    This article presents and critically discusses a new Recommendation on restorative justice (CM/Rec(2018)8) that was adopted on 3 October 2018 by the Committee of Ministers of the Council of Europe. This new regulation builds on the previous Recommendation No. R(99)19 on mediation in penal matters and recommends the governments of the 47 member States of the Council of Europe the adopt and implement the principles of restorative justice as described in the Appendix of the new Recommendation. These guidelines apply to national authorities and national agencies in general, and to judges, public prosecutors, police, prisons, probation, juvenile justice agencies, victim support services and restorative justice services in particular. The article presents the origins of the Recommendation, its contents and its meaning for restorative justice developments in Europe and beyond.

    This article discusses the willingness of the victim to judge the offender more mildly after the latter apologized for his wrongdoing and shows that he is involved in behavioral change. A large group of victims wants to help (young) perpetrators and offer them a second chance, even victims who have been treated violently. It is argued that these forms of compassion express a caring attitude, the wish that the offender will be rehabilitated and that a change in behaviour is more important than compensation. This attitude can also be referred to as ‘forbearance’, in terms that a less severe sanction is sufficient. This goodwill factor may well be the most important aspect of ‘doing justice’ in restorative meetings.

    Whether and under which conditions restorative justice can be applied to cases of corporate violence is explored starting from the phenomenon of corporate violence, defined as acts committed by corporations in the course of their regular activities but with harmful consequences for people’s health. Specific characteristics of different types of corporate violence are presented, as well as victims’ needs, experiences and expectations. The applicability of restorative justice, but also the need of its rethinking, is discussed through an analysis of the role of its key actors and the concepts of participation and restoration.

    Penal mediation is currently gaining ground within the Dutch criminal law system. The practice of penal mediation is still young, however, and therefore vulnerable. Common criminal practice as well as legislation are not yet thoroughly compatible with practicing penal mediation. The authors of this contribution explore some of the dangers mediators in penal cases face while drafting party-agreements that are to be taken into consideration by the judicial authorities.
    The article identifies the responsibilities of penal mediators who at the same time serve the interests of victims and offenders as well as take into account expectations judicial authorities might have. The responsibility of penal mediators is especially delicate whenever mediation parties seek to influence the outcome of the criminal lawsuit through mediation. Criminal law is a highly-regulated field, which – albeit unconsciously – seduces the mediator his- or herself to lose track of the main restorative goals of the mediation process. The authors point out some of the traps penal mediators can and should avoid. The article for instance elaborates the inadequacy of current Dutch regulations to arrange financial compensations and damages through penal mediation. Also, the article enumerates examples of over-juridification as well as the lacking of it. Furthermore, avoidable pitfalls such as McDonald-icing of penal mediation, the uselessness of so-called sunny-weather-vouchers, the dangers of copy-paste-agreements and – the worst – putting the height of their own – currently fixed – fees above party interests, are being addressed.

    The apologies offered by young offenders in restorative justice conferences are often of poor quality. In this article the difficulties that accompany the offering of excuses are discussed. Offenders sometimes lack the language skills to pronounce an adequate apology, are anxious or insecure or believe that they have not been treated fairly. The mediation setting itself also has effects: sometimes perpetrators feel intimidated and feel compelled to say something that resembles an excuse. A related problem is that the perceptions about the sincerity of the apology can vary considerably. This perception-mismatch also occurs among victims: what one victim considers sincere is ‘fake’ for another. Many people
    – also advocates of restorative justice – trust that the offender will offer a sincere apology, without realizing that this is not self-evident in a thorny confrontation setting. This article aims to temper this sincerity-expectation.

