    In this paper I test the thesis that the different fortunes of the secular state in the predominantly Jewish, Christian and Muslim countries depend significantly, although not exclusively, on their different religious background and, in particular, on the conception of God’s law that developed in the theological and legal traditions of these three religions. My analysis will focus primarily on Sunni Islam, Orthodox Judaism and Roman Catholic Christianity. The model of the secular state appears to be connected to the Christian theological concept. It is not neutral and thus, it is futile to attempt to export this model to religious and legal traditions that do not meet the conditions for accepting it.

    As a result of reported cases of child abuse by Roman Catholic priests and brothers in The Netherlands, a Dutch solicitor has formally accused the archdiocese of Utrecht and the diocese of Rotterdam of conspiracy. The charges being ill-founded were rejected by the public prosecutor. The present article points out that the charge of conspiracy was ill-considered and legally untenable under Dutch criminal law, because it could not be maintained that the archdiocese of Utrecht or the diocese of Rotterdam were parties to an agreement to commit the offences in question. Unfortunately child abuse and the tendency to keep it silent are a common problem in Dutch society, not only within the Roman Catholic Church, so it should be addressed accordingly. The Dutch Bishops’ Conference and representatives of congregations established in The Netherlands have set up a fact-finding committee under the expert guidance of the elder states-man Mr. Deetman to make an independent investigation into the facts and circumstances of sexual abuse of children within the ecclesiastical province of The Netherlands and to make recommendations for redress and compensation. The committee has submitted its report in December 2011. Like this the Dutch bishops and congregations have set an example how the problem of prescribed cases of child abuse within a complex social organization can be revealed and dealt with. For that purpose criminal law is a less appropriate instrument. It is satisfying to see that other organizations, religious and secular, have taken similar initiatives.

    The Dutch Industrial Organisation is a public-law system of product boards and industrial boards, which are authorized to lay down general rules and impose levies on the companies under their jurisdiction. It was established in 1950 on a firm theoretical ground, where three principles coincide: the socialist principle of ‘functional decentralisation’, the protestant concept of ‘sovereignty within the communal spheres’ and the Roman Catholic concept of ‘subsidiarity’. The papal encyclical Quadragesimo Anno (1931) added greatly to the philosophical basis of this system and to the ‘collective bargaining economy’, which is so characteristic for the political culture of the Netherlands.

    In 2011 the Dutch Parliamentarian Geert Wilders was acquitted of group defamation pursuant to article 137c of the Penal Code. The court ruled that the qualification ‘concerning a group of people because of their religion’ had not been fulfilled because Wilders had spoken about the religion of Islam but not about people. This recent juridical shortcut has various foundational problems in semantics and jurisprudence. In view of the impact that defamation of religion can have via the modern media, violent disturbance of public order should be reintroduced as a ground of liability.

    Student requests for praying space are posing schools for important questions about their policy. These questions cannot be answered within the scope of relevant principles of law in the Netherlands. On the basis of religious studies research the author suggests that schools should respond to those questions with positive tolerance. Such a policy is most effective in promoting order and other educational objectives. However this tolerance should be bound to a responsibility of praying students towards the position of secular and moderate religious students.

    The authors endeavour to provide new insights on the continuing Dutch debate on ‘immigration’, ‘integration’, and the assumed clash between Islam and Dutch norms, values, and culture. The late Lebanese ayatollah Fadlallah (1935-2010) specifically addressed the Dutch situation in 2005-2010. The article is based on interviews with him, his Dutch followers, and literary sources. It demonstrates that Fadlallah and his followers hold liberal views on contentious issues such as women’s rights, veiling, integration, and condemn violence and terrorism as exemplified by 9/11. On these grounds, the authors question the supposed incompatibility between Islam and integration, arguing that the precepts of practice cast doubt on the validity of such a contention.

    In the Netherlands, a national model for church-state relations is often put forward as the guiding light for authorities struggling with governance dilemmas related to religion. This model supposedly represents ‘The Dutch Way’ of dealing with religion and is, among other things, linked to multiculturalism, a pragmatic outlook, and typically Dutch historical processes like pillarization. This paper examines whether this model holds up in practice. It argues that the Dutch model does not suffice as an accurate description of current policy practices at the local level and that, given various underlying processes that influence this practice, this model also does not provide a credible normative guideline for the future. Dutch society has undergone significant changes, and the Dutch model should be rethought accordingly.
