John Blad was universitair hoofddocent Strafrechtswetenschappen aan de Erasmus Universiteit Rotterdam, de Erasmus Law School, en is redacteur van dit tijdschrift.

Jacques Claessen
Jacques Claessen is als universitair docent straf(proces)recht verbonden aan de vakgroep Strafrecht & Criminologie, Faculteit der Rechtsgeleerdheid, Universiteit Maastricht. In 2010 verscheen zijn dissertatie Misdaad en straf. Een herbezinning op het strafrecht vanuit mystiek perspectief. Zijn interessegebieden zijn sanctierecht, herstelrecht en de strafrechtelijke positie van het slachtoffer. Claessen is redacteur van de Nieuwsbrief Strafrecht en het Tijdschrift voor Herstelrecht. Voorts is hij rechter-plaatsvervanger bij de Rechtbank Limburg. Hij is winnaar van de Bianchi Herstelrechtprijs 2012.

Anneke van Hoek is criminoloog en medeoprichter van de Stichting Restorative Justice Nederland.

Gert Jan Slump
Gert Jan Slump is criminoloog, sociaal-maatschappelijk ondernemer en consultant, adviseur en trainer. In 2010 was hij medeoprichter van de Stichting Restorative Justice Nederland en sindsdien ontwikkelt hij samen met organisaties en professionals binnen het netwerk rond herstelrecht en herstelgericht werken in Nederland allerlei projecten op dit terrein. Hij is ook actief op het terrein van professionaliseringsvraagstukken, onder meer binnen de jeugdzorg.

    Since 2005, Dutch victims of serious crime have the right to make an oral statement in court (‘spreekrecht’). In the past decade, the Dutch criminal justice system has accommodated this right to make an oral statement with regard to the consequences of the crime; no major problems have occurred. Indeed, only a minority of the victims consumes this right (ca. 230 cases annually), the majority prefers to lodge a written statement. Nevertheless, the Dutch legislature is of the opinion that the right to make an oral statement should be extended and has lodged a draft-proposal recently. The aim is to provide crime victims a right to put forward an advice to the judge at the trial session, such an advice relating to the full scheme of judicial decision-making (truth, legal qualification, punishment). Such a provision resembles a Victim Statement of Opinion, used in the American scheme of justice, and even exceeds this. The draft has been met with criticism, only the Dutch Victim Support is in favor. One of the objections heard is the one dimensional focus underlying the draft: by focusing on a specific group of victims – those who have suffered from serious crimes – the legislature neglects the heterogeneous nature of victims’ needs.

    Utrecht, the fourth largest city of The Netherlands, is addressing resolving social conflict by promoting schools to adhere to the Peaceful School Program and civilians and professionals to join the Peaceful Neighborhood Program. The Peaceful School Program is designed to address problematic behavior of youth in primary, secondary and high school education and evolved into a democratic and participatory citizenship program. The Peaceful Neighborhood Program is involving important organizations that are active within the neighborhood, members of the community and stake-holders to adapt peaceful attitudes in daily life, including a mind-set that addresses conflicts by resolving them (together).
    These two programs are in the process of ‘conquering’ the whole of the city of Utrecht and every single neighborhood. The so-called Utrecht Model for Mediation is supporting these Peaceful Programs, through empowering citizens and professional to enhance their ‘peaceful skills’ and skills for conflict resolution. Citizens and professionals are being trained to develop this mindset. The Utrecht Model for Mediation is organizing a community of mediators that can be of help. A pool of volunteer mediators is being formed to help organizations, professionals, parents, students and members of the community in case of problems, tensions, problematic behavior of youth groups, etcetera. Professional mediators intervene in case of escalated conflicts and penal cases.

    In this article, the author evaluates whether the development of restorative justice in Belgium over the past ten years offers an opportunity to ‘celebrate’, as the Journal for Restorative Justice does. Developments in practice show that mediation is available at all stages of the judicial procedure for adult offenders and mediation and conferencing are available according to youth law. Research has been carried out on various topics, covering a variety of practices. Furthermore, it has elaborated the concept of restorative justice, inspired innovative practices and influenced policy-making. Belgium seems to be peculiar in the relation between practice, research and policy, which tend to influence one another. Compared to the Netherlands, Belgium does have more reasons to celebrate the development of restorative justice.

Inge Vanfraechem is criminologe en onderzoeker aan de Katholieke Universiteit Leuven. Zij is actief binnen het European Forum for Restorative Justice en redacteur van dit tijdschrift.

    Comparing the developments in the Netherlands with those in Belgium the authors find important differences relating to the questions pertinent to implementation. Experiments have also been done in the Netherlands and their evaluations showed positive results, but there were different models which were not clearly – or not at all – related to the traditional criminal justice process. They all were lacking the formal collaboration with the courts, that was seen in Belgium. There has been no form of central direction and no important influence from the academic world and the various projects have officially been replaced in 2006 by a national policy of implementing ‘victim-offendertalks’. These talks have their merits and are appreciated by victims and offenders, but they do not amount to mediation in a restorative style, since restorative agreements are not allowed to result. Nevertheless, there are a number of indications that restorative justice practices could still become recognized and accepted. Staff of the police, the public prosecutors office and judges are interested and new experiments are beginning. The new development of local ‘veiligheidshuizen’ (‘front offices for safety’) offers a promising setting for interagency co-operation and conferencing with citizens in trouble and conflict. The conferencing-model has gained broad acceptance in the context of juvenile care and may continue to inspire justice personnel. In process now is the foundation of a new restorative justice network, called ‘Restorative Justice Netherlands’.

    Victim-offender-mediation started in Belgium as early as 1993 and nowadays the Belgium landscape shows a variety of restorative practices, including conferencing with juveniles and mediation with adult offenders, on the basis of a number of legal arrangements. Progress can still be made in quantitative terms and qualitatively by harmonizing the various legal instruments that are available. The diversionary mediation that is possible at the level of the public prosecutor differs in a number of ways from the mediation that can be offered in subsequent stages of the criminal procedure. A variety of motives and reasons explain the reception and growth of restorative practices, such as the desire to offer victims a better service and to improve the delivery of justice. The willingness to experiment and to collaborate between protagonists of restorative justice and the agencies of criminal justice, and the strong scientific support from the Catholic University of Leuven, are amongst the key factors that promoted the integration and consolidation of restorative practices in the legal system.
