The decision of the Court that Muslims from the Greek province of West Thrace can choose in matters of family law between civil or Islamic law, is not surprising. However, much can be said about the way in which the Court came to that conclusion. Because in doing so it uses principles and considerations that show a lack of insight in the status and functioning of a unique legal system, namely that of interpersonal law, or the coexistence on equal basis of several family laws. Similarly, the Court seems biased towards Islamic family law, which it consistently refers to as ‘sharia’. A critical discussion of this judgment is therefore appropriate. |

The article examines and explains the relation of current Eastern Orthodox Theology to the concept of Human Rights. Putting the controversies into a larger historical and theological context, it seeks to highlight the conditions of a variety of Orthodox theological positions. Such positions, with their common features and strong differences, concern issues such as church and state, universalism or theological anthropology and human dignity. Considerations end with arguing, that much of the treasures of the Orthodox tradition still needs to be unearthed – to the benefit of Human Rights, and of all participants in current debates worldwide. |

Buddhism has very specific ideas about an idealized form of government in Asia. These ideas may be ancient but they very often play a part in the background of politics up to modernity. Even within republics where religious monarchy has long since disappeared, a certain supernatural foundation on the basis of which a government functions may still be present. Opposition to a government can often imply resistance to a world order that is actually of supranatural origin. This article focuses on historical dimensions of this phenomenon (the position of the Buddha, the origin of the monarchy and Emperor Ashoka), but also on modern forms (Sri Lanka, Thailand and Myanmar). Concerning Myanmar, the recent developments around the Rohingyas are placed in a cultural perspective. |

As a special employer, the church has an interest in shaping its own personnel policy in order to achieve the mission and objective. In part, the legislator has met this need. After all, various laws in the field of appointment, terms of employment and dismissal take account of the specific interests of the church as described before. The external border consists of fundamental human rights that are included in the ECHR and the European Directive on equal treatment. It is not always clear where the external border is exactly. The Dutch legislation regarding the battle of ‘church law’ and fundamental rights is not consistent. Moreover, there we notice a tension between national law and the European directive. |

The first national research into church formation among Roman Catholic migrants in the Netherlands dates from the year 2006. Since then many changes took place within these communities. However, there is not a single institution that collects their addresses and data. Policymakers, scholars or journalists do not have access to recent information. Based on questions about their development and composition, this article updates information about these church communities and places them in a broader historical context. One of the most significant findings in this article concerns the stability of their regular parishioners, that contrasts with the national trend in Roman Catholic Church, which is constantly dealing with a declining amount of members. |

On 20 December 2017, the Court of Justice of the EU ruled that an extrajudicial unilateral divorce brought about in Syria does not come within the substantive scope of the European regulation on the law applicable to divorces (Rome III Regulation). In response to this decision, the inequality between men and women in the divorce law of Muslim countries, the developments that are going on in this area, as well as the role the non-discrimination-principle plays in the recognition policies in European states on Islamic repudiations, are discussed in this contribution. |

The question central to this article is whether ‘Islam’ and human rights are compatible and, if not, whether there might be room to come to a minimum standard of human rights that can be shared globally. This article will demonstrate that, from the perspective of Islamic orthodoxy, principles that are fundamental to human rights, like equality and freedom of religion, pose unsurmountable problems, and the adjustment of these principles is theologically nearly impossible. However, a growing number of Muslim intellectuals holds the opposite view, using new theological methods to argue that these Islamic principles and human rights are compatible. Although they are warmly welcomed by human rights lawyers and activists, their methods are not uncontroversial, and they are still very small in number. |

The article is a plea to reconsider the new impetus that the second Vatican council in the catholic church has brought about, and to give it shape in the ecclesiastical administration of the catholic church. After a period of strong renewal this movement seems to be evaporated in the Netherlands, whereas this council and the code of 1983 have a lot of opportunities to offer. On the basis of a number of concrete examples of administrative reforms that Pope Francis and some of the newly appointed bishops have realized, the author offers some concrete proposals. |

Some religious persons refuse to undergo certain medical treatments such as vaccinations or blood transfusions. They refuse treatment not only for themselves but for their children as well. Many fundamental rights may be at stake here: freedom of religion, the right to physical integrity and respect for family life on the one hand, and the duty of public authorities to provide for health care and defend children’s rights on the other. The main topic of this contribution is the extent to which the government is allowed to make certain treatments compulsory. |

The liberal stance regarding religious freedom starts from a particular anthropology, which holds that in order to become fully human citizens must be able to build their lives on the foundations of their religious convictions. This starting point leads to distinctive conceptions of constitutionalism and democracy that make it possible for citizens to keep faith in liberal democracy. The so-called new critics of religious freedom, to the contrary, run the risk of eventually eroding trust in government by putting their substantial ideas of liberal democracy first and demanding of citizens and their organizations to act in conformity with these ideas. |

The Netherlands changed from a culturally homogenous society into a religiously plural society. This had an impact across public and denominational schools. The pluralisation of the pupil population raised the issue of the so-called pillarized educational system. In this contribution I explore this theme in the context of the freedom of education laid down in article 23 of the Dutch Constitution, and the right of every child to get acquainted with the diversity of its society’s traditions, and to position itself in the plural Dutch society. Moving beyond the pillarized system, all education can then become truly special, preparing children for normative citizenship. |

The Dutch policy of the ‘Participation Society’ intends to return many societal responsibilities to civil society. As religious organizations traditionally had undertaken that task, an increase in their participation is expected. However, the separation of state and religion often proves an obstacle. Also, there is quite some scepticism among religious organization regarding the role that a state should have in its caring duties. This contribution contains several insightful and critical articles on this subject: the introduction is by Gert-Jan Buitendijk, director-general with the Ministry of Interior, who is involved in the policy-making process of the Participation Society policy, followed by brief reflections by two scholars of religion and theology, and two representatives of the Islamic and Catholic communities. These contributions were the outcome of a lustrum symposium organized by the Journal for Religion, Law and Policy in november 2015, where academics, policy makers and representatives of religious organizations discussed the effects of the ‘Participation Society’ policies and laws in the Netherlands. |

This article presents a summary of a report of the (mainline) Protestant Church in the Netherlands on democracy and the rule of law (see: www.protestantsekerk.nl/Lists/PKN-Bibliotheek/The-church-and-the-democratic-constitutional-state.pdf), including an evaluation. It starts from the presumption that modern plural society rightly expects religious communities to present their views in this regard explicitly and clearly. The report presents an interpretation of what ‘the separation of church and state’ entails, as well as an analysis of recent developments in the public domain. The church expresses its critical solidarity with the modern state. It points to the risk of democracy turning into a market rather than a forum. |

This article argues that the increasingly negative attitude towards religion in Dutch society correlates with how the government understands the notion of citizenship. While citizenship used to be understood in a broad and liberal sense, the interpretation of the notion has been narrowed down. Nowadays, citizenship is understood in a cultural-nationalist way, with an emphasis on progressive values, especially concerning sexual-ethical themes. The article shows that the focus on a ‘sexular’ identity as characteristic of good citizenship carries important implications for dealing with religion and religious orthodoxy. A multi-dimensional interpretation of citizenship offers alternatives for an inclusive society |