    The article reflects on the conceptual work undertaken during the first year of ALTERNATIVE, a project coordinated by KU Leuven. The overall objective of the project is to provide an alternative and deepened understanding of justice and security based on empirical evidence of how to handle conflicts within intercultural contexts, mainly through the active participation of citizens. The paper focuses mainly on the relation of the concept of citizenship with restorative justice, especially as viewed and enacted in the four intercultural settings of the ALTERNATIVE project. Several issues are discussed: the concept of participatory citizenship in relation to crime and conflict; the claim of the discourse of restorative justice to the concept of participatory citizenship and democracy and the challenges in the restorative justice discourse that complicate its relationship to participatory citizenship. Next, insight is provided in the ways the ALTERNATIVE project tries to tackle some of these challenges, by exploring and strengthening the relationship between the concept of active citizenship and justice in Europe. By targeting the intercultural field the ALTERNATIVE aims to explore the potential of mediation services and restorative justice models to engage with macro societal conflicts that are not referred to these services by the criminal justice system, and on the other hand expand the way some of the crimes referred by the criminal justice system are handled by the mediation services alternatively by fostering alliances with various civil society organisations. Employing ‘action research’ methodology, it is argued that the concept and framework of ‘nodal governance’ (Shearing and Wood, 2003) can serve to support participatory modes of conflict regulation. Interactive settings are created, which allow for spaces between informal and formal justice, and between justice mechanisms at the individual and at the societal level (Aertsen, 2001, 2008). Arguments are provided in support of the need to promote broader models of restorative justice which are able to address social and systemic crimes and conflicts, and which will help the theory and practice of RJ to move beyond the individualisation of crime and its remedies.

Hij is ook actief op het terrein van professionaliseringsvraagstukken, onder meer binnen de jeugdzorg.

    In this article attention is paid to the thoughts and feelings which underlie criminal law and restorative justice, as well as the question whether those thoughts and feelings have to be regarded as rational or irrational. For this purpose, the author has firstly examined the relationship between thinking and feeling from the perspective of the so-called cognitive emotion theory as put forth by the American philosopher Martha Nussbaum and the Dutch philosopher Mirjam van Reijen. In addition, this contribution also addresses the ideas of the Stoics, Spinoza and Schopenhauer, since the aforementioned theory goes back on the ideas of these philosophers. These philosophers depart from the view on man and world in which interconnectedness plays an important role – as the opposite of separateness. This view which reflects the mystic-religious perspective on man and world forms an important connecting thread in this article, as this turns out to have direct consequences for the idea about the (ir)rationality of certain thoughts and feelings, as well as for the (ir)rationality of criminal law and restorative justice. Special attention is paid to emotions that are relevant within the context of criminal law and restorative justice – which include anger, resentment, hatred, fear and compassion. After having explained – on the basis of the cognitive emotion theory – how thinking and feeling relate to each other and which thoughts and feelings – on the basis of the perspective of interconnectedness – have to be considered as (ir)rational, the article examines whether punishment is (ir)rational and whether the regular theories which legitimate punishment (i.e. retribution and prevention theories) are ‘rationalities of something irrational’. Furthermore, it is assessed whether the thoughts and feelings behind restorative justice are (ir)rational. The article concludes with a suggestion in which the main findings of this contribution are summarized, in order to stimulate discussion.

Jacques Claessen (1980) is universitair docent straf(proces)recht aan de faculteit der rechtsgeleerdheid van de Universiteit Maastricht. In 2010 verscheen zijn dissertatie Misdaad en straf. Een herbezinning op het strafrecht vanuit mystiek perspectief (Nijmegen: Wolf Legal Publishers). Zijn interessegebieden zijn sanctierecht, herstelrecht en de strafrechtelijke positie van het slachtoffer. Claessen is redacteur van dit tijdschrift en van de Nieuwsbrief Strafrecht. Voorts is hij rechter-plaatsvervanger bij de Rechtbank Maastricht. Hij is winnaar van de Bianchi Herstelrechtprijs 2012.

    In restorative thinking it is often assumed that the involvement of volunteers, almost naturally, flows from its values and aims. But are there really convincing arguments that account for, justify or even necessitate an active policy on volunteering in restorative justice practices?This contribution focuses on the moderate view on restorative justice as developed in the Belgian context. It is argued that this approach offers a variety of reasons for developing a volunteers-programme. Two central issues in a moderate view on restorative justice are essential to understand the value of volunteering in restorative justice practices. Such a view sees 1) crime as a multi-layered phenomenon, and 2) takes participative and communicative justice as its central aim.

    There is a natural alliance between the ambitions of prison chaplaincy and those of restorative justice in the sense that in both approaches (coping with) responsibility and guilt by offenders are important issues and mechanisms at the same time. Both share a relational concept of crime, consider the evil deed as occasion to start a dialogue to examine responsibility, stress the importance of process and bi-lateral partiality with both the victim and the offender. Coping with guilt and making it productive requires that communication with the offender reaches the deeper and more intimate levels of giving meaning to the criminal offence committed, self, others, past and future. For this communication the context should be open and fundamentally loving in a Christian sense, leading the way to a liberation from guilt once it is thoroughly known and accepted. At that point guilt can be transformed into a constructive moral impetus in human relations.
