Trefwoorden shopkeepers, procedural justice, the Netherlands, ethnic minorities, performance theory
Auteurs Marc Schuilenburg, Laura Messie en Darnell de Vries
SamenvattingAuteursinformatie

In this article, we analyze which aspects of performance theory and the procedural justice-based model are explaining the trust of shopkeepers in the police and local government. Utilizing a survey of 156 shopkeepers and 94 semi-constructed interviews with shopkeepers, which are located at the South Shopping Boulevard in Rotterdam (The Netherlands), the study finds that shopkeepers have a relatively high trust in the police and local government. This is surprising because various attempts in the past 30 years to revive the high street by the government have failed to improve its bad image, as dwindling visitor numbers, poor turnover, limited range of retailers, empty shops and high crime and offence levels show only too plainly. The findings also highlight that ethnic minority respondents have more trust in local government than Dutch shopkeepers. The explanation therefor is sought in the dual frame of reference theory.

SamenvattingAuteursinformatie

Traditionally, the mayor has an important role as a citizen’s father and as a maintainer of public order. In the context of the so-called ‘undermining’ criminality, the mayor has been increasingly empowered with new legal instruments to combat undermining criminality. Some mayors see themselves as a sheriff. However, in the Dutch Municipal Act, the mayor only has a task of maintaining the public order. How does this task relate to combating undermining criminality? What is the role of the mayor in the combat of undermining criminality? Nowadays, there is no legal basis in the Dutch Municipal Act to equip the mayor with crime-fighting duties. This article proposes to equip the mayor with a legal duty as a crime fighter.

Trefwoorden Big data, Security, good governance
Auteurs Remco Spithoven en Siri Beerends
SamenvattingAuteursinformatie

The promises of Big Data, predictive policing and artificial intelligence hold a key position in the public debate for quite some time now. Optimists tell that it is possible to predict where criminal events will occur before they take place. This would implicate a major shift towards a crime and insecurity preventive society, feeding on our cultural longing for a secure future. Therefore we give algorithms and deep learning access to more and more aspects of our lives. But how realistic and desirable is the application of Big Data techniques in the area of security?
In this article we put focus on the research question ‘In which way can Big Data and predictive policing support good governance of security?’, that has led our study. By exploring the central concepts, the processes behind them and their results in the domain of public security, we conclude that there are only rather disappointing results from the application of these techniques: crime and insecurity have not dropped when the police and other organizations turned to Big Data techniques. Instead, many negative side effects occurred. We search for explanations in six central academic critiques on the application of these techniques in the area of security.
We have found several ways to guaranty principles of good governance in the application of Big Data techniques, but these require a firm paradigm shift on Big Data in general. The heuristics of security professionals should not be overshadowed by technological promises: the professional should always be in the loop, must understand the way predictions come into existence and must be able to correct flaws and bugs of (semi-)automated decisions. We conclude that safeguarding public security must remain human work in which Big Data techniques can assist.

SamenvattingAuteursinformatie

Within the group of Dutch foundlings, 28% are migratory foundlings: children coming from abroad to the Netherlands (inbound foundlings), and children going abroad from the Netherlands (outbound foundlings). According to the rational choice theory, there is at some point a rational decision behind human action, based on consideration of costs and benefits – terminology reminiscent of the origins within economic science. When viewed from that perspective, cross-border abandonment may be regarded to be a conscious effort to hinder detection. After all, abandonment of foundlings has been a criminal offence in the Netherlands since at least the Middle Ages. There is therefore also a vested interest in not attracting attention. Anyone abandoning a child and wishing to protect their identity will be attracted to locations that lack effective supervision, defined as guardianship within the criminological routine activities theory. However, the less familiar a location, the trickier it is to avoid visibility. Does the rational consideration of costs and benefits result in migratory foundlings being abandoned just over the border (in order that the perpetrators attract the least possible attention) or actually further inland (in order to detract from the cross-border activity, for example)? Is there a comparable choice in terms of distance when people abandon native foundlings – children found in their country of birth? Relevant questions indeed, as greater insight into such variables can support the direction taken by detection activities. This study is an exploratory analysis of the distance between the domicile or birth location and the abandonment location of cross-border foundlings. The results will then be compared with the distances in the case of domestic foundlings.

