    Traditionally, it has been taught, or prohibited, for mediators to charge ‘success fees’ or ‘contingency fees’ as remuneration for the work they do. This article argues that such overall prohibition lacks nuances. Mediation rules and rules of ethics for mediators should not prevent the parties and the mediators from agreeing on some sort of higher remuneration in case of successful outcome of the mediation. There are limits. In particular, making the mediator’s remuneration a percentage of the settlement amount should remain prohibited.
    However, if the mediator’s interests are aligned with those of the parties, which shall frequently be the case, there should be no blank prohibition for the mediator to charge higher fees in case of successful outcome of the mediation process.
    There is a need for the mediator to be fully transparent about the system he proposes, which includes explaining to the parties and securing their understanding of the pros and cons of the remuneration system he suggests.

    On 23 April 2018, the Belgian Ministry of Labour, together with a consortium of 12 European research institutes, held a symposium on the current state of the art and best practices for conciliation and mediation in collective labour conflicts within the European Union, and particularly in Belgium. The symposium was organized for two occasions. First, the 50st anniversary of the Belgium law, providing mediation services by the Ministry of Labour to prevent and mediate in collective labour conflicts. Second, the presentation of the results of an EU (DG Employment, Social Affairs and Inclusion) sponsored project in 12 EU member states.
    The management of collective labour conflicts is in all countries regulated differently. The study shows that also practices of third party intervention differ largely. Most countries differentiate conciliation (a relative informal process of facilitated negotiation), mediation (usually defined as a strong involvement of the third party, who gives recommendations to the parties), and arbitration. Mediators typically are not trained, certified or registered as mediators in most countries. In all countries there is a large potential for conciliation, particularly in early stages of conflict (preventive mediation), as well as in rebuilding of trust after conflict episodes. Ana Belén García
Ana Belén García is senior researcher at the University of Seville and KU Leuven, working in the departments of work and organizational psychology. She was coordinator of several EU funded research programs on social dialogue in organisations. The most recent project was on mediation in collective labor conflicts in 12 EU member states. Ana’s interest is on conflict management and mediation in organizations. She was editor of two handbooks in the Springer Series ‘Industrial relations and conflict management’. Ana holds a PhD in Psychology and HRM from the University of Seville and KU Leuven. She is also a registered mediator.

Erica Pender
Erica Pender is a mediator and senior researcher at the University of Seville and KU Leuven in the department of Work and Organizational Psychology. She holds a PhD in Psychology from the University of Seville and KU Leuven focusing on trust and trustworthiness in organizations. After studying psychology at the University of Seville, she obtained her MSc at Maastricht University. She has coordinated two large-scale projects for the European Commission, and was co-editor of two handbooks in the Springer Series ‘Industrial relations and conflict management’.

Francisco J. Medina
Fransisco J. Medina is professor in social and organizational psychology, and Dean of the Faculty of Psychology and Educational sciences, at the University of Seville, Spain. His interests are conflict management, mediation and organizational development. He is engaged for many years in the development of labor mediation in Spain, providing training for mediators. He is also an experienced consultant and mediator. Francisco published both internationally and in Spanish extensively on conflict management and mediation.

Martin Euwema
Martin Euwema is professor in organizational psychology, and chair of the research group Organizational and Occupational Psychology and Professional Learning at KU Leuven, Belgium. He is also co-director of the Leuven Center for Collaborative Management and visiting professor at University of Copenhagen, IESEG-Paris, Sevilla, and Tsinghua (Beijing). He has extensive experience as consultant and mediator for both profit and non-profit organizations. His fields of expertise are conflict management, mediation, leadership, and organizational and team development.

    Over the last years the expectations of Belgian clients have changed and the Flemish lawyer needs to adapt his positioning. Clients are looking for a personalized solution that not only provides a solution for the substantive (pure legal) aspect of the dispute, but also meets, at least takes into account, the more emotional and relational aspects of the conflict.
    In collaborative negotiation (also called principled or interest-based negotiation), the approach is to treat the relationship as an important and valuable element while seeking an equitable and fair agreement for all parties.
    As part of the collaborative law method, each party engages its own specially trained Collaborative attorney whose job consists in helping to settle the dispute outside the court. If one of the parties however decides to go to court, the collaborative law process terminates and both attorneys are disqualified from any further involvement in the case.
    The Association of French- and German-speaking Bars of Belgium has integrated collaborative law in its code of ethics. The Association of Dutch speaking Bars of Belgium looks in which way collaborative law can also become a part of the practice of the Flemish lawyer.

    It is often assumed business mediation in The Netherlands is not used to its full potential. This article reports on 17 interviews with lawyers from leading Dutch business law firms about their considerations regarding mediation. Most reasons mentioned to turn to mediation are in line with the advantages of mediation described in the literature. Unique positive considerations are: (i) mediation may serve as a substitute for confidential discussions between lawyers and (ii) a mediator may help to sidetrack the sub-standard lawyer on the other side. Reasons mentioned to refrain from mediation are: (i) attempts to resolve the conflict have already been made at various hierarchical levels of the companies involved; (ii) for lawyers with adequate negotiation skills a mediator has little added value; (iii) parties require a formal judgement; (iv) mediation implies some sort of compromise; (v) lack of trust between parties; (vi) not knowing any sufficiently skilled business mediators.

