    This research aims to contribute to the development of an adequate handling of the complex, conflictual family situation that occurs during a parental abduction. The following research question is answered: to what extent can the methods of conflict resolution – in the Belgian context – be optimized so that the interests of the child are guaranteed, in the light of the theoretical insights provided by Glasl’s conflict theory? Attention is paid to the limited effectiveness of legal procedures on the one hand and the mediation on the other. The method of de-escalation, developed by Glasl, offers a useful diagnostic tool for the conflict counsellor. In addition, the metaphor of the ladder he uses is extremely valuable as a tool for gaining insight into the mechanisms of conflict-escalation. A clear theoretical framework for the judiciary in the interpretation of an escalated conflict can lead to a better understanding of the possibilities and limits of cooperation between ex-partners, which benefits the best interests of the child.

    With a Belgian law of June, 18 2018, the principle of the voluntary nature of mediation was affected. A lot of critical comments can be made at this point. The scope of the obligation is not clear. Mandatory mediation raises the threshold to the court and has as effect that many cases are not handled in the most appropriate way. The bar doesn’t support the measure. Research is needed to find out if the new measure is justified.

    Recently, a new law with articles concerning mandatory mediation was approved in Belgium. From January 1st, 2019, the judge will be able to refer parties to mediation on a mandatory basis. This article considers if mandatory mediation is a realistic and feasible track in Belgium, focusing on the evolution of alternative dispute resolution in Belgium and in the European Union. The first part will define mediation in Belgium, followed by an analysis of the articles concerning mandatory mediation of the newly passed law. The article will also have a gander at Belgian legal developments to see which initiatives have already been taken towards mandatory dispute resolution. To conclude, an assessment is made if mandatory mediation is a realistic and feasible track in light of the existing evolutions of ADR in Belgium.

    Dispute Boards are an alternative ‘real time’ method to avoid disputes. If no settlement can be reached the board will issue a decision which is contractually binding for all parties involved. This way costly arbitrations or court procedures, which generally only start at the end of projects with negative effects for both employer and contractor, are avoided. DBs are especially suited for construction sites and longterm contracts. They have a positive effect on the total cost of the project and avoid delays in the handing over at the end of the project. FIDIC, ICC are already using a special DB-article in their general contract conditions. The Worldbank, JICA, the EIB and MDBs are also using this method when financing international investment projects. Setting up a DB with three members right from the start of a project seldom costs more than 1% of the contract price of the project.

Enforceability of mediation clauses in Belgium and the Netherlands

    In this article authors discuss (possible) legal means and methods aimed at making mediation clauses effective and/or enforceable. In particular Belgian and Dutch law are examined. In part attention is also paid to English, French and Italian law. Against the background of recent EU-legislation the validity of mediation clauses is discussed as well, with a focus on consumer related disputes. By reviewing US case law with regard to the duty to participate in good faith in the mediation process, the authors also outline the limits of this concept for the effectiveness of mediation clauses. The central theme of the enforceability of mediation clauses has been looked at both from a procedural as from a financial angle. Substantial differences can be noted between the Belgian and the Dutch approach towards what courts should do when dealing with a dispute in which parties have previously agreed to mediation. Belgian law provides in art. 1725 § 2 Judicial Code that the court, if so requested by the defendant, is in principle obliged to suspend the examination of the case until the mediation has taken place. According to current case law, the situation in the Netherlands is that mediation clauses are in principle not enforceable (Supreme Court 2006). Following the most recent legislative proposal regarding mediation (July 2016) the court should examine whether mediation can still have an added value in case one party refuses to take part in a mediation as provided for in a clause invoked by the other party, prior to (possibly) proposing mediation. Based on the plans repeatedly announced by the Belgian Minister of Justice, it is likely that there will soon be an amendment to the mediation provisions in the Judicial Code that will allow courts to ‘force’ mediation upon the parties, even in the absence of a mediation clause. If this becomes the rule, judges would be well advised to exercise this power with due care. In the authors’ opinion the Dutch approach (as suggested in the most recent legislative proposal) in connection with mediation clauses, consisting in having the court examine whether mediation may (still) have an added value for the parties, could serve as a good guideline for the Belgian judges to use.