Auteurs Ilja Van Hespen
SamenvattingAuteursinformatie

Until recently, Dutch merchant ships could not rely on privately contracted maritime security staff to protect themselves against pirates. On the one hand, the argument prevailed that the State had to retain the monopoly on the use of force and, on the other hand, one also feared for the escalation of violence or international incidents. Nowadays, however, more and more European countries allow for the use of privately contracted armed security personnel on board merchant ships. As a result, the Dutch Parliament has adopted a bill containing rules for the use of armed private security guards on board Dutch maritime merchant ships (Law to Protect Merchant Shipping 2019 (published in the Dutch official Gazette on June 7th, 2019)).
The author addresses the question whether because of the new law a level playing field will emerge with the Merchant Navies from the neighboring Flag States of Belgium, the United Kingdom, Spain and Denmark, presenting a comparative analysis of their domestic legislation.
The Dutch law clearly regulates the use of force and the master has the final responsibility for everything that happens under his authority. In principle, the security guards may only apply violence as the master has determined that it is necessary. Innovative is that there is a reporting obligation whereby every incident should be reported with images and sound recordings. It seems, however, that the law is especially made to protect and secure and not necessarily to provide a solution for situations in which pirates come on board.
It is clear that the intention of the legislator is to leave the monopoly on the use of force in the hands of the State. However, the adoption of this law to protect merchant shipping could constitute a first step in enabling the use of force by other actors than the State, which in itself is groundbreaking. Before being able to go on this road, there are still countless political (mainly related to the sovereignty of a State) and legal challenges (mainly concerning the use of force and respect for human rights) to be addressed.

SamenvattingAuteursinformatie

The Dutch Police Act provides the police with the legal power to gather information about a person on the internet as long as this does not cause more than ‘a limited violation of privacy’. If the police are gathering more information about a person they need a special legal power laid down in the Dutch Code of Criminal Procedure. The dividing line between ‘a limited violation of privacy’ and ‘more than a limited violation of privacy’ is not always clear. The legislator is preparing a new piece of legislation to provide the police with more clarity. This article discusses the suggested law article with respect to the gathering of information from open sources. Furthermore, this article suggests to not only regulate the amount of information the police are gathering but also the kind of tools that the police use (simple search machine versus an advanced web crawler).

The most important mechanism for crime prevention is just the presence of guardians. Some counter arguments against this thesis are discussed and rejected. By manipulating the presence of guardians it is possible to influence the level of prevention. It is argued that a large scale evaluation of such measures is wanted.

De smokkel van Syrische migranten naar Nederland

Tijdschrift Tijdschrift voor Veiligheid, Aflevering 2-3 2017
Trefwoorden Mensensmokkel, Smokkelroutes, smokkelnetwerken, Smokkelfuncties, smokkelen van migranten
Auteurs Sacha van der Velden
SamenvattingAuteursinformatie

In this article the following question is answered. What is the modus operandi of human smugglers that smuggle Syrian migrants to the Netherlands in de period 2014-2016? Content analysis of police and Royal Marechaussee files, interviews with experts and Syrian migrants and literature research has revealed that: Syrian migrants in first instance use the South-Eastern route overseas from Turkey to Greece, for which they pay 1200-4000 euro to a smuggler, depending on the quality of the boat. From Greece some travel over land on the Balkan route. Several means of transportation are used on this route, with smugglers asking prices ranging from tens to hundreds of euros. Also they travel large parts on their own. Others are smuggled by airplane, for which they need (false) documentation. Smuggling by plane tends to be successful when departing from a small airfield, when made a detour through visa-free countries and/or a good quality (false) travel document. Prices range from 2.000 to 14.000 euros. Migrants mostly pay cash through irregular ‘banks’, a third party that plays an important facilitating role within several smuggling networks. These networks consist of several cells, with in these cells leaders and ‘employees’ and are located on migration routes and ‘hubs’ like Istanbul, Athens and Milan. The South-Eastern route is mostly in hands of Turkish criminal networks, and the continuation of the journey by airplane or through Milan over land is in hands of Syrian Dutch smugglers, the Balkan route seems to be mainly operated by individual smugglers. Within these smuggling networks the most important roles are: the recruiter, who is responsible for making contact with migrants on migration hubs or social media. The organizer/leader who coordinates activities along the smuggling route and calls employees to account. And finally the driver. Responsible for transporting the migrants and instructing them. Based on these findings several recommendations were made that can be found in this article or full research rapport.

