The promises of Big Data, predictive policing and artificial intelligence hold a key position in the public debate for quite some time now. Optimists tell that it is possible to predict where criminal events will occur before they take place. This would implicate a major shift towards a crime and insecurity preventive society, feeding on our cultural longing for a secure future. Therefore we give algorithms and deep learning access to more and more aspects of our lives. But how realistic and desirable is the application of Big Data techniques in the area of security? |

In view of the recent problems arising from the decentralization of the Dutch youth care system, this article examines whether the Netherlands could learn from decentralization experiences in other countries. The author focuses on Denmark, where such decentralization took place fairly recently. In addition, elements of the organization of youth care in Germany and Norway are also discussed. It becomes clear that the Netherlands has a relatively complex system with many different organizations with overlapping tasks and powers. In the Netherlands, much attention is paid to control and risk management. In Denmark, on the other hand, there is much more confidence in the capacities of parents and children to find solutions. It is noticeable that in the vast majority of cases there is consensus between parents, child/youngster and care providers about how to deal with the problems. The most important lesson that the Netherlands can learn from abroad – and especially the Danes – is: invest in underlying values and principles and give professionals and families time, support and space. |

We analyze two citizen collectives of ‘professional city makers’ who have shaped participation in circular area development in anticipation of the Dutch Environment and Planning Act. The activities of professional city-makers form an interesting new phenomenon that requires attention as well as the implications: it is precisely through the professionalism of the city-makers’ efforts that there is a regular tension in the participation process between their role as citizen and professional in their contact with the government. We therefore discuss how the participation of professional city-makers in area development exposes different paradoxes that must be taken into account in the further implementation of the Environment and Planning Act. In short, we argue that participation in the Act is presented in a traditional way and does not fit the new role of citizens in area development in the 21st century. |

The Environment and Planning Act (EPA), which will enter into force in 2021, has been called the most influential legislative reform in the Netherlands since World War II. This article forms the introduction to a special issue devoted to the EPA, in which scholars from various disciplines reflect on the societal and legal ramifications of this new act. The authors introduce the different articles but also offer their perspective on the emergence of this new field of research. Socio-legal research into such a vast new regulatory field benefits from the application of multiple perspectives and different research methods. Conspicuously, the authors of the various articles differ on how to assess the new regulation of Dutch spatial planning. Some are pessimistic, others strike a more optimistic note. In this introduction two more perspectives on the law are offered. The perspective of prefigurative law (Davina Cooper) embodies the more optimistic view, whilst the perspective of outsourced law (Pauline Westerman) sides with the pessimists. |

In the past twenty-five years, a lot of attention is paid to a more victim-aware and restorative justice focused policy in prisons in Belgium and The Netherlands, striving for a restorative culture and climate in the institutions (among prisoners and staff) and for more restorative practices like victim-awareness programs and mediation. The focus is primarily on the prison structure and culture, striving to create a more restorative prison culture and climate in the institutions. In this article we argue for a shift from this system-focused pursuit of ‘estorative detention’ to the restorative reintegration of prisoners at the individual level, and by this supporting their desistance from crime. We present a conceptual framework for restorative reintegration in and outside prison as a strengths-based approach, with attention to the structural and individual elements that supports their desistance from crime. |

In het Albert Heijn-arrest heeft de Hoge Raad opnieuw bevestigd dat naar huidig Nederlands recht geen algemene regel geldt dat een franchisegever een (toekomstige) franchisenemer moet inlichten omtrent de te verwachten omzet of omtrent de winstverwachting. De bijzondere omstandigheden van het geval kunnen echter wel een zodanige verplichting meebrengen. De vraag rijst of in het voorontwerp van de Wet Franchise dat op 12 december 2018 werd gepubliceerd een andere benadering is gekozen. In dit voorontwerp wordt voorgesteld een – vrij ruim geformuleerde – informatieplicht voor de franchisegever te introduceren. In deze bijdrage wordt ingegaan op het Albert Heijn–arrest en wordt de uitkomst van deze procedure afgezet tegen het Nederlandse conceptwetsvoorstel en de Belgische regelgeving voor franchiseovereenkomsten. |

How does the police deal with conflict resolution and (referrals to) mediation? Is this perceived as relevant within the new national police organization? This article elaborates on work processes within the National Police, including ZSM-settlements, the punitive aspects of police culture and the impoverishment of neighborhood-oriented police work. It is concluded that there is little room within the police for responsive approaches to crime and social unsafety. However, there are still police professionals who question ‘assembly line’-processing of criminal cases, support restorative justice strategies and try to improve the citizen-empowerment in neighbourhoods. |

Terrorism could be regarded as an extreme type of (violent) criminal behaviour. Against this background, there is much to gain if criminological attention would be extended to terrorism. In this overview, the authors describe how and to what extent criminological theories may provide a significant contribution to underlying causes of terrorism. Previous criminological contributions to the field of terrorism have primarily taken a theory-extended approach, including routine activity theory, rational choice theory and strain theory. However, so far such studies lacked empirical data. Further, to this day, not much is known about the empirical applicability of other criminological theories, including desistance theories, which warrant particular attention. In order for criminology literature to contribute effectively to our understanding of terrorism and to pursue better counter-terrorism policies, empirical evidence should first be obtained. In this way, terrorism researchers, in close collaboration with criminologists, can deepen our theoretical and empirical understanding of this relatively underexplored field. |

Illegal weed cultivation is increasingly perceived as an important societal problem. Most of existing research in this area focuses on the criminal organisations active on the cannabis market and the criminal profits that are gained here. The current study however focuses on the actors at the bottom of the cannabis market – the home growers – and aims at answering the following research question: what factors influence the chance of encountering an illegal weed cultivation at a certain residential address? In this study, the risk and protecting factors are taken into consideration on both the individual level (e.g. family composition and financial position of residents) and the neighbourhood level (e.g. social cohesion, physical disorganisation, level of criminality in a certain neighbourhood). In the current study, data of 401 illegal hemp cultivation sites discovered between 2011 and 2016 in homes in Eindhoven, the Netherlands, were analysed. Data from various quantitative data sources – like municipal data (BRP and data from the Social Domain) and data from the municipal neighbourhood monitors – were combined and analysed through a multilevel logistic regression. The results suggest that the likelihood of an illegal weed cultivation site is most prominently influenced by individual factors. Being married for instance seems to decrease the risk, whereas being divorced seems to increase the risk. The housing type also turns out to be of influence. On a neighbourhood level, physical disorganisation and the presence of other hemp cultivation sites in the neighbourhood are the only predictors for hemp cultivation. The results are discussed in the light of criminological theories regarding participation in crime, using the theoretical concepts motivation, opportunity, and control. |

By the end of 2020, the European Public Prosecutor’s Office (EPPO) will be operational. The EPPO will be tasked with investigating, prosecuting and bringing to judgement criminal offences against the EU budget. The substantive competence of the EPPO could in the future be extended to terrorism and other serious cross-border crimes. This article will first describe the background, structure and competences of the future EPPO. Then the procedural guarantees will be discussed and the problem of ‘forum shopping for evidence’. This problem entails that the choice in which Member State to conduct an investigative measure could be made on the basis of the less stringent rules in that Member State regarding, for example, the right to privacy. The article will end with a proposal on how to prevent forum shopping for evidence. |
