    This contribution discusses the supplementary value of media analyses to understanding the relationship between media and crime. Analyses of media framing and media hypes are discussed on the basis of two cases: the case of New Years Eve in Cologne in 2015 and the “bus incident” of Moroccan Dutch youngsters in Gouda in 2008. The two cases presented here illustrate the significance of media analysis in criminology and its relevance in a media society. Analyses of the media representation and the societal reactions show the influence of media on the image building about crime. Since media are a predominant force of modern society and mediatization is a characteristic of the present tense, media representation has a great impact on the perceptions of crime and punishment, and our reality.

    The security landscape has changed rapidly. New or revived threats have emerged, such as terrorism and cybercrime, bringing new or revived fears and anxieties as well. Actors in security policy feel a need to address these fears, but do not know how. Can the criminological subdiscipline of fear of crime studies provide the knowledge and understanding that is needed? A quick scan of the state of the art in this research domain, gives two reasons why it cannot: (1) fear of crime studies have yielded much knowledge on operationalization, measurement and determinants of fear of crime, but far less in mechanisms, trends, effects and influenceability, whereas insight in the latter issues is what is mostly needed in security policy; and (2) fear of crime studies are still mainly focused on the ‘traditional’ fear of crime, while fear of new crimes and threats remains under-researched. A shift of focus in fear of crime studies is urgently needed.

    If a religious organisation relies on an exception to the principle of equal treatment to draft rules that differ according to the religion of the employees, this must be subject to judicial review and will be acceptable only if the religion or belief constitutes a genuine and legitimate occupational requirement, justified by the ethos of the organisation concerned and the application of the exception is proportionate. If there are contrary provisions in national law, these must be disapplied.

    A worker cannot automatically lose the right to annual leave because s/he did not apply for it. The employer must have informed the employee about the opportunity to take leave adequately and in a timely way, and must be able to prove this has been done.

    According to German law, every employee is entitled to paid annual leave. The amount of pay is generally calculated based on the current salary (known as the “principle of loss of pay”) but a reduction of working hours during the year does not lead to a reduction of entitlement to holiday pay for previously acquired holiday entitlements. If the entitlement was already acquired before the reduction of working time (which can happen because in Germany holiday entitlement is acquired at the beginning of the calendar year), pay during leave will be based on the salary agreed between the employer and employee when the holiday entitlement was acquired and thus, based on the ‘old’ salary.

    Heirs of a deceased worker are entitled to an allowance in lieu of untaken paid annual leave. Based on the EU Charter of Fundamental Rights, this applies between individuals as well.

    Following the ECJ’s decision in Somoza Hermo – v – Ilunion Seguridad, C-60/17 (Somoza Hermo) of 11 July 2018, all eyes were on the Spanish Supreme Court. Since 2016, the Court has ruled a number of times that limitations to the liability of the new contractor established in a collective bargaining agreement (‘CBA’) in the context of a CBA-led transfer were valid (see e.g. EELC 2018/21). Somoza Hermo established that a CBA-led transfer that entails a non-asset-based transfer is a transfer within the meaning of the Acquired Rights Directive. Now the Supreme Court (in a decision dated 27 September 2018 taken with one dissenting opinion) is clear that its doctrine must be reviewed and has therefore held that limitations on pre-transfer liability for a new contractor under a CBA-led transfer that trigger a non-asset-based transfer, are not valid.

    The Austrian Supreme Court has held that the employer must notify the Employment Service (AMS) when it is contemplating collective redundancies, even if they are carried by mutual agreement. The duty of notification is triggered if the employer proposes a mutual termination agreement to a relevant number of employees, provided the offer is binding and can be accepted by the employees within 30 days. If the employer fails to notify the AMS, any subsequent redundancies (or mutual terminations of employment occurring on the employer’s initiative) are void, even if effected after 30 days.

    The obligations regarding collective redundancies also apply to all undertakings linked to an employer by shareholdings or by other links in law which allow for decisive influence in decision-making bodies and compel it to contemplate or to plan for collective redundancies.

    For workers without a fixed workplace, travelling time between their place of residence and the first customer and travelling time between the last customer and the place of residence constitutes working time.

    In a recent decision, the Labour Court awarded an employee € 7,500 for working in excess of 48 hours a week, contrary to working time legislation. The complainant allegedly regularly checked and responded to emails outside of business hours, occasionally after midnight. The Labour Court reiterated it is the employer’s responsibility to ensure that employees are not permitted to work beyond the statutory maximum period and that if an employer is aware that an employee is working excessive hours, must take steps to curtail this.

