    Care providers establish often long term relationships with their clients. It is of paramount importance that the threshold for a complaint or dispute resolution is preferably low. Ideally this is not a ‘mini-trial’ in which care provider and client are opposed against each other, but a constructive dialogue at a round table guided by a skillful complaints officer. This is what has been introduced by the Healthcare Quality, Complaints and Disputes Act (the Wkkgz).
    The new complaint system introduced with the Wkkgz applies to care covered by the Chronic Care Act (WLZ), the Healthcare Insurance Act (ZVW) and optionally can also apply to care based on the Social Support Act (WMO 2015).
    In my opinion it is a missed opportunity that the legislator has not introduced a similar complaint procedure in the Youth Act, but instead has chosen the ‘mini-trial’ option here. Moreover, it is also confusing for care providers and clients to follow different complaints systems next to each other.
    Finally, in psychiatric care where decisions of care providers can interfere with the right to self-determination there is a separate complaint procedure with a role for the Family Court. For all other run-of-the mill issues also in the psychiatric care the Wkkgz complaint procedure applies.

    The cost of conflicts in the Netherlands between civil parties or individuals and the government add up to more than 12 billion Euro. For this calculation, a framework has been developed to distinct between three cost categories: Subject (parties) cost, System cost (e.g. court) and Consequential cost. The latter category represents more than 50% of the total cost, the majority of which are born by commercial parties and employer. The government bears 12,5% of the total cost. The impact on insurance companies could not be estimated but is suspected to be substantial. It are these three parties who in concert should fund further investigation and develop initiatives to reduce the financial and human cost of conflicts. It is to be investigated which incentives are required to make this game change to take place.


Ivor Brinkman
Ivor Brinkman (1968) is Registeraccountant en Registermediator. Mede op grond van eigen observaties, aangevuld met uitgebreid onderzoek naar die van anderen, is hij tot de conclusie gekomen dat de impact van conflicten op mensen en organisaties groot is en dat de samenleving lijkt te juridiseren. Om dit tegen te gaan heeft hij Vantage opgezet dat zich richt op het ontwikkelen en verstrekken van instrumenten en diensten om mensen en organisaties te helpen anders om te gaan met conflicten door deze vroeger te herkennen, vaardiger te worden om escalatie te stoppen en meer zelfstandig in staat te zijn om tot oplossing te komen.     Educated as a psychiatrist, Dr. Compernolle first became one of the world’s leading experts in work-related stress. From there, he developed into a coach of executive teams, frequently engaged by large multinational companies. Mr. Compernolle discusses the differences between coaching and mediation, and shares some of his techniques for changing communication dynamics within teams. His special interest concerns family businesses, where emotions easily surface, and where problems need to be solved swiftly, to avert irreparable damage to family relations. Mr. Compernolle concludes the interview discussing some observations from his latest book: BrainChains.

    In this article the focus is on conflicts in the legal protection of incapable adults. First a short explanation is given of protection measurements in Dutch family law. Second is discussed in which cases judges appoint or should appoint professional guardians instead of a member of the family of the incapable adult. The central issue in this article is the role of the guardian as an ‘arbiter’ in conflicts. According to his task he cannot be independent, because his primary task is to care for the interests of the incapable person. This may bring him in conflict with other parties involved. Particularly the fact that the guardian himself can be a party in a conflict makes his position and role special. Therefore, some methods of possible strategic interaction from the perspective of the guardian are discussed.
