EU-burgerschap en toegang tot sociale voordelen over de grens

    In recente arresten heeft het Hof van Justitie uitgemaakt dat als een land door middel van een nationaliteits- of woonplaatseis de toegang tot zijn stelsel beperkt, ook niet-economisch actieven deze eisen kunnen aanvechten op grond van de bepaling van het Europees burgerschap. Wel mogen lidstaten bepaalde goed beargumenteerde beperkingen stellen voor personen met een vreemde nationaliteit, zoals dat men vijf jaar in Nederland heeft gewoond voordat men recht heeft op studiefinanciering. Nu rijst een aantal vragen. Hoe kan het dat de bepaling van het Europees burgerschap een dergelijk effect heeft? Zijn er nog verschillen tussen economisch actieve en niet-actieve burgers? Is de jurisprudentie over het burgerschap geen bedreiging voor nationale welvaartsstaten? Deze vragen worden in deze bijdrage behandeld. Daarbij komt ook het recente arrest Europese Commissie tegen Nederland (C-542/09) aan de orde.

Zijn veiligheidshuizen effectief?

    In the Netherlands ‘Safety Houses’ have been established, in which partner organizations in the field of criminal justice, crime prevention, law enforcement, public administration and social services collaborate in order to reduce crime and recidivism, and to increase public safety. This article examines why some Safety Houses are better in achieving these goals than others. The effectiveness of 39 Safety Houses is analyzed by means of QCA (qualitative comparative analysis). Results show two different paths leading to effective outcomes. Effective Safety Houses have been in existence for at least three years, show a high degree of stability and a centrally integrated collaboration structure. In addition, they either have considerable resources at their disposal or have been set up with a network administrative organization, where a neutral coordinator governs the network.

Medical liability: do doctors care?

    Van Velthoven and Van Wijck review empirical studies on the effects of tort law in the medical sector. The data they present comes mainly from the US, because from the 1970’s US states have enacted a variety of reforms in their tort systems. This variation has provided very useful data to study preventive effects. The empirical evidence analysed shows that medical malpractice risk affects the behaviour of health care providers. It has a negative impact on the supply of services and it encourages extra diagnostic testing;yet if the additional tests and procedures have any value, it is only a marginal one. Furthermore it has been found that changes in the supply of services do not affect health adversely. This suggests that the physicians who are driven out of business have a below average quality of performance. The authors conclude that, at the margin, medical liability law may have some social benefits after all.

    Dit artikel behandelt de door de Europese Commissie in 2008 geïntroduceerde schikkingsprocedure voor kartelzaken. Op grond van de eerste zes schikkingsbesluiten wordt beoordeeld hoe succesvol de procedure tot nu toe heeft uitgepakt voor de Commissie en voor deelnemende ondernemingen. Hierbij wordt allereerst kort ingegaan op de achtergrond en het verloop van de procedure. Vervolgens komen de voordelen en risico’s voor beide partijen in de procedure aan bod en wordt gekeken hoe deze zich tot nu toe in de praktijk voordoen. Het artikel concludeert positief over de procedure maar wijst op enkele mogelijke verbeterpunten.

    In the Netherlands, not much research has been done on the ways that Dutch women experience and try to survive a detention abroad. The research, on which this article is based, did focus on Dutch female prisoners abroad, using an ethnographic research method. This study looks at the ways Dutch mulas experience their prison term in Peru and focuses on their strategies of survival. The ways these women react upon their detention can be traced back to existing literature on the importation theory and deprivation theory. Also it became apparent that various coping strategies are used to survive their Peruvian imprisonment. These coping strategies proof to be related to the life experiences of the women (importation theory) and the experienced prison environment (deprivation theory).

    Messina, a Sicilian town, was devasteted by an earthquake in1908. It was an hecatomb. Stricken through this unfathomable disgrace Messina’s institutions and civil society collapsed and a sort of wild natural state replaced the rule of law. In this situation there was a first intervention of the Russian Czarist navy who came to help but immediately enforced cruel emergency measures. The Italian army followed and there was a formal declaration of an ‘emergency situation.’ Around this event and the several exceptional measures taken by the government a debate took place about the legality of those exceptional measures. The article tries to reconstruct the historical context and the content of that debate and in a broader perspective thematizes how law (and morality) could be brought to meet the breaking of normality and ordinary life by an unexpected and catastrophic event.