    In deze bijdrage, die een weerslag biedt van de door Lorenzo Squintani gehouden presentatie tijdens de VMR-bijeenkomst op 31 mei 2018, staat de vraag centraal welke eisen het internationaal en Unierecht stellen aan rechtsbescherming tegen plannen en programma’s in het omgevingsrecht, en in hoeverre Nederland daaraan voldoet. Ter beantwoording van deze vraag wordt eerst het Verdrag van Aarhus en de implementatie daarvan in het Unierecht bekeken, waarbij ook de reikwijdte van het begrip ‘plannen en programma’s’ in het EU-milieurecht wordt geschetst. Daarna wordt ingegaan op de toetsing overeenkomstig het Unierecht en de (on)mogelijkheid van exceptieve toetsing. Dit wordt gevolgd door een analyse van het Nederlandse rechtssysteem, waarna geconcludeerd wordt dat dit rechtssysteem op onderdelen tekort lijkt te schieten, gelet op het internationaal en Unierecht.

    This article discusses empirical examples from international trial transcripts to see if and why there is a need to use the ‘enemy of all humanity’ label in contemporary international criminal justice discourse. It shows an absence of explicit uses of the concept and an ambiguous set of implicit references; the hosti generis humani concept is simultaneously too precise and too broad for ICJ discourse. Based on these findings, the article challenges David Luban’s suggestion that the term can be undone from its dehumanizing potential and used adequately in the ICJ context.

    In his contribution to this special issue, David Luban proposes to revive the age-old concept of ‘the enemy of all humanity.’ On his view, this concept supports the aims of international criminal justice by emphasizing that atrocity and persecution crimes are ‘radically evil’ and therefore ‘everyone’s business.’ Criticizing Luban’s proposal, this paper shows that in the past, the ‘enemy of all humanity’ concept has often served to establish parallel systems of justice, depriving these ‘enemies’ of their rights as suspects under criminal law and as lawful combatants under the laws of war. Thus, even if the ‘enemy of all humanity’ concept is used with the intention to bring today’s perpetrators of ‘radical evil’ to justice, it risks undermining, rather than protecting, the rule of law.

    Piracy holds a special place within the field of international law because of the universal jurisdiction that applies. This article reconsiders the role of piracy in the development of universal jurisdiction. While usually a connection is established between Cicero’s ‘enemy of all’ and modern conceptions of pirates, it is argued that ‘enemy of the human species’ or ‘enemy of humanity’ is a medieval creation, used by Bartolus, which must be understood in the wake of the Renaissance of the twelfth century and the increased interest for the study of Roman Law. The criminalization of the pirate in the late Middle Ages must be understood not only as a consequence of royal power claiming a monopoly of violence at sea. Both the Italian city-states and the Hanse may have preceded royal power in criminalizing pirates. All the while, political motives in doing so were never absent.

    Trationally, the term “enemy of all humanity” (hostis generis humani) referred to pirates. In contemporary international criminal law, it refers to perpetrators of crimes against humanity and other core. This essay traces the evolution of the concept, and then offers an analysis that ties it more closely to ancient tyrants than to pirates. Some object that the label is dehumanizing, and justifies arbitrary killing of the “enemy of humanity.” The essay admits the danger, but defends the concept if it is restricted to fair trials. Rather than dehumanizing its target, calling the hostis generis humani to account in a court of law is a way of recognizing that radical evil can be committed by humans no different from any of us.

    Companies fined for infringing the cartel prohibition are denied access to the courts until the competition authority has reviewed its fining decision in the objection procedure. Several stakeholders have been negative about the functioning of this objection procedure in case of cartel fines, including because of its limited ability to resolve disputes and the cost and length of the procedure. In light of the discussions on the effectiveness of this objection procedure, this article analyses the ability of the cartel objection procedure to resolve disputes on basis of an analysis of the decisions on objection, as well as interviews with the parties involved in the objection procedure and a study of relevant literature. Previous studies have shown that the success of the objection procedure, regarding dispute resolution, depends on the nature of the dispute, the reason that the objection is made and the organisation of the procedure. Reviewing the data which was gathered through the interviews and case analysis with the knowledge of these factors influencing the success of the objection procedure, the article concludes that these previously carried out studies can explain the limited ability of the cartel objection procedure to resolve disputes.
