The ‘fear of crime’ is a buzzword among citizens, media, politicians and professionals by now. But the phenomenon seems to be as intangible as it is important. The struggle of professionals with this concept is the result of a too wide and self-evident problem definition. This article contains an alternative approach. The focus is on disturbed fear of crime: a negatively changed and problematically experienced fear of crime on the level of the neighborhood. |

Urban nightlife areas are widely renowned for their emotionally charged nature, affording greater opportunities for transgressions of social norms compared to daytime contexts. Yet, the ways nightlife consumers experience safety in the public spaces of nightlife areas has received limited attention in the academic literatures. This article approaches experienced safety in the public spaces of nightlife areas as emerging from encounters between human and non-human (material, social, cultural) elements grounded in time and space. Such elements include the characteristics of the built environment, the design of public space, police presence, lighting and also first and secondhand experiences and popular media discourses more generally. We hypothesized that encounters between such elements necessarily renders some ambiguity in experienced safety, in the sense that the effect of a particular element on experienced safety is always coproduced in the unfolding encounter. By drawing on a series of interviews with Dutch students in Utrecht, various types of ambiguity are shown to exist depending on both the particularities of the situation at hand and based on differences between individual circumstance and life course. Ambiguity is also shown to exist in the sense that mentioned elements may both comfort and alarm participants at the same time. Our findings infer that we should implement ‘safer nightlife’ initiatives that are tailored to particular contexts, situations and publics. The results also suggest that current interventions seeking to stimulate safety in urban nightlife settings might not be as successful in reducing/enhancing (un)safety as (popular) policy and media discourses have suggested. |

The global financial crisis of 2008 and the following public uproar over offshore tax evasion and corporate aggressive tax planning scandals gave rise to unprecedented international cooperation on tax information exchange and coordination on corporate tax reforms. At the behest of the G20, the OECD developed a comprehensive package of ‘consensus-based’ policy reform measures aimed to curb base erosion and profit shifting (BEPS) by multinationals and to restore fairness and coherence to the international tax system. The legitimacy of the OECD/G20 BEPS Project, however, has been widely challenged. This paper explores the validity of the legitimacy concerns raised by the various stakeholders regarding the OECD/G20 BEPS Project. |

The Global Forum on transparency and exchange of information for tax purposes has undertaken peer reviews on the implementation of the global standard of exchange of information on request, both from the perspective of formalities available and from the perspective of actual implementation. In the review reports Global Forum advises jurisdictions on required amendments of regulations and practices. With these advices, the Global Forum exercises regulatory authority. The article assesses the legitimacy of the exercise of such authority by the Global Forum and concludes that the exercise of such authority is not legitimate for the reason that the rule of law is abused by preventing jurisdictions to adhere to due process rules. |

This article focuses on mobile organized criminal groups that travel through Europe and commit a broad range of property crimes. The study aims to explore the perspective of individual group members. Information was gathered from fifteen criminal investigations that were carried out in the Netherlands in recent years (2013-2016). The study shows that members of these crime groups view their criminal activities primarily as ‘work’. It is work that is characterized by conflicts and consensus. Conflicts often have to do with the stolen loot and reveal disagreement about leadership, rules and obedience. Rows and threats of violence go along with feelings of fear and distrust. At the same time gang members belong to an international deviant community with a shared common way of life and feelings of togetherness. Performing within this international community gives the possibility to attain social status and to express success and richness. These contractive emotions and symbolic meanings characterize the everyday life of gang members and motivates their daily practices. |

This study contains a qualitative framing analysis of outlaw motor clubs in Dutch newspaper articles. These clubs appear in the news as a source for positive framing to counterbalance the prevailing organized crime frame. The study shows with what rhetorical means club members are framed and how news media balance a criminal and a non-criminal image. In news articles club members refer to ethical norms and group values, and appear to employ mitigation strategies which take the hard edges off the frame and simultaneously increase their credibility. |

But in the impressive body of literature on both types of crime and as seen by specialists from the Dutch National Police, some indications can be found that there is a toxic relationship between the two forms of delinquency: human traffickers can call on the family-honour of their victims in order to blackmail them into prostitution and to keep them working in that field against their will. |