Asielzoekers als (vermeende) daders

Auteurs Joris van Wijk en Maarten Bolhuis
SamenvattingAuteursinformatie

This contribution describes the legal basis for revoking or denying a residence status to asylum seekers and individuals in possession of a status who are considered war criminals, ‘common’ criminals or terrorists, in what way the Dutch government tries to identify these persons, and what the nature and size of this group is. The authors conclude that identifying alleged war criminals and jihadists is particularly complex and that there is a tension with respect to the use, necessity and desirability of making available concrete tools in the form of indicators to first line professionals for the purpose of identifying jihadists. The presence of unwanted but unremovable (criminal) asylum seekers is undesirable from the perspective of society. The suggestion is made to provide them, under certain conditions, with a temporary residence status.

SamenvattingAuteursinformatie

On September 21th 2012, a sweet sixteen party in Haren (a Dutch village), announced on Facebook as PROJECT X Haren, turned into a riot in which youngsters clashed with the police. The blame was put on the film Project X (2012) that would have inspired adolescents to become aggressive and violent. However, like other adolescent comedies, this movie offers an insight in the adolescent state of mind, the role of humor and their lack of risk assessments. Much violence is (harmless) slapstick-like, boundaries are exceeded (sex, alcohol, drugs) and transgression is often directed against parents, teachers and the police. What is tested in the adolescent imagination is the public order. Film functions as a symbolic rite of passage, with carnivalesque inversions. Reacting in Haren on this adolescent state of mind with an administrative prohibition (‘there is no party’) confirmed the juvenile joke. Acting as if it is not a party but a huge disaster (by enlarging police forces) contributed to make the riot a reality that the youngsters themselves never imagined. The commission of inquiry recommends taking serious film and other forms of public imagination, because they contribute to our understanding of reality, especially concerning the perceptions of societal actors.

Vessel protection, van zorgplicht naar zelfverdediging

Tijdschrift Tijdschrift voor Veiligheid, Aflevering 0304 2015
Trefwoorden Security, Piracy, public vs. private responsibilities, policy making, paradigm changes
Auteurs Henk Warnar
SamenvattingAuteursinformatie

This article demonstrates the influence of intellectual debate in policy paradigm changes. In response to piracy around the Horn of Africa, Dutch naval forces have participated in NATO and EU counter piracy operations since 2008. Although successful, also self protection measures by the merchant ships are required to provide security to individual ships. Since 2008 Dutch ship owners have advocated to amend legislation to allow private armed security teams (PAST) for individual protection, similar to policies by most foreign countries. Because of sensitivities concerning the private use of arms, policymakers, politicians, stakeholders and advisors have circumvented the issue. Instead of addressing the question of self defense, the paradigm of state monopoly for violence and the state’s obligation to provide security, made individual protection by embarked military teams to develop as a governmental service at levels that turned out to be unachievable for the armed forces. This policy caused several types of friction. Currently, the only acceptable solution seems to be to allow PAST and legislation is being prepared accordingly. A successful paradigm change however can only be achieved if an adequate new paradigm is constructed by intellectual debate. (Hall, Visser & Hemerijck) So far this debate has been too limited in scope. Debate has been state centric and focused on legal views and regulation. To resolve friction, additional analysis of differing roles by the state and individual entrepreneurs is required. Such analysis argues that the state severely reduces individual protection and politicians decide on the fundamental question of self defense by ships at the high seas.

SamenvattingAuteursinformatie

Is behavioural profiling a viable alternative to more traditional approaches to profiling, viewed from the perspectives of underlying theoretical assumptions and measures of effectiveness? In this article we describe behaviour profiling in relation to other types of profiling, we review relevant psychological mechanisms that underpin behaviour profiling, and discuss effectiveness of this type of profiling as well as methodological aspects of measuring effectiveness. Behaviour profiling is a method largely used to select potential offenders before the offence is committed by observing and giving meaning to behaviours preceding incidents. Deviant behaviours exhibited by suspects can be either part of a modus operandi related to the offence, the consequence of increased stress, or an atypical response to prodding actions by security officers. Relevant psychological mechanisms to explain ways behaviour profiling works include direct characteristics of deception as well as indirect indicators of deception, such as a criminal being more self-focused and more cognitively engaged. Effectiveness of behaviour profiling is increased by training, including learning more about modi operandi and related behaviours, awareness of biases in general, specific relevant biases, and techniques to correct for these biases.

