    On 1 January 2015 a new arbitration act entered into force in the Netherlands. This article discusses the main amendments to the old legislation. The purpose of this new act is to improve the efficiency and flexibility of the arbitration process. Partially, the changes consist of codification of existing case law. However, also new elements are introduced such as for example the possibility of remission. Another reason for this revision of the arbitration legislation is to make the Netherlands internationally more attractive as an arbitration venue.
    The main changes are related to, for example, the enforcement proceedings, which are significantly shortened for foreign awards, and making the annulment procedure more efficient. Furthermore, consumers are given more protection from arbitration clauses in general conditions, the rules regarding the challenging of arbitrators are amended and allow for the appointment of a third party to decide on the challenge. Summary proceedings are introduced as a possibility. The registration of the arbitral award with the district court is no longer required.

    Managing commercial conflicts requires reflexivity: the description of the conflict influences the manner in which the conflict is handled, and changing this description may influence this approach and the desirable outcome. The Belgian law firm contrast was curious to find out more of different parameters influencing the manner in which a conflict is handled. It developed an in-dept questionnaire and submitted it to 40 participants. The findings of this research are commented.

    This diptych consists of two articles: the first, The Rise and Fall of Mediation in Italy, by Elisabetta Silvestri, analyzes the way in which the Italian Constitutional Court has recently (October-December 2012) struck down a Decree that had introduced mandatory mediation in a wide range of civil procedure areas in Italy. The second article, The EU’s Italian Job, by Rob Jagtenberg, discusses the way in which the Advocate-General with the Court of Justice of the European Union has dealt with the request for a preliminary ruling on the compatibility of the same Decree with European law (Opinion of 19 April 2013). It appears that at both Court levels, the subject was perceived as too risky to judge on the merits: mandatory mediation thus ends as a potato too hot to hold in a court’s hand.

    In TMD 2009-2 the article ‘Case study: the international CSR conflict and mediation. Supply-chain responsibility: western customers and the Indian textile industry’ was published. In this article, Tineke Lambooy describes the ins and outs of the multiparty dispute between G-Star, in origin a Dutch company, the Indian-Italian Fibres & Fabrics, the employees of Fibre & Fabrics International, the governments involved and a number of non-governmental organisations striving for good labour relations and labour conditions. Lambooy’s article resulted in four reactions that are published in this article.