    Care providers establish often long term relationships with their clients. It is of paramount importance that the threshold for a complaint or dispute resolution is preferably low. Ideally this is not a ‘mini-trial’ in which care provider and client are opposed against each other, but a constructive dialogue at a round table guided by a skillful complaints officer. This is what has been introduced by the Healthcare Quality, Complaints and Disputes Act (the Wkkgz).
    The new complaint system introduced with the Wkkgz applies to care covered by the Chronic Care Act (WLZ), the Healthcare Insurance Act (ZVW) and optionally can also apply to care based on the Social Support Act (WMO 2015).
    In my opinion it is a missed opportunity that the legislator has not introduced a similar complaint procedure in the Youth Act, but instead has chosen the ‘mini-trial’ option here. Moreover, it is also confusing for care providers and clients to follow different complaints systems next to each other.
    Finally, in psychiatric care where decisions of care providers can interfere with the right to self-determination there is a separate complaint procedure with a role for the Family Court. For all other run-of-the mill issues also in the psychiatric care the Wkkgz complaint procedure applies.

    This article is about the process of Collaborative Practice, also known as Collaborative law, and more specific collaborative divorce. The aim of this article is to explain what the process entails, when it can be used, what the benefits for clients are and what a professional can gain by making this method his own.
    The history of the Collaborative Practice process and the manner the process was introduced from the United States to Europe are reported. Furthermore, the development of the Collaborative Practice community in Europe, with a focus on the expansion in the Netherlands and Belgium, is described.
    On the basis of a practical case the process will be explained and the findings, experiences and reviews from the multidisciplinary team and the clients will be exemplified.

    Over the last years the expectations of Belgian clients have changed and the Flemish lawyer needs to adapt his positioning. Clients are looking for a personalized solution that not only provides a solution for the substantive (pure legal) aspect of the dispute, but also meets, at least takes into account, the more emotional and relational aspects of the conflict.
    In collaborative negotiation (also called principled or interest-based negotiation), the approach is to treat the relationship as an important and valuable element while seeking an equitable and fair agreement for all parties.
    As part of the collaborative law method, each party engages its own specially trained Collaborative attorney whose job consists in helping to settle the dispute outside the court. If one of the parties however decides to go to court, the collaborative law process terminates and both attorneys are disqualified from any further involvement in the case.
    The Association of French- and German-speaking Bars of Belgium has integrated collaborative law in its code of ethics. The Association of Dutch speaking Bars of Belgium looks in which way collaborative law can also become a part of the practice of the Flemish lawyer.

    Taking the recent European Commission’s Report on the application of Mediation Directive 2008/52/EC as a starting point, the authors set out to reconstruct the pattern of ADR/mediation activities undertaken by the EU and the Council of Europe over the past 40 years. The authors conclude that the European initiatives have been conducive to a broadening and deepening of the ADR debate. Remarkable shifts can be observed in the emphasis placed by the European agencies during this period, notably a shift from emancipatory to efficiency-based arguments. The inherent coupling of private mediation and public adjudication entails risks however for each of these distinct conflict resolution strategies. The authors call for advanced research designs to generate the data needed for a genuine evidence-based policy in this domain.

    Inclusive mediation involves a mediator whose neutrality is based on involvement with both sides of the dispute, and whose normative references are implicit; he or she is an insider. Exclusive mediation, on the other hand, involves a third party whose neutrality derives from his knowing neither disputant, and whose references to norms are explicit; an outsider, so to speak. The concepts of inclusive and exclusive mediation have been introduced by the anthropologist Carol Greenhouse in the 1980s. Inclusive mediation heavily relies on local knowledge and local ties, and its orientation can be labelled as horizontal. Basically, it fits small-scale societies, while exclusive mediation is more common in Europe and the United States. This article is about dispute settlement in an indigenous community in the Ecuadorian highlands, were I have encountered a unusual mixture of both forms: a local teniente político who applies inclusive as well as exclusive aspects of mediation at the same time.
