Trefwoorden Fuller, Arendt, legal subject, juridical person, public rule of law theory

SamenvattingAuteursinformatie

The ‘public’ character of the kind of rule of law theorizing with which Lon Fuller was engaged is signalled especially in his attention to the very notion of being a ’legal subject’ at all. This point is central to the aim of this paper to explore the animating commitments, of substance and method alike, of a particular direction of legal theorizing: one which commences its inquiry from an assessment of conditions of personhood within a public legal frame. Opening up this inquiry to resources beyond Fuller, the paper makes a novel move in its consideration of how the political theorist Hannah Arendt’s reflections on the ‘juridical person’ might aid a legal theoretical enterprise of this kind.

Restorative Transformative Learning en Partnergeweld

Van ‘herstellen’ naar ‘herstellend transformeren’

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 4 2014
Trefwoorden intimate partner violence, restorative justice, transformative learning, meaning perspectives, restorative transformative learning
Auteurs Dana Weistra en Anthony Pemberton
SamenvattingAuteursinformatie

Many articles have dealt with the question why restorative justice in cases of intimate partner violence (IPV) may or may not be appropriate. Seeing however as a punitive approach towards IPV is rapidly losing popularity as an effective way of dealing with this complex type of violence, as well as the outcomes of a recent study by the European Agency for Fundamental Rights (2014) – where 25% of the Dutch women that were surveyed indicated they had experienced violence by an intimate partner – restorative justice may be a promising alternative after all.
Instead of adding to the debate, the current article focuses on how restorative justice can be constructed to be appropriate for IPV cases, and is explorative in nature. In order to do so, the theory behind transformative learning is combined with restorative justice practices, shifting the focus from ‘restoration’ to ‘restorative transformation’. Such a restorative transformative learning approach focuses on transforming violent meaning perspectives that dictate the use or toleration of violence. Instead of trying to restore the individual back to the state they were in before the violence took place – as ‘restoration’ traditionally implies – the goal of restorative transformative learning is to restore the individual back to a state before a violent meaning perspective was acquired. The transformation of violent meaning perspectives is therefore the prerequisite for restoration.
The method that is introduced in this article offers a practical framework and guidelines to achieve such a transformation. It answers to the complexity of IPV cases by focusing on the entire family system, while leaving room for individual restoration. In doing so, restorative transformative learning may possibly open the way to the acceptance of restorative justice in the field of IPV.

Kinderpornorechercheurs en hun mentale weerbaarheid

Hoe rechercheurs de impact van kinderpornografiezaken ervaren en daarmee omgaan

Tijdschrift Tijdschrift voor Criminologie, Aflevering 4 2014
Auteurs Drs. Henk Sollie, Dr. Nicolien Kop en Prof. dr. Martin Euwema
SamenvattingAuteursinformatie

Eleven Teams against Child Abuse Images and Transnational Child Sex Offences (TBKKs) are operating within the Dutch National Police Force. This study provides an in-depth analysis of the resilience of criminal investigators working in these teams and how they perceive and cope with daily work stressors. Observational studies within five TBKKs and 35 semi-structured interviews with child pornography investigators revealed that managing their heavy caseloads, classifying abusive images, dealing with suspects and conducting home searches can sometimes be (very) challenging. Despite these demanding work aspects, investigators experience low levels of stress. By employing emotional detachment, self-reflection, workload regulation, social support and meaningfulness, they overcome the stress of investigating internet child exploitation. However, successful implementation of these resilience-enhancing strategies depends on the availability of several individual and organizational resources. To reduce the risk of health problems and to stimulate positive functioning, these resources require permanent investment from police management and investigators themselves.

The Challenge of Empirical Method to Labour Law Theory and Practice

Tijdschrift Arbeidsrechtelijke Annotaties, Aflevering 3 2014
Trefwoorden Empirical research, Shaping of labour law, Methodology
Auteurs Simon F. Deakin
SamenvattingAuteursinformatie

The aim of the paper is to consider the significance for labour law theory and practice of empirical research into the operation and effects of this branch of law. It will be argued that empirical research has an important role to play in the methodology of labour law, even if it is ancillary, much of the time, to doctrinal approaches. Secondly, and relatedly, the paper will address the historical role of empirical research in the shaping of labour law as a field distinct from both private law and public law, and, in particular, as transcending the categories of property and contract that were inherited from the individualist private law of the nineteenth century. The third and last theme of the paper is that of the role of empirical research in addressing contemporary issues of labour law doctrine and policy.

