    There is a tendency to put honour-based and domestic violence in the same box. This article examines whether this is correct or not. The perception of the two phenomena share a number of similarities: violence that often occurs in the context of the family and, in many cases, complex issues that have already been at play for some time. Furthermore, the perception is that primarily women are the victims of both domestic and honour-based violence. A big difference is that the term domestic violence refers to the social context where violence is taking place and the term honour-based refers to the motive for violent action or threats. A complicating factor is that hurt feelings of honour might provoke violence or threats in the context of the family. In research literature it is assumed that domestic violence occurs at all levels of society, which means that this phenomenon will also be encountered amongst ethnic minorities. It is striking that domestic violence amongst ethnic minorities is often mentioned in the same breath as honour-based violence. However, both phenomena deserve a different approach. The risks of treating domestic violence as an honour case and honour-based violence as domestic abuse are described.

    Honour-related physical or psychological violence, performed in reaction to perceived (threats of) loss of (family) honour, draws a lot of political and public attention in the Netherlands. A comprehensive policy-program was developed to reduce and prevent honour-related violence. However, the project knows two important restraints. In the first place, no reliable prevalence figures of honour-related violence are available. Furthermore, the program has been implemented without articulating and testing the presumed working mechanisms. In this article suggestions are made for evaluation of the program using the educational project ‘Black Tulip’ as an illustration. Black Tulip is used in secondary schools and aims at adolescent potential victims and perpetrators of honour-related violence. The main purpose is to achieve attitude and behaviour changes by means of visualizing experiences with honour-related violence in drama and film, and subsequent group discussions. Evaluation of Black Tulip and other parts of the program should take place by a combination of traditional evaluation research (e.g. with pre- and post-measurements of attitudes and behaviour in ‘Black Tulip-schools’ and in schools that do not receive the intervention), and a theory-driven evaluation which articulates the presumptions about the working mechanisms of the program and puts these to a test using the scientific literature.

    Homicides that take place in the family generally lead to shock and incomprehension in society at large. Even though in recent years the number of homicides in the Netherlands has decreased, domestic homicides still claim approximately sixty victims per year. This article aims to describe the nature and incidence of domestic homicide in the Netherlands by making use of both epidemiological data as well as detailed analyses of case reports of domestic homicides. In doing so, several types of domestic homicides are distinguished: intimate partner homicide, child homicide, parent and sibling homicide, multiple family homicide and finally, domestic homicide followed by suicide. The findings are discussed and put into perspective.

    Many public prosecutors see a link between domestic violence and violence in the public sphere. In the beginning of this century the fight against domestic violence was integrated into the national security policy of The Netherlands. The growing attention for domestic violence combined with better registration has led to an enormous grow of criminal justice cases of domestic violence. The article analyses the public prosecution policy towards domestic violence. Nowadays even without a report suspects can be brought to trial if the charges can be proved. On the one hand the public prosecution aims to lay down a standard, on the other hand perpetrators are confronted with a set of conditions forcing them to accept professional help in order to bring about a change in their behaviour and prevent recidivism. In this way an effective use of criminal justice could contribute to a reduction of domestic violence and crime in general.

    Conceptions of what ethics are about inform the expectations one has when consulting ethicians. To illustrate this Pattyn shows how two different conceptions of ethics generate two opposite expectations. One could either consider ethics as a specific disciplinary domain that can evaluate and judge decisively about a certain phenomenon on the basis of fundamental criteria, or see ethics as the study of the ways in which a phenomenon – such as restorative justice – can appear as a morally accountable praxis in a specific cultural setting or ‘situated understanding’. Pattyn argues that only the second view makes sense and discusses several types of settings and understandings in relation to various types of judicial settlement. The conclusion following from the analysis is that the ambitions of restorative justice amount to an everyday moral strategy to heal the damaged cohesion of social groups after a transgression and to offer offender and victim alike the opportunity to rehabilitate.

    In this article, an ongoing Flemish qualitative research on life histories and criminal careers of women in prison is discussed. We conducted autobiographical interviews with 40 female prisoners aged between 20 and 69 years. Considering our target group, we didn’t always succeed in conducting an autobiographical interview. In practice we often conducted a classic open in-depth interview. By means of file analysis, we reconstituted the criminal career of every interviewed woman. Thanks to the retrospective approach we could reveal a diversity of trajectories. We identified three pathways: (1) youth offenders, (2) early adult-onset offenders and (3) late adult-onset offenders. Remarkably, quite a lot of women are late starters. Three risk factors – to a greater or lesser extent – play a role in these pathways: a problematic educational situation in childhood, drugs and negative love affairs.

