Marc Juston
Marc Juston, Président de Tribunal honoraire, a au cours de sa carrière de magistrat, occupé tous les postes spécialisés du Siège, dans sept juridictions différentes. Il exerce actuellement des fonctions de magistrat à titre temporaire au Tribunal de grande instance d’Aix en Provence (13) affecté au Tribunal d’Instance de Martigues (13), et de formateur spécialisé en droit de la famille et en procédure civile, notamment les modes amiables de règlement des différends, dans lesquels il est investi depuis plus de vingt ans. Il a écrit une centaine d’articles dans des revues juridiques et sociales. Il est Chevalier de la Légion d’Honneur.

    Following an overview of the historical place of mediation in China, this contribution summarizes the outcomes of a Euro-Chinese symposium held in Beijing on 1 and 2 September 2012, focused on mediation as a case management tool for the courts. In China, mediation appears to be on the rise again since a few years, reconquering its traditional predominant place in China, after a decade of increased litigation during the period of rapid economic growth. The pressure on Chinese courts to make the parties settle raises some questions however about how to assess whether private mediation or public litigation is indicated, and by which evidence-based standards.

    This article examines the Belgian legislation aimed at safeguarding the confidential nature of mediation. It takes the perspective of all actors involved in the mediation process: the parties to the dispute, the mediator and experts or witnesses who participate in the mediation.

    In 2008, Ruud Lubbers led a mediation process to resolve the conflicts which had arisen between two Dutch campaigning organisations, various Indian non-governmental organisations (NGOs) and labour unions, two Dutch internet providers, an Indian clothing producer and a Dutch jeans brand. The mediation took place at the request of the disagreeing parties and the Dutch and Indian governments. The conflict related to corporate social responsibility (CSR) standards followed by the textile companies.In this contribution the effects of campaigning and litigating in issues concerning CSR will be examined. Limiting the analysis to CSR conflicts in the textile industry, the author will reflect on these new types of international conflicts in a globalising world and will share her view on appropriate ways to avoid them or, ultimately, to (re)mediate them if necessary.This contribution informs the reader about the events in India and the Netherlands which led to the escalation of the conflict. It provides an overview of the conflict resolution procedures and elaborates on the outcome of the ‘Lubbers Mediation’. The applicable legal and soft law labour standards are compared as well as the parties’ communication strategies. Lastly, this case is contrasted with other CSR conflicts in the textile industry, revealing a hidden conflict.

Tineke Lambooy is a Senior Researcher at Nyenrode Business University (Nyenrode) in the field of corporate social responsibility (CSR) and she lectures in Legal Aspects of Globalisation-CSR, and Mergers & Acquisitions at Utrecht University, the Netherlands.
