    How can we teach critical legal education? The article tackles this key question by focusing on the role of methodology in legal education and research. I argue that critical legal education requires marketing methodology as a ‘skill’, thereby freeing it from what students and researchers in Law often view as the negative connotations of ‘theory’. This skill requires exploring ‘alternative methodologies’ – those critical perspectives that depart from legal positivism and which Law traditionally regards as ‘peripheral’. As an example, the article explores the Foucauldian concept of governmentality as a useful methodological tool. The article also discusses the difference between theory, methodology and method, and reviews current academic contributions on law and method(ology). Ultimately, it suggests a need for a ‘revolt of conduct’ in legal education. Perhaps then we might hope for students that are not docile and disengaged (despite being successful lawyers) but, rather, able to nurture an attitude that allows for ‘thinking’ (law) critically.

    This article seeks to critically analyse the European Commission's Proposal for a Council Regulation on jurisdiction, applicable law and recognition and enforcement of decisions in matters of matrimonial property regimes (COM (2011) 126). It focuses upon the coordination of the Proposal's provisions on jurisdiction and applicable law with the parallel provisions contained in other related EU private international law instruments, namely those relating to divorce (Brussels II bis and Rome III) and succession (Succession Regulation). In doing so, the article adopts a 'stress-test' approach, presenting scenarios in which interaction between these related instruments takes place. The compositions and circumstances of the fictitious couples in these scenarios are varied in order to fully illustrate the potential consequences of the interplay between the instruments. This article seeks to assess the extent to which (in)consistency exists between the current and proposed EU private international instruments and, by evaluating this interaction through a number of norms, how identified inconsistencies impact upon international couples' legal relationships. In order to ensure the analysis remains as up to date as possible, the article will also take into account relevant changes introduced in the latest revised versions of the Proposal.

Jacqueline Gray studied law at the University of Glasgow (2006-2010) and European law at the Leiden University (2010-2011). Following this, she undertook a four-month internship at the Molengraaff Institute for Private Law and five-month traineeship at the European Parliament in Brussels. She is now a PhD student at the Molengraaff Institute for Private Law, where she is writing her dissertation on party autonomy in the EU private international law relating to family matters and succession.

Pablo Quinzá Redondo, a research scholar funded by the Spanish Ministry of Education, Culture and Sport, is currently undertaking a PhD at the University of Valencia. His specialisation concerns 'The europeanisation of matrimonial property regimes from a substantive and private international law perspective'.     In this article on the social production of the book Outsiders, I will situate its production in the daily practice of the social worlds in which Becker was involved. Therefore I focus on the relations, interactions and situations which were relevant for the form, content and success of Outsiders. For data, I use fragments from my email communication with Howard Becker, the collected interviews and other publications which show that Becker seeks to demystify Outsiders. My main contribution is that I use Becker’s own words to demystify the ethnographic practice of Outsiders and describe its mundane backstage reality, which is described by Fine as ‘the underside’ of ethnography (1993).

    To what extent must employers accommodate manifestations of religion within the workspace and what should be the role of the state in that respect? In the joint case of Eweida and others the European Court of Human Rights discusses this question from four different angles as urged on by four different complaints. Two complaints concern the banning of Christian crosses, either for reasons of protecting the corporate image of a private company, or for reasons of health and safety within a care institution. The remaining complaints concern employers that, through their equal rights policies, notably equality on grounds of sexual orientation, may effectively force employees to act contrary to the religious dictates of their conscience.

    In Das Recht der Freiheit Axel Honneth develops his concept of social freedom. In this article I discuss Honneth’s project and critique one of its crucial aspects: Honneth’s views on the disruptive role of legal freedom in our society and its dependent relation to the sphere of social freedom. I argue that in his attempt in Das Recht der Freiheit to reactualize Hegel’s discourse on the realization of freedom for our time, Honneth risks mistranslating Hegel’s discourse of ‘right’ by denying the sphere of legal relations a constitutive role for true freedom, and that because of this Honneth’s own theory of social freedom suffers: it becomes less clear whether it can still offer helpful insights into the proper place of legal freedom in our society.

    As we move towards constructing narratives regarding the future outlook of global governance, constitutionalisation among them, the hope is that whatever shape this world order takes it will, somehow, forestall or hinder the possibility of a hegemonic order. This article tries to deconstruct the notion of hegemony and claims that as it currently stands it is useless in doing its critical work since every successful narrative will end up being hegemonic because it will employ the ‘hegemonic technique’ of presenting a particular value (or value system), a particular viewpoint, as universal or at least applying to those who do not share it. The only way for a narrative in this discourse not to be hegemonic would be for it to be either truly universal and find a perspective that stems from nowhere and everywhere – a divine perspective – or purely descriptive; the first being an impossibility for fallible beings and the other not worth engaging with since it has nothing to say about how things should be structured or decided in a specific situation.