Jihadgang naar Syrië: een wetenschappelijke benadering

Tijdschrift Tijdschrift voor Veiligheid, Aflevering 4 2014
Trefwoorden Jihad, Foreign fighters, Syria, radicalisation
Auteurs Nick Platje Msc
SamenvattingAuteursinformatie

This article describes a qualitative inquiry into Dutch people going to Syria for participating in Jihad. The inquiry compares theoretical findings with empirical facts, based on a content analysis and a document analysis, completed with ten depth-interviews. The results show that a combination of scientific findings on radicalisation and foreign fighters explains the jihad movement to Syria partly. The results also show that some factors, which have not recently be examined scientificly, are crucial for the character and extent of the movement towards Jihad.

In the summer of 2014 a book was published at the request of a group of the Church of England’s bishops. It aims to develop strong theological foundations for understanding social engagement as integral to the churches’ theology and spirituality. In doing so it takes, among others, it’s cue predominantly from Catholic Social Teaching. This article provides a review of the book and indicates some important lessons that can be learned from the book for the work of the Dutch Christian-social movement.

The government’s roles in transnational forest governance

Tijdschrift Recht der Werkelijkheid, Aflevering 3 2014
Trefwoorden transnational governance, forest certification, legality verification, emerging economies, public-private interaction
Auteurs Liu Jing
SamenvattingAuteursinformatie

Forest certification schemes and the legality regime are two main methods of transnational forest governance. A recent review of the literature has revealed that the government and forest certification are often intertwined. Based on that review, this contribution argues that governments play divergent roles in forest certification schemes in different aspects of the regulatory process: namely, agenda and standard setting, implementation, monitoring, and enforcement. In most FSC schemes, governments in developed countries play a less active role in most of these aspects than they do in context-based industry-dominated schemes. In the three emerging economies examined – Indonesia, Brazil, and China – the government sometimes plays a more active role in context-based, industry-dominated schemes than it does in developed countries. The rising legality regime might further strengthen the role of the government in forest governance in these emerging economies. Moreover, China may exemplify the fact that forest governance is entering a new phase, because the country not only exports to countries demanding legal verification, but also imports from countries where the risk of illegal logging is high. This illustrates that the role of governments in forest governance is constantly evolving.

The need for an integrated comparison of the effectiveness of international sustainable forestry, coffee and cocoa initiatives

Tijdschrift Recht der Werkelijkheid, Aflevering 3 2014
Trefwoorden effectiveness, private sustainability standards, certification, FSC, UTZ Certified
Auteurs Martijn Scheltema
SamenvattingAuteursinformatie

To date the effectiveness of private sustainability standards has been assessed from different angles which attribute different meanings to effectiveness. This contribution compares the effectiveness of two international certification initiatives (i.e. sustainable forestry (Forest Stewardship Council, FSC) and sustainable coffee and cacoa (UTZ Certified)) from three different angles (legal, impact, acceptance/legitimacy/governance). Based on publicly available data, it is shown that FSC scores better on some dimensions of these three angles (e.g. enforcement, cost and price premium, and government acceptance), while UTZ Certified scores better on others (e.g. verifiable evaluation criteria, regular evaluation, innovation). Hence, this analysis shows that a comparative evaluation of both initiatives would have been biased if it would have been based on a single angle approach. There is all the more reason to use such an integrated approach, since the different angles are intertwined. Therefore, it has been established that in order to establish the effectiveness of private certification initiatives an integrated approach is needed which combines different angles. This contribution shows such an approach is feasible.

Access_open Unexpected Circumstances arising from World War I and its Aftermath: ‘Open’ versus ‘Closed’ Legal Systems

Tijdschrift Erasmus Law Review, Aflevering 2 2014
Trefwoorden First World War, law of obligations, unforeseen circumstances, force majeure, frustration of contracts
Auteurs Janwillem Oosterhuis Ph.D.
SamenvattingAuteursinformatie

European jurisdictions can be distinguished in ‘open’ and ‘closed’ legal systems in respect of their approach to unexpected circumstances occurring in contractual relations. In this article, it will be argued that this distinction can be related to the judiciary’s reaction in certain countries to the economic consequences of World War I. The first point to be highlighted will be the rather strict approach to unexpected circumstances in contract law that many jurisdictions had before the war – including England, France, Germany, and the Netherlands. Secondly, the judicial approach in England, France, Germany, and the Netherlands to unexpected circumstances arising from the war will be briefly analysed. It will appear that all of the aforementioned jurisdictions remained ‘closed’. Subsequently, the reaction of the judiciary in these jurisdictions to the economic circumstances in the aftermath of the war, (hyper)inflation in particular, will be analysed. Germany, which experienced hyperinflation in the immediate aftermath of the war, developed an ‘open’ system, using the doctrine of the Wegfall der Geschäftsgrundlage. In the Netherlands, this experience failed to have an impact: indeed, in judicial practice the Netherlands appears to have a ‘closed’ legal system nevertheless, save for an ‘exceptional’ remedy in the new Dutch Civil Code, Article 6:258 of the Burgerlijk Wetboek (1992). In conclusion, the hypothesis is put forward that generally only in jurisdictions that have experienced exceptional economic upheaval, such as the hyperinflation in the wake of World War I, ‘exceptional’ remedies addressing unexpected circumstances can have a lasting effect on the legal system.

