    The ‘fear of crime’ is a buzzword among citizens, media, politicians and professionals by now. But the phenomenon seems to be as intangible as it is important. The struggle of professionals with this concept is the result of a too wide and self-evident problem definition. This article contains an alternative approach. The focus is on disturbed fear of crime: a negatively changed and problematically experienced fear of crime on the level of the neighborhood.
    Through a review of the literature and previous research, we work towards this concept and apply it to the neighborhood of Kerckebosch in the municipality of Zeist in the Netherlands. As during 2014 the local quantitative indicators for ‘the fear of crime’ rose from 7% of the local population indicating to ‘sometimes feel unsafe’ to 22%, while the rest of the municipality remained quite stable. Additionally, several local professionals received complaints of multiple local inhabitants claiming to ‘feel unsafe’ in the neighborhood. Our research question was: What explanations for their ‘disturbed fear of crime’ do local inhabitants of the neighborhood Kerckebosch give?
    It was highly plausible that this local rise of the fear in Kerckebosch was connected to the social re-engineering of the neighborhood, but the exact nature of the quantitative rise was unclear. Therefore, we have interviewed 25 local inhabitants. Qualitative analyses showed the local rise of ‘the fear of crime’ to be the result of: (I) physical characteristics of the neighborhood; (II) events of burglary and intimidation from the past; (III) the presence of loitering youths and – primarily – (VI) a backlash of social integration as a side effect of the social re-engineering of the neighborhood. These qualitative explanations to the observed quantitative discontinuity led to several policy advises, which were based on international effect studies.

    The central question in this article is whether an empirical-legal approach of victimhood and victim rights could offer a sufficient basis for proposals of legal reform of the legal system. In this article, we choose a normative-critical approach and raise some objections to the way in which part of such research is currently taking place in the Netherlands, on the basis of two examples of research in this field, one dealing with compelled apologies as a possible remedy within civil procedural law and the other with the victim’s right to be heard within the criminal legal procedure. In both cases, we argue, the strong focus on the measurable needs of victims can lead to a relatively instrumental view of the legal system. The legal system must then increasingly be tailored to the wishes and needs of victims. Within this legal-empirical, victim-oriented approach, there is little regard for the general normative principles of our present legal system, in which an equal and respectful treatment of each human being as a free and responsible legal subject is a central value. We argue that results of empirical-legal research should not too easily or too quickly be translated into proposals for legal reform, but first become part of a hermeneutical discussion about norms and legal principles, specific to the normative quality of legal science itself.

    For liberals religion is a private matter. This does not mean that a citizen should leave his or her religion at home. It does mean that laws and public services should not be determined by religious beliefs. The article describes how liberals have looked upon religion in their programs of principles since mid 19th century. The educational arrangement in the Netherlands of 1917, favouring religious schools, did not satisfy them. What were the liberal proposals in order to safeguard the religiously neutral, publicly-maintained schools?

    This article focuses on the experiences that authors gained during a study trip to Japan. In general terms, the main features of Japanese criminal law are being observed. This system resembles the letter of Dutch criminal law, but in practice it appears to differ greatly. Among other things, attention is paid to the strong position of the prosecutor’s office, the high conviction rate, the limited contradictory nature of the criminal procedure, and the relative strong position of the victim. Subsequently, attention is given to some recent reforms, including the democratization of criminal law. Also, authors describe a visit to the Fuchu-prison. This article concludes with the question to what extent we could learn something from the Japanese practice in the Netherlands.

    Door de Wkkgz vindt de buitengerechtelijke afwikkeling van medische schadeclaims plaats in het klachtrecht in plaats van het aansprakelijkheidsrecht. Zorgaanbieders moeten zelf proactief en oplossingsgericht schadeclaims onderzoeken en beoordelen. De rol van de patiëntencontactpersoon in het ziekenhuis, van de zorgverlener en de samenwerking tussen ziekenhuis en verzekeraar zijn daarmee ingrijpend veranderd. Dit overzichtsartikel bespreekt de eerste stappen naar implementatie van de Wkkgz, de aard van het klachtrecht, de noodzaak van triage, de werkwijzen van zelfregelende ziekenhuizen, de noodzaak van informed consent, BGK , de zeswekentermijn, de eerste resultaten van de Wkkgz-geschilleninstanties, en het wetsvoorstel tot wijziging van de Wet BIG.