    Several reports covering the provision of legal aid in asylum procedures in a selection of European countries expressed concerns on the effectiveness of the legal aid provided to asylum seekers. Among others, the cuts in legal aid funding and the speed of the asylum process were put forward as issues affecting the provision of adequate and effective legal aid. Lawyers providing legal aid in asylum procedure have to cope with the day-to-day realities arising from the national asylum procedure and legal aid system in which they operate. The aim of my research project is to explore and understand the impact of the institutional context, i.e. the functioning of the asylum procedure and the legal aid system on lawyers’ conduct. To this end I will conduct a comparative case study in three EU Member States which have arranged for the provision of legal aid in different ways, i.e. Netherlands, the United Kingdom1xHere it must be noted that the UK comprises of four constituent countries with different regimes. This research will be confined to the England region of the UK. and France.

    On 26 May 2013 Ard van der Steur, Netherlands MP for the liberal democrats, introduced a cluster of three mediation bills to secure the status of mediation as a sound alternative to traditional in-court adjudication in civil and administrative disputes. Although the starting point in these bills is that mediation should take place on a voluntary basis, there are some arrangements that may result in quasi compulsory mediation. One such arrangement is that the judge, on his own motion, may refer parties to mediation. Also parties have to proof that they first have attempted to settle their dispute through mediation and if not, why not.

    Although shared legal problems are generally easily identified in transnational law design, it is considerably more difficult to design frameworks that transcend the peculiarities of local law univocally. The following exposition is a plea for giving more prominence to rigorous conceptual analysis in transnational law design in order to disambiguate the terms used in such frameworks. It does this by taking the formation of contracts in the model rules of the Draft Common Frame of Reference (DCFR) as a case in point. A conceptual analysis of the basic legal notion ‘juridical act’ in its model rules for contract law shows that the DCFR allows for two mutually conflicting interpretations of contract formation that are by no means fictional. A rigorous conceptual analysis of basic legal notions in the formative stages of transnational law design would have prevented a conflation of two legal traditions resulting in an ambiguous legal framework. As such it is an indispensable method for achieving a univocal interpretation of the legal end product.

    Based on qualitative research within Chinese restaurants in the Netherlands, the authors describe and discuss (informal) labour relations among Chinese restaurant owners and their illegal Chinese workers. It is argued that a too one-sided emphasis on interpreting these labour relations in terms of ‘labour exploitation’ reduces employers to offenders and employees to victims. Such a judicial perspective hinders a clear view on the causes of underlying themes as illegal labour and illegal stay. The authors discuss how restaurant owners and employees operate in a ‘moral economy’ in which a demand for cheap products and flexible, motivated, cheap, and capable labour interacts with culturally shared expectations on justice and reciprocity and influences labour relations.

    Financial relationships between state, churches and religious organisations have existed for a long time in Dutch history. This could be understood from a general interest point of view in the nineteenth century and the social welfare state. However, that century and the welfare state do not exist anymore. Also society and people have changed. Do the financial relationships still exist nowadays and if so, to what extent and how should one assess these financial relationships? In order to deal with these questions, the article gives a comprehensive overview of the current situation of different financial relationships between state and religious organisations against a constitutional and historical background. It is argued that most of these relations are legitimate under certain conditions and that the constitutional framework of separation of church and state should not be overestimated in this field.

    Honour based violence has attracted a great deal of attention in recent years in the Dutch public debate. However, given that honour can be damaged and restored in many ways, defining this kind of violence is rather difficult. The term honour based violence is an umbrella concept. This article explains how, within this concept, the relationship between religion and violence in the name of honour is understood.

    Het Amerikaanse rechtsrealisme is een stroming die zich richt tegen opvattingen die het recht buiten de maatschappij plaatsen in een apart domein (positivisme) of boven de maatschappelijke orde (natuurrecht). Hierbinnen neemt Karl Llewellyn een centrale positie in. Op basis van sociaalwetenschappelijk onderzoek (inclusief veldwerk bij de Cheyenne-indianen) ontwerpt hij een theorie over ‘law jobs’ die de basis is voor projecten die tot een realistische rechtspraak en realistische wetgeving leiden. Daarbij is vooral het begrip ‘situation sense’ van belang; het blijkt te operationaliseren tot een werkwijze die in vijf stappen tot een oordeel of beslissing leidt.

    In this article, the author defends two propositions related to the concepts of free will and criminal responsibility. Free will is defined as the capability of distancing oneself from one’s immediate surroundings and reflect on impulses. The first proposition is that it is a mistake to suppose – as do many neuroscientists adhering to objectivist theories on the human mind – that the concept of free will refers to a postulated natural phenomenon, the existence of which could, in principle, be established or falsified. Instead, the concept of free will constitutes a practice; it is a human artefact that is part and parcel of the differing means by which mankind structures intersubjective life. The second proposition is that the criminal law legitimately presupposes that persons normally act out of free will and that they, consequently, are morally responsible and accountable for the wrongful actions they perform. The author claims that his arguments for both propositions are supported by insights from the neuroscientific fields of connectionism and embodied cognition.
