Het grondrecht op collectief onderhandelen van zelfstandigen versus het Europese mededingingsrecht

    In dit artikel staat centraal dat de beperking van de door het Hof van Justitie geformuleerde ‘cao-exceptie’ op het Europese mededingingsrecht tot ‘werknemers’ en ‘schijnzelfstandigen’ zich moeilijk tot een grondrechtenbenadering lijkt te verhouden. Zelfstandigen met een zwakke arbeidsmarktpositie hebben namelijk evenzeer behoefte aan collectieve middelen om hun arbeidsvoorwaarden te verbeteren en vallen ook onder grondrechtenverdragen. Door een uitgebreide beschouwing van de relevante rechtsinstrumenten van de VN, de IAO en de Raad van Europa en de uitleg die de toezichtorganen hieraan geven blijkt dat het grondrecht op vrijheid van (vak)vereniging, collectief onderhandelen en collectieve actie evenzeer aan deze groep lijkt toe te komen, en een te rigoureuze inperking vanwege het mededingingsrecht niet gerechtvaardigd wordt geacht. De conclusie bevat enkele gedachten over hoe het Europese mededingingsrecht met een grondrechtenbenadering overeenstemming te brengen. Daarbij passeren zowel de recente ontwikkelingen rondom het zelfstandigenvraagstuk in Nederland als initiatieven op Europees niveau de revue.

    Het Hof van Justitie van de Europese Unie heeft baanbrekende uitspraken gedaan, vooral als gevolg van prejudiciële vragen van nationale rechters op grond van art. 267 VWEU. Het zijn vooral niet-verwijzingsplichtige lagere rechters geweest die voor deze aanvoer hebben gezorgd. Dit artikel onderzoekt hoe dit kan worden verklaard en kijkt naar de motieven van Nederlandse lagere rechters om al dan niet prejudiciële vragen te stellen aan het HvJ. Het doet dit op basis van interviews met 22 rechters en een uitgebreide juridische analyse van uitspraken. Dit artikel toont aan dat met name pragmatische en praktische overwegingen een rol spelen bij het besluit om te verwijzen. Daarnaast laat dit artikel zien dat er meer verschillen zijn binnen een lidstaat dan tussen lidstaten onderling, met name tussen gerechtelijke instanties en individuele rechters.

    The Court of Justice of the European Union has rendered landmark cases, especially following references for a preliminary ruling from national courts on the basis of Art. 267 TFEU. Primarily lower courts that are not obliged to refer have been responsible for such cases. This article examines how these references of lower courts can be explained by focusing on the motives of the Dutch lower court judges to refer, or not to refer. It does so on the basis of interviews with 22 judges and an extensive legal analysis of judgments. This article shows that practical and pragmatic considerations play an important role in the court’s decision to refer. In addition, there are more differences within one Member States than between EU Member States, especially between particular courts and individual judges.

    Following a retrospective of the road towards the Convention, incorporating some Singaporean inside views, the authors provide a detailed analysis of the envisaged grounds for refusal of mediated settlements. The authors also highlight various issues around the very concept, and proof, of mediation. These issues are fundamental, as only settlements ensuing from mediation are covered. Another significant aspect is the absence of any provisions pertaining to the status of agreements to mediate, the contract situated at the entry side of mediation.

    More than sixty years after the adoption of the New York Convention, UNCITRAL finalised at its annual session, in July 2018, an instrument akin to the New York Convention in the area of mediation: the United Nations Convention on International Settlement Agreements Resulting from Mediation (‘the Singapore Convention on Mediation’ or ‘the Convention’), which was adopted by the United Nations General Assembly on 20 December 2018. In addition, UNCITRAL adopted the UNCITRAL Model Law on International Commercial Mediation and International Settlement Agreements Resulting from Mediation, (2018, amending the Model Law on International Commercial Conciliation (2002); ‘the revised Model Law’).
    This contribution gives an overview of these two texts and their drafting process, starting with an overview of the works done by UNCITRAL over the past decades in the field of international mediation.

    The maxim ‘law in books and law in action’ relays an implicit dichotomy, and though the constitutive nature of law is nowadays commonly professed, the reflex remains to use law in books as an autonomous starting point. Law however, it is argued in this article, has a storyline that commences before its institutional formalisation. Law as ‘a continuous process of becoming’ encompasses both law in books and law in action, and law in action encompasses timelines both before and after the formal coming about of law. To fully understand law, it is necessary to understand the entire storyline of law. Qualitative studies in law and society are well equipped to offer valuable insights on the facets of law outside the books. The insights are not additional to doctrinal understanding, but part and parcel of it. To illustrate this, an ethnographic case study of local bylaws regulating an ethnically diverse public space of everyday life is expanded upon. The case study is used to demonstrate the insights qualitative data yields with regard to the dynamics in which law comes about, and how these dynamics continue for law in action after law has made the books. This particular case study moreover exemplifies how law is one of many truths in the context in which it operates, and how formalised law is reflective of the power constellations that have brought it forth.

