In the past twenty-five years, a lot of attention is paid to a more victim-aware and restorative justice focused policy in prisons in Belgium and The Netherlands, striving for a restorative culture and climate in the institutions (among prisoners and staff) and for more restorative practices like victim-awareness programs and mediation. The focus is primarily on the prison structure and culture, striving to create a more restorative prison culture and climate in the institutions. In this article we argue for a shift from this system-focused pursuit of ‘estorative detention’ to the restorative reintegration of prisoners at the individual level, and by this supporting their desistance from crime. We present a conceptual framework for restorative reintegration in and outside prison as a strengths-based approach, with attention to the structural and individual elements that supports their desistance from crime. |

How does the police deal with conflict resolution and (referrals to) mediation? Is this perceived as relevant within the new national police organization? This article elaborates on work processes within the National Police, including ZSM-settlements, the punitive aspects of police culture and the impoverishment of neighborhood-oriented police work. It is concluded that there is little room within the police for responsive approaches to crime and social unsafety. However, there are still police professionals who question ‘assembly line’-processing of criminal cases, support restorative justice strategies and try to improve the citizen-empowerment in neighbourhoods. |

At the end of 2000, a pilot project began in Flanders (Belgium) to offer family group conferencing for juvenile offenders. Since June 2006, this restorative practice – together with victim-offender mediation – has been inserted in the new Youth Justice Act, making conferencing available in all judicial districts in Flanders. Five years later, however, the mediation-services had to conclude that the number of referrals for conferencing remains rather limited. This observation inspired the mediation services to take actions to bring conferencing more to the attention. This article reports on the findings of a study that was part of this process. Based on (1) an analysis of all conferencing-files that were referred between 1 January 2007 and 31 December 31, (2) focus groups with youth court social workers and criminologists working at the level of the public prosecutor and (3) surveys conducted with youth judges, the study aimed to identify and discuss barriers and obstacles within the current referral practice of conferencing in Flanders. |

Neighbourhood mediation has been practiced more than fifteen years in the Netherlands. In 2010 there was neighbourhood mediation in 160 municipalities. More than 7000 cases were handled. Volunteer mediators try to break through communication blockades and teach their neighbours to make agreements. They are successful in two thirds of the cases. This means that about 20.000 directly involved family members are participating in successful cases. The authors discuss some conditions, results and the central principles of Dutch neighbourhood mediation: communication on an equal basis, impartiality, responsibility to solve conflicts, autonomous action and the enhancement of security and quality of life. |

Seemingly a difficult concept, participation in restorative justice can be understood better once the notion is broadened and operationalized. Therefore a proposal will be made here to first broaden the meaning of participation beyond participation of stakeholders and ‘community’ in the process as it is generally understood in restorative justice literature, and second break down the concept of participation into five different levels: (1) involvement of the stakeholders and the ‘community’ in the restorative process; (2) participation of citizens as volunteer mediators/facilitators in the process; (3) self-referrals from citizens; (4) voluntary participation of experts in restorative justice organisations; (5) promotion from ex-victims of crime and ex-offenders. Based on this approach, in the end, the author opens up the discussion on the meaning of active citizenship for restorative justice in continental Europe. Before discussing how the broadening of the concept of participation is concretely envisioned, the author argues on the importance of prioritizing the notion of citizenship instead of ‘community’ in the continental European restorative justice discourse. |

Legislation affects restorative justice in four ways: existing legislation may allow it, new laws may enable it, laws may limit it, or restorative justice may be the norm. Examples from different countries are given and specific questions about the relationship of restorative justice to the criminal justice system discussed. It is suggested that, broadly speaking, safeguards should be legislated and practice regulated by an independent body. It is concluded that restorative practices, have the potential to transform society’s response to harmful behaviour. |
