    In this contribution, the authors take stock of the many diverse restorative justice programs that have been implemented in many countries, worldwide, over the past twenty years, and that have involved a number of problems. They also discuss a number of new developments and areas of concern, including victim participation, the relationship with common law, cases of serious crime and the role of the community. The authors hope the new UNODC Handbook on Restorative Justice Programmes to be as successful as the previous edition in promoting new ways to apply restorative justice principles in criminal matters and helping practitioners benefit from each other’s experience.

    The 20th anniversary of this journal is a good reason to glance back at developments with restorative justice for children and young people. Can we say that restorative youth justice has become mature? Some core events and articles about developments in Belgium, the Netherlands and elsewhere are discussed, paying attention to young suspects as well as victims. Subsequently, the embedding of restorative justice in youth laws is discussed. Finally, the article focuses on the question what should be done to improve the implementation into an effective, child friendly and ‘rights based’ youth sanction model.

    The apologies offered by young offenders in restorative justice conferences are often of poor quality. In this article the difficulties that accompany the offering of excuses are discussed. Offenders sometimes lack the language skills to pronounce an adequate apology, are anxious or insecure or believe that they have not been treated fairly. The mediation setting itself also has effects: sometimes perpetrators feel intimidated and feel compelled to say something that resembles an excuse. A related problem is that the perceptions about the sincerity of the apology can vary considerably. This perception-mismatch also occurs among victims: what one victim considers sincere is ‘fake’ for another. Many people
    – also advocates of restorative justice – trust that the offender will offer a sincere apology, without realizing that this is not self-evident in a thorny confrontation setting. This article aims to temper this sincerity-expectation.

    Restorative Justice is not evident in cases of intimate partner violence, but it can take and does take place under certain conditions. Wolthuis and Lünnemann explain about the European research they coordinated in six European countries (Austria, Denmark, Finland, Greece, the Netherlands and the UK) on context and practicalities of the use of victim-offender mediation in such complex cases. Cases dealing with violence of mainly men against women and where power imbalances often play a role. That means that mediators, referrers and others involved should know about this complexity and the needs of participants. Austria and Finland turned out to have the most experienced working methods. Their models, good practices and challenges are presented as well as the main outcomes of the research. Interviews and focus groups in the countries gave additional insights. It resulted in a guide with minimum standards addressing the different stages of a mediation process with extra attention for safety and empowerment.

    Based on a literature research and program evaluation of the practice of Victim in Focus (Slachtoffer in Beeld) in 2013, two issues are addressed: What are the possible effects of victim offender mediation? Which active mechanisms will cause or contribute to these effects? The authors describe the current context and developments in The Netherlands concerning restorative justice and then describe the effects and possible active mechanisms such as satisfaction, diminishing fear, anger and shame, information and consent, procedural justice, reduction of recidivism, compliance. In a synthesis of active mechanisms they present four domains or mediating factors: from incomprehension to comprehension (cognitive restoration); from unease to ease (emotional restoration); from injustice to justice (moral restoration); from powerless to powerful feelings (restoration of control). The victim offender mediation as a ritual has an impact or is supposed to have an impact on these four domains for both victims and offenders. Within the four domains four activities or interactions within victim offender mediation are presented: creating understanding through inter-subjectivity; expression of fear, trauma and shame; doing justice by excuses/apologies and restorative actions; regaining self control. Further research is needed to validate the model and to get more insight in essential or primary and secondary aspects in the explanation of the impacts of victim offender mediation.

In 2010 was hij medeoprichter van de Stichting Restorative Justice Nederland en sindsdien ontwikkelt hij samen met organisaties en professionals binnen het netwerk rond herstelrecht en herstelgericht werken in Nederland allerlei projecten op dit terrein. Hij is een veelgevraagd spreker op dit terrein. Gert Jan is ook actief op het terrein van professionaliseringsvraagstukken, onder meer binnen de jeugdzorg.

    This article studies the position of young victims in restorative justice and mediation. First we study the literature, which shows that although young victims may have specific needs, their position within restorative justice remains underexposed. Therefore, we have set up a small explorative study in the beginning of 2015. Through nine interviews with young victims who have gone through a mediation process in Flanders, we sought to answer three central questions. The article discusses whether these victims were satisfied with the mediation process, whether they could have a say in the process and what the importance was of having support persons throughout the mediation process.
    We found that the participation of the parents does influence the mediation process, since the parents are the main support persons for the young victim. Other support people are seldom present in the process, although some victims wanted the school or a friend to participate. Most of the young victims found they had a say in the process, but the presence of the parents could be an impediment in that regard. Young victims interviewed were generally satisfied with the mediator and mediation process, but not always with the outcome of the mediation. Ensuring that these young victims really get a say in the process proved to be a point of attention for practice.