    Studies have shown that the effects of scientific research on law and policy making are often fairly limited. Different reasons can be given for this: scientists are better at falsifying hypothesis than at predicting the future, the outcomes of academic research and empirical evidence can be inconclusive or even contradictory, the timing of the legislative cycle and the production of research show mismatches, there can be clashes between the political rationality and the economic or scientific rationality in the law making process et cetera. There is one ‘wicked’ methodological problem, though, that affects all regulatory policy making, namely: the ‘jump’ from empirical facts (e.g. there are too few organ donors in the Netherlands and the voluntary registration system is not working) to normative recommendations of what the law should regulate (e.g. we need to change the default rule so that everybody in principle becomes an organ donor unless one opts out). We are interested in how this translation process takes place and whether it could make a difference if the empirical research on which legislative drafts are build is more quantitative type of research or more qualitative. That is why we have selected two cases in which either type of research played a role during the drafting phase. We use the lens of the proportionality principle in order to see how empirical data and scientific evidence are used by legislative drafters to justify normative choices in the design of new laws.

Promoting Conciliation and Mediation in Collective Labour Conflicts in Europe

    On 23 April 2018, the Belgian Ministry of Labour, together with a consortium of 12 European research institutes, held a symposium on the current state of the art and best practices for conciliation and mediation in collective labour conflicts within the European Union, and particularly in Belgium. The symposium was organized for two occasions. First, the 50st anniversary of the Belgium law, providing mediation services by the Ministry of Labour to prevent and mediate in collective labour conflicts. Second, the presentation of the results of an EU (DG Employment, Social Affairs and Inclusion) sponsored project in 12 EU member states.
    The management of collective labour conflicts is in all countries regulated differently. The study shows that also practices of third party intervention differ largely. Most countries differentiate conciliation (a relative informal process of facilitated negotiation), mediation (usually defined as a strong involvement of the third party, who gives recommendations to the parties), and arbitration. Mediators typically are not trained, certified or registered as mediators in most countries. In all countries there is a large potential for conciliation, particularly in early stages of conflict (preventive mediation), as well as in rebuilding of trust after conflict episodes. Ana Belén García is senior researcher at the University of Seville and KU Leuven, working in the departments of work and organizational psychology. She was coordinator of several EU funded research programs on social dialogue in organisations. The most recent project was on mediation in collective labor conflicts in 12 EU member states. Ana’s interest is on conflict management and mediation in organizations. She was editor of two handbooks in the Springer Series ‘Industrial relations and conflict management’. Ana holds a PhD in Psychology and HRM from the University of Seville and KU Leuven. She is also a registered mediator.

Erica Pender
Erica Pender is a mediator and senior researcher at the University of Seville and KU Leuven in the department of Work and Organizational Psychology. She holds a PhD in Psychology from the University of Seville and KU Leuven focusing on trust and trustworthiness in organizations. After studying psychology at the University of Seville, she obtained her MSc at Maastricht University. She has coordinated two large-scale projects for the European Commission, and was co-editor of two handbooks in the Springer Series ‘Industrial relations and conflict management’.

Francisco J. Medina
Fransisco J. Medina is professor in social and organizational psychology, and Dean of the Faculty of Psychology and Educational sciences, at the University of Seville, Spain. His interests are conflict management, mediation and organizational development. He is engaged for many years in the development of labor mediation in Spain, providing training for mediators. He is also an experienced consultant and mediator. Francisco published both internationally and in Spanish extensively on conflict management and mediation.

Martin Euwema
Martin Euwema is professor in organizational psychology, and chair of the research group Organizational and Occupational Psychology and Professional Learning at KU Leuven, Belgium. He is also co-director of the Leuven Center for Collaborative Management and visiting professor at University of Copenhagen, IESEG-Paris, Sevilla, and Tsinghua (Beijing). He has extensive experience as consultant and mediator for both profit and non-profit organizations. His fields of expertise are conflict management, mediation, leadership, and organizational and team development.

    The Court of Appeal has overruled the recent Employment Appeal Tribunal (EAT) decision in Efobi – v – Royal Mail [2017] IRLR 956 (reported in EELC 2017/41), restoring the previous position that a claimant in a discrimination case has the initial burden of proof – which ‘shifts’ to the respondent to provide an explanation of why its conduct was non-discriminatory if a prima facie case is proven.
    The Court of Appeal disagreed with Mrs Justice Elisabeth Laing’s ruling in Efobi, that section136 of the Equality Act 2010 had made a substantial change to the law when it was introduced, on the basis that it could not be fair that a respondent should have to discharge the burden of proof without the claimant first showing that there is a case to be answered. Lord Singh ruled that it could not have been Parliament’s intention to remove this initial burden of proof when it enacted the Equality Act.