Auteurs Anouk Bosma MSc, Dr. Maarten Kunst, Dr. Anja Dirkzwager e.a.
SamenvattingAuteursinformatie

The current study examined the extent to which risk factors and treatment readiness were related to prison based treatment engagement (i.e. participation and completion), using a large sample of detainees who were a candidate for the Prevention of Recidivism program. Analyses showed that offenders who were treatment ready were over two times more likely to complete treatment programs, compared to offenders who were not. Risk factors did, for the most part, not correlate with treatment participation and completion. Outcomes underlined the importance of motivational aspects and showed the significance of enhancing treatment readiness amongst correctional resocialisation participants.

The Use of Mediation in Tax Disputes – UK Position

Tijdschrift Nederlands-Vlaams tijdschrift voor mediation en conflictmanagement, Aflevering 3 2014
Trefwoorden mediation, Tax disputes, HMRC, international arena
Auteurs Peter Nias en Nigel Popplewell
SamenvattingAuteursinformatie

The article looks at the background to the use of mediation as a tool for resolving tax disputes between the UK tax authorities (HMRC) and UK taxpayers. It explains HMRC's litigation and settlement strategy which comprises the broad structure within which HMRC must operate to resolve such disputes. It then looks at specific guidance published by HMRC dealing with ADR and mediation in particular. The operational elements of this guidance, and the authors practical experience of them are then described, as are their views, with the limitations of the process. Finally the authors look at the application of ADR in the international arena.

SamenvattingAuteursinformatie

Community policing is a common strategy in the Dutch police organization: working in a geographically bounded area, in close proximity and engagement with the local population. The use of Twitter by local police-officers is an increasingly popular way of communicating in this context. Prior research has indicated that there is a positive relation between the use of Twitter by the local police officer and citizens’ confidence in the police. But what factors determine this confidence and how can it be strengthened by using Twitter? This article examines the nature of police tweets and shows how tweets can contribute to improving the degree of confidence between citizens and the police. To determine what factors influence confidence we made use of the model of trust and confidence by Jackson and Bradford. This model differentiates between ‘effectiveness’, ‘fairness’, and ‘engagement’. These three factors are used to explore the way tweets might influence confidence in policing. The empirical research included interviews with three police officers who twitter actively, as well as interviews with 30 ‘followers’ living in the neighbourhood where the police officer works. Also an analyses has been carried out of the tweets made by the police officers in one year, 3.506 tweets in total, by categorizing the tweets according to the model of Jackson and Bradford. We conclude that the model of Jackson and Bradford is useful to explore the possible relationship between the use of Twitter and citizens confidence in the police. Using Twitter by the local police officers seems to make a possible contribution to the degree of confidence in the police. Our categorization of Twittermessages allowed us to give practical recommendations to local police officers how to use Twitter in order to improve confidence among citizens. The data also suggest that followers appreciate the fact that local police officers show their knowledge of current affairs in the neighbourhood.

Tijdschrift Tijdschrift voor Religie, Recht en Beleid, Aflevering 2 2014
Trefwoorden rooms-katholieke kerk, bestuursstructuur, vereniging/netwerk, digitalisering, universele kerk – bisdom – parochie
Auteurs Prof. dr. Henk Witte
SamenvattingAuteursinformatie

The Roman Catholic Church experiences a transition from the highly centralized Church formation of Ultramontane Mass Catholicism into a more decentralized and pluralistic Choice Catholicism. With respect to governance, this transition concerns the increasing importance of the diocesan intermediate level in the Church on the one hand, and a transition from a union-oriented organization model into a network-oriented model on the other. The network model is catalyzed by the digitalization of daily life and its polycentrism. This contribution discusses these developments in a systematic way with the help of sociological and theological insights. By way of conclusion it summarizes some challenges from a policy and governmental point of view. They concern the ecclesial leadership style, membership and participation, catholicity, online community building, and self-presentation in the social media.