    Fifty three shades of grey refers to the radical transformation of policing and security in society from a traditional public – and foremost ‘blue’ – police system into a hybrid(semi)public and private policing system which is losing its dominant – and visible – blue character. Using the criminological concepts ‘police as an institute’ and ‘policing as a process’ the ongoing blurring of boundaries between different public and private organisations is discussed in the context of the proliferation of different forms of multi-agency cooperation. Whereas in the traditional discourse of the public police system a strong tradition of analysing the democratic nature of policing exists, in the public and scientific perception of the new, variegated police constellation such notions are still lacking, which contributes to the relative lack of political control, the defective democratic accountability and fragile human rights in the grey areas. The public discourse on the police remains too narrowly focused on the public police system. ‘Normal science’ of policing needs to break away from ‘police as an institute’ to incorporate new research questions and new concepts regarding ‘policing as a process’.

    Academic and professional disciplines, such as organization and management theory, psychology, sociology and engineering, have, for years, grappled with the multidisciplinary issues of safety and accident prevention. This article examines a domain of research on system safety – the high reliability organization (HRO) paradigm. HROs operate in hazardous conditions, but have fewer than their fair share of adverse events. HROs, traditionally found in the domain of aviation and aircraft carriers, are committed to safety at the highest level and adept a special approach to its pursuit. The attributes and operating dynamics of the best HROs provide a template on which to better understand how safe and reliable performance can be achieved under trying conditions.

    There is an impressive body of literature dealing with the so-called ‘cruelty link’. Two directions can be distinguished: animal abuse as a part of domestic violence and cruelty against animals as a predictor of a penchant for violence in later life. Related to these topics are a lot of methodological problems, for example regarding research designs, definitions of (domestic) violence and animal abuse, practices of cultural bias and prejudice regarding the position of animals in society and problems regarding the recognition of abuse. This contribution deals further more with the problematic claims of correlation and causation between violence against humans and animals. What is the risk of identifying ‘false positives’, that is making uncritical assumptions and accusations of (a penchant for) violent behaviour based on the (mis)interpretation of certain behaviour against animals?

    The Netherlands public-service broadcasting system is confronted with an austerity policy of the present liberal-christian democrat minority cabinet, supported by the populist Party for Freedom. The Rutte cabinet also aims at scaling back the amount of large member-based broadcasting associations. Merger talks are now high on the agenda in Hilversum. Apart from the large member-based broadcasters a small amount of airtime is given to several broadcast organizations that represent the main religious or spiritual communities (catholic, protestant, jewish, buddhist, humanist, hindu, islamic). They are also involved in the merger talks. This article clarifies their present position in the Dutch broadcasting system under the Media Act. It is argued that they should integrate to form one, internally pluralist, task-based broadcaster for ‘higher things’, especially in order to stimulate religious encounters and dialogue.

    Illegal deforestation is generally not considered as a criminological subject but in this article it is argued that it can easily be considered as such. The central question that is addressed here is how the theme of deforestation, which clearly fits into the new realm of green criminology, relates to more traditional criminological concepts. This question is discussed through various case studies: the Brazilian Amazon (mainly Brazil), Central Africa (mainly the Democratic Republic of Congo), South East Asia (mainly Indonesia), Russian Siberia, and Pakistan's Swat forests. The case studies show that there are actually many victims of deforestation, both human and non-human, and that deforestation is linked to a variety of other crimes and harms as well. It is concluded that even without taking a green criminological perspective, several concepts of criminology apply to illegal deforestation practices: governmental and state crimes, corporate crimes, and various types of organized crime.

    As a contribution to literature drawing together green criminology and studies of organized and corporate crime, this paper provides a case study of crimes and public health harms linked to the Naples garbage disposal crisis. The context is the inability of modern consumer society to cope with the problem of mass production of waste. In turn this leads to opportunities for both legal and criminal entrepreneurs to offer services that promise but fail to ‘dispose’ of the problem. The analysis draws upon environmental law and classic studies of organised crime.