The theory of retribution is a central tenet in Malawian sentencing jurisprudence. Courts have given expression to retribution in various ways, most conspicuously through the recognition of the principle of proportionality as the most important principle in sentencing. Retribution has permeated courts’ consideration of certain sentencing factors such as the seriousness of the offence, family obligations and public opinion. Overall, retribution rightly plays a pivotal role in Malawian sentencing jurisprudence by elevating the principle of proportionality to the most important principle in sentencing. Malawian courts have also noted that whether in pursuit of retribution or utilitarianism, the ultimate objective is to arrive at a sentence that is just and fair in relation to the crime and the offender. This also ensures that the sentence imposed does not offend the prohibition of cruel, inhuman and degrading punishment. |

The Statute of the International Court of Justice stipulates that judges shall exercise their powers impartially. We question the practicability of this statement and examine whether the voting pattern of the judges are biased. In this light, empirical research is conducted on cases adjudicated from 2005 to 2016. We find strong evidence that (1) judges favour their home States or appointing States; and (2) judges favour States that speak same majority language with their home States. |

The extensive interpretation of criminal law to the detriment of the defendant in criminal law is often problematized in doctrinal theory. Extensive interpretation is then argued to be problematic in the light of important ideals such as democracy and legal certainty in criminal law. In the Dutch discussion of this issue, Klaas Rozemond has argued that sometimes extensive interpretation is mandated by the rule of law in order to protect the rights of victims. Rozemond grounds his argument on a reading of Dworkin’s distinction between the rule-book and the rights conception of the rule of law. In this article, I argue that Dworkin’s rights conception, properly considered, does not necessarily mandate the imposition of criminal law or its extensive interpretation in court in order to protect victims’ rights. |

Drawing on material from her extensive study of Russian organized crime, the author sketches a portrait of Semjon Mogilevitsj. This Russian ‘godfather’ enjoys the reputation of being the smartest and highest educated mafia boss worldwide. Indeed Mogilevitsj obtained a master’s degree in Economics with good results, but this alone doesn’t explain his phenomenal successes in criminal as well as in legal business. Describing the steady expansion of his criminal activities from Russia into Israel, the United States, Eastern Europa, Italy and Canada, the author suggests that the social and economic circumstances in Russia just before and during the collapse of the Soviet Union might have served as an ideal playing ground for Mogilevitsj to develop the specific social intelligence and skills needed to successfully run a criminal organization. |

Comparative methodology is an important and a widely used method in the legal literature. This method is important inter alia to search for alternative national rules and acquire a deeper understanding of a country’s law. According to a survey of over 500 Dutch legal scholars, 61 per cent conducts comparative research (in some form). However, the methodological application of comparative research generally leaves much to be desired. This is particularly true when it comes to case selection. This applies in particular to conceptual and dogmatic research questions, possibly also allowing causal explanations for differences between countries. This article suggests that the use of an interdisciplinary research design could be helpful, and Hofstede’s cultural-psychological dimensions can offer a solution to improve the methodology of selection criteria. |

Every year there are some 130 cases of victimization dating fraud in the Netherlands. On average the victims lose more than 19.000 euros in this scam. With dating fraud a person on the internet pretends to be someone else and begins a love affair with the victim with the aim to make as much money off the victim as possible. This is a form of Nigerian fraud. In this article is described how this dating fraud is being done. Dating fraud is highly organized with highly educated offenders. Victims come from all layers of society, but according tot he Fraud Helpdesk midddle-aged women who are lonely, have a christian background and work in care, loose the largest amounts. The impact on the victims is huge: the emotional damage is even bigger than the fiancial loss. To reduce dating fraud it is necessary to pay more attention tot his form of fraud. |

Amsterdam is a popular destination for tourists. The number of tourists visiting Amsterdam increases every year and is expected to hit 23 million by 2025. This article describes which implications increasing tourism has on security and crime in Amsterdam. It appears that increasing tourism has a negative effect on social cohesion and can be a serious threat to safety. Tourism also attracts crime. Tourists are far more likely to suffer from crimes than inhabitants of Amsterdam. In particular they become victims of crimes like pickpocketing, mugging and scams. Tourists are also often associated with drug- and alcohol-related incidents. Apart from being a victim, a tourist can also be a perpetrator of crime. Inhabitants of Amsterdam regularly complain about nuisance caused by tourists. Especially subletted apartments via Airbnb is a serious concern for residents of Amsterdam and local policymakers. |