    In this article the authors compare Belgian and Dutch (draft) regulation of mass damage claims, and notably the prominent place reserved for the collective amicable settlement of such claims. Though collective action for the recovery of damage is still not possible in the Netherlands, Dutch law does provide for the possibility of the court endorsing collectively agreed settlements, since 2005. One of most notorious settlements, i.e. the Dexia case, is discussed, illustrating how individual victims may retain their standing to sue in court, although in such cases the courts show a tendency to cling to the terms of the collective settlement just the same (‘reflex effect or shadow of the settlement’). Mediation in brokering such high profile settlements does not necessarily follow the vested principles of mediation in ‘regular’ one to one disputes.

    The article looks at the background to the use of mediation as a tool for resolving tax disputes between the UK tax authorities (HMRC) and UK taxpayers. It explains HMRC's litigation and settlement strategy which comprises the broad structure within which HMRC must operate to resolve such disputes. It then looks at specific guidance published by HMRC dealing with ADR and mediation in particular. The operational elements of this guidance, and the authors practical experience of them are then described, as are their views, with the limitations of the process. Finally the authors look at the application of ADR in the international arena.


Peter Nias
Peter Nias is a barrister and CEDR accredited mediator. He is a member of Pump Court Tax Chambers in their ADR Unit, a member of CEDR’s Tax Panel of mediators and has collaborated with CEDR to create the Tax Disputes Resolution Hub. Until 2012 he was a partner and solicitor in the law firm of McDermott Will & Emery UK LLP, where he was head of the Tax Practice and its Tax Dispute Resolution Group. Since qualifying in 2010 as an CEDR Accredited Mediator, Peter has been focussing his time advising clients on mediation and premediation strategies for resolving tax disputes. He has been working with HMRC’s Dispute Resolution Unit in developing a collaborative dispute resolution (CDR) Programme for complementing their Litigation and Settlement Strategy.

    Wendy Hensen analyzes the current Belgian legislation on tax mediation from the perspective of the traditional mediation doctrine. This legislation is in no way connected to the general set of rules on mediation incorporated into the Judicial Code. The question arises whether an internal comparative study between the two separate schemes can shed more light on potential bottlenecks in the current regulation. A comparison reveals significant differences in regard to the importance attributed to certain key elements of mediation, namely the principles of voluntary participation, confidentiality, party self-determination as well as the involvement of an independent and impartial third party who uses mediation methods and techniques. The customary interpretation and understanding of the concept ‘mediation’ apparently doesn’t apply to tax mediation. A brief overview of the Dutch mediation practice in fiscal affairs shows that a more holistic approach, in respect of the aforementioned principles, is nonetheless possible.

    Medio 2013 the European legislator adopted Directive 2013/11/EU (ADR Directive) and Regulation 524/2013 (ODR Regulation), both in the field of European consumer redress. The Directive and Regulation aim to promote the simple, fast and digital (out of court) resolution of consumer disputes. The Directive must be implemented no later than July 2015. This article describes some hurdles the Dutch legislator must overcome to successfully implement the Directive into the self-regulatory Dutch Consumer ADR system.

    In 2005 the Mediation Act came into force in Belgium. This act makes it possible starting a procedural and legal mediation procedure, besides the usual legal measures. This article starts with a short introduction to the legal measures and continues with some notable results of an inquiry to the social mediation field by B-Mediation in cooperation with the Federal Mediation Commission. The results of the inquiry are collected in the report Barometer van de bemiddeling 2012. The authors end with confronting the results with their own experiences and an explanation of their own model for practice, and the description of a recent case.

    On 1 January 2013 the new Mediation Rules of CEPANI (the Belgian Center for Arbitration and Mediation) entered into force. The 2013 CEPANI Mediation Rules replace the 2005 version of the CEPANI Mediation Rules and also the 2010 version of the CEPANI ICT (Information and Communication Technology) Mediation Rules. The 2013 Rules contain provisions on the introduction of the mediation, the appointment of the mediator, the mediation protocol to be established at the beginning of the mediation process, the conduct of the mediation, the confidentiality, the end of the mediation and its costs. The authors comment on these various provisions of the CEPANI Mediation Rules and explain thereby also the relevant provisions of the Belgian Mediation Law contained in Chapter VII of the Belgian Judicial Code.

    Construction contracts are particularly prone to the emergence of disputes. In Belgium, construction disputes have traditionally been referred to State Courts. In recent years however, there has been a growing interest in Alternative Dispute Resolution (ADR), which has gradually affected the Belgian construction sector. There are now several institutions dedicated solely to providing arbitration and ADR services to the construction industry.Beside the Centre belge de l’arbitrage et de la mediation, three institutions are specialized in the settlement of construction and real estate disputes: the Chambre de Conciliation, d’Arbitrage et de Médiation en matière immobilière, the Commission de conciliation construction and the Centre Scientifique et Technique de la Construction. These institutions offer fast and cost-effective ways of settling disputes, which are often more suitable than judicial proceedings
