Pieter Ippel is hoogleraar Rechtsgeleerdheid bij de Roosevelt Academy, het internationale ‘liberal arts and sciences-college’ van de Universiteit Utrecht in Middelburg.

    Ownership, sustainability and capacity building are the buzz words of development cooperation; that is not different in the legal field. Five years of experience in legal development cooperation in Rwanda, both on the side of the northern and the southern partner, shows that this is not a merely southern responsibility. The fact that a project is demand-driven instead of donor-driven is only the start. The northern partner has the responsibility to seduce the southern partner each and every day again, and keep him at the steering wheel. This implies that the northern partner shows personal involvement, and leaves the southern partner deciding about what is happening and when. This implies certain flexibility in the execution of a project, both time and content wise. And it means that the northern partner recognizes that the southern partner does not exist merely for the northern project. Otherwise it will lead to a southern partner that says ‘yes’ and picks the best cherries, but for the rest does ‘no’ and obstructs where possible.

    Each of the more than four hundred Dutch municipalities is governed by an executive board led by a mayor. This board of municipal executives is formed by a coalition of political parties reflecting the balance in the general council of elected members. The mayor is a member of the board; he is not elected by the people. The mayor is officially appointed by the national cabinet of ministers, but in fact since recently selected by the local council. In the Netherlands there has been a significant rise in the number of forced resignations by mayors. From 2000 to 2010 more than fifty mayors were forced to resign before the end of their term. The impression that the mayor's position has recently weakened, is confirmed by case studies. The Dutch mayor is in limbo between being elected and being appointed. In itself this is a major factor contributing to the weakening of Dutch mayors in general. This might give more room than before to private reasons and micro factors causing mayors to resign early. Mayors wishing to survive, should give more attention to signals about ‘strengths and weaknesses’ of their position in a field of political ‘stakeholders’.

    In TMD 2009-2 the article ‘Case study: the international CSR conflict and mediation. Supply-chain responsibility: western customers and the Indian textile industry’ was published. In this article, Tineke Lambooy describes the ins and outs of the multiparty dispute between G-Star, in origin a Dutch company, the Indian-Italian Fibres & Fabrics, the employees of Fibre & Fabrics International, the governments involved and a number of non-governmental organisations striving for good labour relations and labour conditions. Lambooy’s article resulted in four reactions that are published in this article.