    In this contribution, the justification of restorative practices in prison is first discussed from a normative perspective. On the basis of Lippke’s retributive theory of imprisonment it is argued that modern, humane retributive sanctioning entails an obligation to provide prisoners with opportunities to engage in restorative practices. Second, restorative practices in prison are examined from the perspective of possible impacts on the empowerment of prisoners and their experience to move away from crime and do good. Finally, it is argued that in order to yield positive effects, restorative practices in prison need to be supported by a safe and healthy living environment.

    The Dutch Custodial Institutions Agency (DJI) strives for a more restorative prison culture in the Netherlands, incorporating a more victim-oriented and restorative way of working in prisons. To this end, DJI has asked for a plan and process evaluation of three restorative courses among (juvenile and adult) prisoners in the Netherlands: Puinruimen, SOS and DAPPER. This article first offers an overview of the most important findings of this evaluation which was finalized in 2016. Based on the findings of the plan evaluation, a cautious yet clearly positive picture emerges of the design and substantiation of each of the three courses examined. That is, an extensive description and substantiation exists of each course. In addition, evidence exists in the (limited) scientific literature for one of the goals that each of these courses have formulated: to increase prisoners’ awareness of the consequences of crime for victims. The literature also suggests that creating trust among participants and a safe group process during the course is helpful in attaining the goals formulated. The process evaluation of the execution of the three courses in practice further strengthens the cautious, yet positive picture painted by the plan evaluation. An examination of the experiences of the courses’ participants lends further support to the observation that these courses can attain part of their goals. For example, after the course participants were more positive about the added value of victim-offender mediation for them personally than before.
    Aside from these findings, this article also argues for a deeper consideration of the constructive roles that both emotions guilt and shame can play in the restorative process of prisoners during these courses. The article ends with a number of recommendations for restorative courses in prison and a sketch of the current state of affairs in the Netherlands regarding these courses.

    In this article, we try to answer the question of how and why the stories of the victims of attacks by the guerrilla movements in the 1970s in Argentina are currently silenced in the public sphere. We analyse how this collective denial is negotiated in human rights discourse.     In 2015, South-Korea and Japan came to a ‘final’ agreement concerning the ‘comfort women’ issue. This contribution reveals that this deal signals the next stage in a process of denial through which Japanese authorities have structurally denied the women’s’ victimhood. Taking a discourse analytical approach, the contribution investigates this historical process of denial and its implications. The analysis shows that denial takes several forms and performs different functions throughout the process. It demonstrates that denial is an interactional phenomenon, has different psychologies underlying it, and that it operates on different levels. Denial ultimately contributes to a state of continued victimization.

    The probation service gives advice to the court tens of thousands of time each year, coordinates tens of thousands of community service orders, and supervises tens of thousands of offenders. This is done professionally and takes place without much incidents or problems. However, the probation is not very well known to the general public. The identity of probation is also ambiguous and therefore not strong. There is less appreciation for the probation than they deserve. This can be met by making the probation service responsible for the implementation of all community-based sanctions (suspended sentences and other conditional modalities and community service orders), similar to the responsibility of the prison system for custodial sanctions and measures. Secondly, by differentiation in the nature and intensity of activities. Many probation clients do well. They represent only a low risk, and probation involvement may be limited. For other clients, more is needed: more activities, greater intensity and focus on criminogenic needs. It is proposed to distinguish between probation and probation plus. In both, probation supervision and community service are at the center, but the plus version is emphatically more focused on rehabilitation and reintegration, and thus on minimizing recidivism. This requires more efforts by the probation service. It also requires adapting the organization: one probation organization that is accountable and responsible for the implementation of community-based sanctions, but with the possibility to outsource work if special expertise and special activities are required.