    Hip-hop and restorative justice may seem odd bedfellows, but according to Antony Pemberton they have more in common than many would assume. In the first place hip-hop shares a common history, at least with restorative justice's modern incarnations, spanning four decades, to become a similarly global phenomenon. Much of the social ecology shaping RJ is similar to hiphop. In addition hiphop's criticism of criminal justice almost goes without saying. Almost no source offers similar scathing critique of criminal justice and penal institutions as rap lyrics. Pemberton concludes that rituals in hip-hop are connected with the need to deal with conflict. The way respect and disrespect can coincide in rap-battles might offer insights in the way similar dialectics can be navigated within restorative justice processes. The extent to which this is possible is necessarily limited. Pemberton finds that hip-hop – with the exception of graffiti- does not seem currently to criticize the key neo-liberal values of the American Zeitgeist. The much maligned chasm between the old-school and the new school can be situated in this observation. Where hip-hop, as a social movement, used to deploy the depiction of injustice as a means to underline the necessity of social change, the current motto appears to be rich or die tryin”. The life of the thug and the gangsta is depicted as the epitome of the American Dream. Here Pemberton sees grounds for a cautionary warning for restorative justice, which is nurtured by a similar neo-liberal undercurrent in a number of jurisdictions.

    On the basis of current definitions and approaches of restorative justice and crime prevention, and making use of a two-dimensional typology of crime prevention, this article develops a conceptual framework and seeks to offer points of connections and departure at the theoretical level between restorative justice practices and different models of offender-oriented, victim-oriented and community-oriented prevention. In order to face some of the present limitations of restorative justice, in particular the missing link to causes of crime at the societal-structural level, the author widens the perspective of restorative justice to the broader notion of ‘community justice’. The challenge for restorative justice is, then, to integrate polycentric problem-solving approaches into its operational models.

    The author reports on the doctorate research that she presented in 2009. Restorative practices have not often been researched as a praxis of social work, on the interface between giving help and administering justice. The author situates restorative mediation as a form of social work on the threshold between the private and the public, a threshold that she considers to be of a social nature.Restorative mediation as social work should contribute to values such as human dignity and social justice. The author observed and studied restorative mediation in adult on the one hand and juvenile criminal cases on the other (in Flanders, Belgium) and found that these practices differ widely.Although in both kind of practices responsibility and restoration are central concepts, their meanings differ fundamentally: in youth cases the offer of restorative mediation departs from a critical pedagogy oriented at emancipation, holding on to protective arrangements at the same time. Societal developments changed the image of youngsters from victims of society into risks for society and this may have implied that social problems around criminality are now also by mediation transformed into individual problems for which juveniles should be held accountable.In adult criminal cases the approach was initially much more on civic responsibility for the harm done to victims and since mediation was only offered in serious cases the courts always had their say too.Reflecting upon her research the author questions whether dominant social norms can be and still are challenged in the praxis of mediation. Restorative mediation has become incorporated into the existing institutional arrangements relevant to juveniles and adults: with juvenile cases the logic of prevention seems to become dominant. The practices seem to become exercises in taking responsibility within the traditional normative framework. On the threshold between the private and the public restorative practices, with their self-image of being a more humane form of law enforcement, run the risk of becoming blind for the potential effect of criminalization of their clients.

    The authors latest book on Restorative Justice, Self-Interest and Responsible Citizenship has been discussed in this journal in 2009 and the author now responds to the critiques, which came from three jurists and therefore had a predominantly juristic character. Themes discussed are ‘criminal justice and punishment’, ‘restorative justice and the law’, ‘restorative justice, the victim and public interest’, ‘restorative justice and the legal order’ and finally ‘restorative justice and offender rehabilitation’. Walgrave maintains and clarifies the views he developed in the book explaining why it is correct to claim that criminal justice can be identified as fundamentally punitive (although it does not always punish, as one critic has observed) and that it should be possible to elaborate restorative justice into a completely new legal system, offering legal guarantees fitting to what restorative justice is trying to achieve. Legal guarantees as they exist today in criminal procedure cannot be taken as the benchmark for restorative procedures in view of the totally different aims and procedures. Furthermore, it is not true that the victim gets too much power in restorative justice – as one critic stated – because restorative justice is and should be conceived as a system of public law, involving the legal agencies and authorities such as courts in a proper role as guardians of every citizin’s dominion. It is because of the safeguarding of dominion that the victim should have a key-role to play in restorative justice, although not obliged to participate.One critic has mentioned that Walgraves ideas seem to imply that the legal order is only something being imposed upon the citizens ‘top down’, while in many respects one could maintain that the law and the principles of the legal order have been produced ‘bottom-up’ or at least should be the result of democracy. The response is that restorative procedures offer more opportunities for citizens for this democratic participation in producing the norms of the law.Finally some have argued that the rehabilitative interests of the offender should have a more central place in the definition of restorative justice, more or less of the same importance as restoring the harms of the victim. Walgraves experiences with the Belgian model of juvenile protection made him cautious of the risks of doing so, not only in terms of serving the victims needs, but also in terms of the legal protection of the juvenile offender against arbitrary interventions.
