    Deze bijdrage gaat over de verschillen tussen de enquêteprocedure als verzoekschriftprocedure en het kort geding als dagvaardingsprocedure. In beide procedures kunnen voorlopige ordemaatregelen worden verkregen, maar er bestaan belangrijke verschillen. Gedacht kan worden aan bijvoorbeeld het belang dat in de procedure centraal staat alsmede de rol die belanghebbenden spelen.

    This paper looks at how Dutch newspapers dealt with mental disorders and gender in their crime reports in 1930. The Psychopath Acts, which allowed special restriction orders (‘TBR’) to be imposed on mentally disturbed delinquents who were a danger to society, had just come into effect then. The newspapers did not present such TBR criminals as dangerous or mentally disturbed. Instead, the papers used ‘madness’ to explain apparently motiveless crimes such as killing one’s own children. Female perpetrators were no more likely to be labelled mentally ill than male perpetrators.

    The American philosopher Martha Nussbaum and the former Archbishop of the Anglican Church Rowan Williams both published a book three years ago pleading for room for religion in the public arena. Nussbaum makes use of, mainly, liberal arguments, whereas Williams has drenched his argument with Christian-social notions such as pluriformity, sovereignty and human connectedness. Nussbaum, on the one hand, argues that religious arguments must not be banished from the public arena. Williams, on the other hand, holds that religious arguments and stories must be heard in the public arena. Nussbaum offers clues for christian-social political parties to connect with secular parties that claim to liberal.

    Het vonnis van de Haagse rechtbank in de zaak Urgenda tegen de Staat der Nederlanden heeft wereldwijd de aandacht getrokken. Het bevel van de rechter aan de Staat om meer te doen om de uitstoot van broeikasgassen met 25 procent ten opzichte van 1990 te verminderen heeft zowel lof als kritiek geoogst in de (internationale) media en literatuur. Milieuorganisaties loven de durf van de rechtbank om de Staat via het onrechtmatigedaadsrecht te houden aan internationaal overeengekomen CO2-reductiedoelstellingen. Staatsrechtgeleerden hekelen het vonnis daarentegen omdat de rechter te activistisch zou hebben geopereerd, te veel op de stoel van de wetgever en de politiek zou zijn gaan zitten en onvoldoende rekening houdt met de beleidsvrijheid van de Staat. De vraag is echter of deze kritiek niet uitgaat van een te eenzijdige lezing van het vonnis en van verouderde denkbeelden over de rol van de rechter binnen de trias politica.

    A taboo serves the social order for it facilitates social control. This article will focus on taboos related to sexual contact by youngsters. The way authorities guard sexual taboos is indicative of the way authorities envision the organization of society. It is this organization through the control of youth and sex which will receive attention. In the classic study by Mary Douglas on pollution and taboo dirt is understood as ‘matter out of place’. The sexual teenager is an illustration of this ‘matter out of place’ because it is difficult to categorize sexual teenagers on the basis of asexual children and sexual adults as an organizing principle for society. In criminal law lewd conduct by youngsters refers to wrong sex at the wrong age. By criminalizing these sexual transgressions the proper place of youth and sex is once again restored. This is necessary for it will be argued that the interests of society are somewhat under pressure because of transgressions when it comes to children as asexual and when it comes to sex as something for within a relationship. The perpetrator of lewd conduct should be understood as a scapegoat reestablishing when and how sex should take place. By restoring the asexual child and the sexual relationship it is hoped sex and youngsters can once again offer some guidance in a social order lacking these clear markers.

    This article stems from a practice-oriented research on restorative justice and perceptions of conflict in a poor neighbourhood in Brussels: the Anneessens district. The first part of the article focuses on the conceptual shift from a crime-oriented towards a conflict-oriented restorative justice, including the search for a user-friendly working definition of ‘conflict’. The classical restorative justice story receives a facelift in order to address metropolitan challenges. The second part analyses 41 walking interviews of residents, focusing on conflict themes and zones. The third part cautiously checks the working definition in the frame of the analysed data. A provisional conclusion entails that the notion of crime and its related meanings should not be discarded too quickly.

    This article describes the attitudes of Turkish and Moroccan Dutch regarding cousin marriages, using two qualitative studies. Last year the Lower House of the Dutch parliament passed a bill involving a ban of cousin marriages. The main reason for the ban is that many of these marriages are supposed to be concluded forcibly. The new law will mostly affect immigrant groups, since such marriages occur frequently in this population. This article describes the significance for the enforceability of the ban for these groups as well as the attitudes towards cousin marriage. Legitimacy problems seem to arise because a part of the Turkish and Moroccan Dutch respondents feel that the state should not interfere with the individual choice for a marriage partner. Yet there is also evidence for regulatory compliance on normative grounds, even among those who oppose the bans, due to democratic procedures and religious norms.

    This articles offers an overview of four centuries of ‘forbidden relations’ in The Netherlands. From the late sixteenth century onwards, the dominant Calvinist church tried to ‘purify’ the Dutch nation by persecuting all forms of fornication, adultery, incest, and sodomy. The French period (1795-1813) separated church and state, and removed several forms of forbidden relations from the penal code. But social control on relations remained intense. An ‘ideal’ marriage was based on equality of the spouses in terms of social background, religion and age. Parents as well as the local community made sure young people made the ‘right’ choice. Competition between religious groups intensified in the late nineteenth century and mixed marriages became even more problematic. In the 1960s and 1970s all this began to change, and many rules and norms regarding partner choice were relaxed. An example of the changes over time are unmarried cohabitations which transformed from a crime (sanctioned by banishment) to deviant behaviour (sanctions through withholding poor relief) to a more or less normative ‘trial marriage’.

