socio-legal studies have shown a more balanced approach with respect to these models. Neo-functionalism à-la Luhmann still takes the lead in high theory, although some more eclectic voices make themselves heard and some signs of renaissance of conflict theories have become visible again. Through an overview of the recent editorial policy of three influential journals in France, Germany and Italy, the author highlights that middle range socio-legal theory has successfully dealt with some relevant aspects of legal change of the last decades, in such fields as criminal justice, migrations, or family law. Yet, it has left aside other and no less important aspects, such as commerce and property laws, common goods, environment, and other crucial questions of our times. Thus, there is a risk for sociology of law not to perform its critical and pioneering task that belongs to its own tradition.

Vincenzo Ferrari is emeritus professor of philosophy and sociology of law. He has taught in the Universities of Cagliari, Bologna and Milan, and has been a visiting professor in diverse world’s academic institutions. He chaired the ISA Research Committee on Sociology of Law and was among the founders of the IISL, Oñati.

The government’s roles in transnational forest governance

    Forest certification schemes and the legality regime are two main methods of transnational forest governance. A recent review of the literature has revealed that the government and forest certification are often intertwined. Based on that review, this contribution argues that governments play divergent roles in forest certification schemes in different aspects of the regulatory process: namely, agenda and standard setting, implementation, monitoring, and enforcement. In most FSC schemes, governments in developed countries play a less active role in most of these aspects than they do in context-based industry-dominated schemes. In the three emerging economies examined – Indonesia, Brazil, and China – the government sometimes plays a more active role in context-based, industry-dominated schemes than it does in developed countries. The rising legality regime might further strengthen the role of the government in forest governance in these emerging economies. Moreover, China may exemplify the fact that forest governance is entering a new phase, because the country not only exports to countries demanding legal verification, but also imports from countries where the risk of illegal logging is high. This illustrates that the role of governments in forest governance is constantly evolving.

Liu Jing is a postdoctoral researcher in Erasmus University Rotterdam (the Netherlands). She is conducting research on ‘smart mixes in relation to transboundary environmental problems’, especially in the areas of forest, fishery, oil and climate change governance. Her research interests cover regulation and governance, environmental law as well as law and economics.

    Citizenship is a notoriously complex and an essentially contested concept which has been defined in many different ways. The only stable element in all these definitions seems to be that citizenship is primarily described in terms of the relationship between the political community and the citizen. This article aims to explain why citizenship is such a contested concept by showing that it is embedded in three very different normative traditions: the liberal conception of citizenship as a (legal) status, the republican conception of citizenship as an activity and the communitarian conception of citizenship as identity. Each approach emphasizes an important element of citizenship, but none of the three is comprehensive enough to provide a complete picture of what citizenship implies in contemporary constitutional democracies. At the same time they cannot simply be merged because they come from different normative traditions among themselves at odds with each other.This article starts by illustrating the three conceptions of citizenship on the basis of the underlying theoretical models: liberalism, republicanism and communitarianism. Section 3 discusses two mutual tensions between different conceptions of citizenship: first between the liberal and republican conception and then between the liberal and republican conception on the one hand and the communitarian conception on the other. In Section 4, this conceptual analysis is used to analyze a policy terrain that is explicitly embedded in the idea of citizenship, namely the integration of immigrants through naturalization policy. Section 5 concludes.

Citizenship in Transnational Social Spaces

New Ways to Study Socio-legal Boundaries

    In order to establish and evaluate the significance of changing socio-legal boundaries and how these are mirrored in citizenship, cross-border formations of the social and citizenship rules must be discussed. The first part of this paper deals with changes in social boundaries across state borders and presents three generations of transnational studies. Based on this, the second part asks how legal boundaries have changed in the case of dual citizenship and supranational social citizenship. Citizenship is a particularly important issue because it sits at the intersection of social and legal boundaries. There is a growing tolerance toward dual citizenship and the evolution of supranational citizenship, one in which migrants enjoy a transnational life that is supported by the implementation of human rights principles in national constitutions, legislation and in European Union court rulings.

Thomas Faist is professor in the Department of Sociology, Bielefeld University. His fields of interest are transnational relations, citizenship, development and migration. He held visiting professorships at Brandeis University, Malmö University and the University of Toronto. Thomas Faist serves on the editorial board of The Sociological Quarterly, Ethnic and Racial Studies, Migration Letters, and South Asian Diaspora. He recently co-edited Migration, Development and Transnationalisation: A Critical Stance (Berghahn 2010), Diaspora and Transnationalism: Concepts, Theories and Methods (Amsterdam University Press 2010) and The Migration Development Nexus: Transnational Perspectives (Palgrave Macmillan 2011).