SamenvattingAuteursinformatie

Virtual reality is increasingly used in our society. Also in the field of physical safety this technique is applied. In this article we give an overview of virtual reality applications that are used in the Netherlands in this domain. This overview is divided into the five phases of the integrated emergency management system of the Netherlands. Based on international studies from other fields we try to indicate where in the near future virtual reality also can be used.
Conclusion of this article is that virtual reality already plays an important role in the physical safety domain, especially because this technique can support the learning ability of the safety organizations in many areas. Because of constant innovation (in technique and application) that takes place, it is expected that in the future even more virtual reality applications in the field of physical safety are possible.

Trefwoorden regulation, security, privatization, public good, self-regulation
Auteurs Jan Terpstra
SamenvattingAuteursinformatie

This paper deals with the question of how a partly privatized security sector could be regulated. A central aim of this regulation should be the control of security as a public good. Three models of regulation are analyzed. The current practice of this regulation in the Netherlands shows a serious lack of effectiveness. One of our main conclusions is that neither the state nor the private sector is able to enforce this regulation on their own. However, it is assumed that the state should have a central and integrated regulatory role in this field, with more attention paid to the practical implementation of it, with the power and will to sanction private agencies if necessary. In addition managers of private security companies should adopt a role as public managers with a public moral duty. Regulation of security is faced with a double problematic, not only the horizontal fragmentation of the field, but also the vertical fragmentation, often resulting in a serious gap between managers and those in the field, both in the public and the private sector. This implies that the regulation should not only rest on the state and on self-regulation by the sector at management level, but also on the promotion of a practical ethic for security workers to steer and regulate their daily work.

Auteurs Paul Harland
SamenvattingAuteursinformatie

The ‘Shortlist troublesome youth groups’ is a compact survey that enables police-officers to categorize problematic youth groups on a general level. The ‘shortlist’ results in three categories. The least troublesome groups are labelled ‘annoying’, the more serious groups are referred to as ‘disturbing’ and the most serious ones are called ‘criminal’ youth groups. As a quick scan, the shortlist tool has originally been developed in order to prevent criminalization of youth. It has now become a compulsorily used instrument for all 25 police services in the Netherlands. The shortlist is seen as the central starting point that should ultimately lead to the implementation of multidisciplinary interventions to tackle the specific problems that the youth groups cause. This article briefly discusses the highly subjective judgements of perceptions of disorder in society. Against this background this article describes the aim, the benefits and limits to the use of the shortlist. This analysis is based on fifteen years of experience with the annual listing of troublesome youth groups by means of the shortlist at the Haaglanden police service. This contribution concludes that the shortlist is a useful instrument that enables police officers to efficiently categorize problematic youth groups. Several changes by the Haaglanden police service with regard to the content as well as to the procedure further optimized the use of the shortlist. However, its global characteristic hampers evaluation of local safety interventions on the group. Also, comparisons of results between police services are not possible just like that. For those purposes (evaluations and comparisons) additional, i.e. more detailed information on the groups are to be gathered. The shortlist-methodology consists of further steps that include more in-depth analyses.Having said this, the shortlist is a valuable quick scan tool that enables professionals to swiftly categorize problematic youth groups.

Trefwoorden gemeenschap, sociale cohesie, sense of belonging, insluiting
Auteurs Ronald van Steden, Marieke van Vliet, Ton Salman e.a.
SamenvattingAuteursinformatie

This article explores the links between the concepts of security and community, questioning the conventional use and meaning of both. To begin with, it addresses the taken-for-grantedness of the thought that communities foster feelings of security, and that contemporary processes of migration, intensified worldwide communication, and ‘heterogeneization’ of habitats stimulate feelings of insecurity and nostalgia for ‘old-fashioned’ tight kinship. Subsequently, it criticizes the too lop-sided focus on insecurity in current debates, and asks attention for – community-based – positive feelings of security. In the next paragraphs, however, the problematic aspects of the idea of ‘community’ are discussed: its inadequacy in capturing current individualized ways-of-life, its exclusionary tendencies, its potentially exaggerated focus on social control, and its rejection of, and fear for, the outside world. Therefore, we assess the possibility to construe (‘strong’) community qualities in a situation of multiple, overlapping and porous populations of varied identity-relevance within overarching institutional arrangements of rule of law and of shared codes of conduct (as ‘weak’ ties). Finally, the argument is translated in suggestions for empirical research to be able to determine the fecundity of the ideas presented.