    Between 2001 and 2012 there has been a sharp drop in marriage migration from Turkey and Morocco. The number of migration marriages fell particularly sharply in the years after 2004, after changes were made in the legislation concerning marriage migration: the income and age requirements were raised and passing a pre-entry test became conditional to obtaining a visum. This article aspires to explain this decline of migration marriages among co-ethnics of Turkish and Moroccan origin in the Netherlands. As the strongest decline in the number of migration marriages coincides with the introduction of stricter conditions for marriage migration, the author states that these changes in the law acted as a catalyst for a change in mentality among migrant families of Turkish and Moroccan origin.

    In this article we show what relationships may exist between sex workers and their partners. These relationships are diverse and sometimes complex by the presence of both intimacy and intimidation or violence. From the women’s perspective these relationships are not primarily defined as ‘violent’ and ‘involuntary’, they also provide them love, protection and security. From a governments perspective with a focus on human trafficking and exploitation of sex workers, these relationships are quickly mistrusted. In the latest measures to prevent exploitation, all sex workers are questioned about their relationships. Although this may be important for the identification of potential exploitation, in practice the opposite happens: women keep silent about their relationships towards government officials. In other words, an increasing focus on combating exploitation may enforce the stigma on relationships of sex workers.

    This article reflects on the various aspects of paedophile relationships. It is for a large part based on the author’s 30 years of clinical experience with the treatment of paedosexual men. The characteristics of paedophile relatonships are examined and how they usually develop. What does the paedophile seeks in a relationship with a child and vice versa? The prohibition of paedophilia and its consequences for the paedophile are also discussed. Paedosexuality is banned because of the supposed damage for the child involved. But what causes this damage? And what is the possible damage caused by the prohibition? Finally the author shows the interacting of elements like desire and love as well as manipulation and secrets. The friendship with an older man can be very valuable for a child, which is reflected in many books and movies on this topic. In this sense a paedophile relatonship can be appropriate. But this applies only if the adult has enough self control to refrain from giving in to sexual desires, since a paedosexual relationship can never be appropriate.

    This article presents a micro- and a macro-level analysis of predictors of delinquency in order to contribute to the discussion about the micro-macro problem in criminology. We use Coleman’s boat (1990) to situate our research question. Individual theories dominate the field of delinquency, there are few theories at macro level. Cross-level theoretical integration primarily takes place between individual (micro) and community (meso) levels, and hardly ever on (national) macro level. Our question is to which extent macro-level theory fruitfully may use concepts drawn from micro-level theory. We test a micro and a macro model using indicators from the domains of family, school, friends/peers and economy, using data collected by the Second International Self-Report Study of Delinquency (ISRD2), a cross-national self-report survey of delinquency and victimization among students between 12 and 16 years in 30 countries (n=71.436). Dependent variable at micro level is versatility (last year), at the macro level (national) we use contacts with the police for youths under 18. Results confirm the importance of including macro context (country clusters) in the analysis of individual delinquency. We further conclude that factors related to family and friends correlate at both micro and macro level with measures of delinquency; the role of school and economic factors is less clear-cut. The article concludes with the recommendation to give the micro-macro problem in delinquency theory a more central and explicit position in research programs.

    The philosophy of John Rawls (1921-2002) has had a profound influence on political and legal thinking. From the beginning people have wrestled with the place of religion in his works. Rawls own religious ideas remained hidden territory until 2009, when two documents by Rawls on religion were posthumously published. This article explores how Rawls’ early theological ideas can be recognised in his later works, specifically with regard to faith and reason, the meaning of community, and the question of merit in justice. It concludes that, despite his loss of faith, Rawls remained deeply influenced by the neo-orthodox Christianity of his student days.

    I will argue that it is possible to give a neutral or antiperfectionist legitimation for state support for religion, which I consider a perfectionist good that is not in the common interest. I will argue that state support for perfectionist goods (and thus also for religion) can, in some circumstances and under certain conditions, be allowed as a second-best option in order to guarantee an adequate range of valuable options to choose among - and this range of options is a necessary condition for autonomy. Subsequently, I will argue that the bottom line - which is also the limit - for support is a sufficient range of valuable options. Furthermore, I will argue that state support for religion is only allowed if there is a democratic consensus about the value of that particular perfectionist good. Finally, I will claim that state support for religion is only allowed under certain conditions.

    Recently the European Court of Human Rights issued its Grand Chamber judgment in the case of Fernández Martínez versus Spain. This case shows the importance of a sound and justified approach of the collective dimension of religious freedom. It is argued that a perspective from individual autonomy falls short. Instead, an account is proposed which reflects on the nature of religious collectivities, and on the proper place of the state within society. In some aspects of the said judgment, elements of such an approach can be found, while other aspects show more affinity with a contrary approach. The judgment therefore suffers from incoherence, as it is argued.