    Approximately a third of all probation supervision programs is imposed to young adults (18 to 25 years). Literature research shows that young adulthood can be viewed as a separate (developmental) age category. Quantitative analysis of data from the Dutch Probation Service provides some evidence for young adults being a special offender group. Some outcomes cause concerns, e.g. higher absconding rates from supervision and higher re-offending rates. The article discusses these findings and the need for a separate or customized approach as claimed by Probation Service.

    The position of patients facing forced hospitalization in a mental health clinic develops both in a soft and in a hard direction. On the one hand there is a soft current of more empathy with legal protection and on the other hand a harder current that leads to a growing number of forced measures. This involves three dilemmas. First, legal intervention touches only upon the fringe and not upon the core of psychiatric treatment. Second, the problematic relation with the criminal justice sector and third, a lack of concern for what happens after the decision of the judge. Quality based peer review has not developed well in this sector. Forced hospitalization will remain sour for the near future.


Pieter Ippel
Pieter Ippel is vanaf 2005 hoogleraar rechtsgeleerdheid bij de Roosevelt Academy in Middelburg, een Engelstalig Liberal Arts & Science College van de Universiteit Utrecht. Daarvoor was hij onder meer hoogleraar rechtstheorie in Utrecht. Hij studeerde wijsbegeerte, criminologie en Nederlands recht aan de Vrije Universiteit in Amsterdam en promoveerde daar in 1989 op een rechtssociologisch proefschrift. Hij publiceerde over uiteenlopende onderwerpen. Zijn belangrijkste boek is Modern recht en het goede leven. Over gezondheid, milieu en privacy (Den Haag: Boom Juridische uitgevers 2002).

    The last decade the wearing of face hiding clothes has come up as a rather new phenomenon in the Netherlands and surrounding countries. Although not that many people wear them, a rather wide aversion exists against this phenomenon and is directed especially against the Islamic burqa. A rather intensive public and political debat is going on concerning the allowance of those clothes. In different countries, among which the Netherlands, France and Belgium, the legislator is drafting laws which aim to forbid the wearing of these clothes. This article gives an overview of the debate on this issue in especially the aforementioned countries and reflects upon it, with a special focus on the freedom of belief and religion.

    This article aims to assess the security situation in South Africa during the FIFA World Cup by considering the crime situation and the potential for terrorism. Consideration is also given to the ability of the police and other security services to provide the required level of security without neglecting their normal law enforcement responsibilities and leaving South Africans in general more exposed to crime. A major international event such as the World Cup is an ideal facilitator for crime and a potential target for terrorist groups. South Africa does not presently face any direct terrorist threat, but given the number and diversity of participating countries, there will always be a risk. In general, however, from the evidence it would appear that the South African security services are well prepared to ensure a safe and secure World Cup.

    The contract between the administration of Rotterdam and Tariq Ramadan January ended abruptly at august the 18th 2009 because of his connection with the Iranian satellite channel PressTV. Ramadans assignment in Rotterdam was challenged from the beginning and the accusation of cooperating with an oppressive regime overruled the voices that wanted him to stay. Bottom line of the ongoing dissension was the charge on Ramadan that his object was the islamization of Europe that would cause Western achievements like freedom and democracy to perish. The municipal government was blamed for offering him the stage and the facilities. The controversies were not limited to Rotterdam but also reported on by national and international media.In this article we will highlight the role of the Town Hall in the early end of the commitment of Tariq Ramadan in Rotterdam.

Drs. N. van Zessen studeerde Musicologie aan de Universiteit van Utrecht (1988) en volgt momenteel de master Religie en beleid aan de Faculteit der Religiewetenschappen van de Radboud Universiteit Nijmegen. Zij was van oktober 2008 tot juni 2009 verbonden aan de Directie Beleid van de Bestuursdienst van de gemeente Rotterdam in het kader van een onderzoek naar religie en lokale overheid. Zij maakte deel uit van de commissie die de gemeente Rotterdam in maart 2009 instelde om de beschuldigingen aan het adres van Tariq Ramadan te onderzoeken.

    Since the last years there is extensive ongoing debate in Belgium about jury trials at the Assize Court. These trials are an example of direct participation of citizens in the criminal justice system. Hence this jury has obtained a special position in the Belgian administration of justice. Jury deliberations behind closed doors and the isolation of jury members from the outside world contribute to the fascination for this legal phenomenon. The element of secrecy also explains why there is so little empirical research on the jury’s functioning and the jurors’ experiences during the process. By means of interviews with former jury members, we studied the influence of lay participation in a jury trial on their views and confidence in jury decision making. We found that a positive evaluation of participation in a jury may strengthen their involvement with and trust in jury decision making. However, our research also reveals that jury trials may lead to some unacceptable deficits in the proceedings and outcome of the process. These results are contextualised in the broader debate about the jury and the demand for reform of the assize court proceedings.
