Access_open Empirical Facts: A Rationale for Expanding Lawyers’ Methodological Expertise

    This article examines the importance of the social evidence base in relation to the development of the law. It argues that there is a need for those lawyers who play a part in law reform (legislators and those involved in the law reform process) and for those who play a part in formulating policy-based common law rules (judges and practitioners) to know more about how facts are established in the social sciences. It argues that lawyers need sufficient knowledge and skills in order to be able to critically assess the facts and evidence base when examining new legislation and also when preparing, arguing and determining the outcomes of legal disputes. For this reason the article argues that lawyers need enhanced training in empirical methodologies in order to function effectively in modern legal contexts.

    This paper explores the roles that the presumption of innocence (PoI) can play beyond the criminal trial, in other dealings that citizens may have with the criminal law and its officials. It grounds the PoI in a wider notion of the civic trust that citizens owe each other, and that the state owes its citizens: by attending to the roles that citizens may find themselves playing in relation to the criminal law (such roles as suspect, defendant, convicted offender and ‘ex-offender’), we can see both how a PoI protects us, beyond the confines of the trial, against various kinds of coercion, and how that PoI is modified or qualified as we acquire certain roles. To develop and illustrate this argument, I pay particular attention to the roles of defendant (both during the trial and while awaiting trial) and of ‘ex-offender,’ and to the duties that such roles bring with them.

    In this article on the social production of the book Outsiders, I will situate its production in the daily practice of the social worlds in which Becker was involved. Therefore I focus on the relations, interactions and situations which were relevant for the form, content and success of Outsiders. For data, I use fragments from my email communication with Howard Becker, the collected interviews and other publications which show that Becker seeks to demystify Outsiders. My main contribution is that I use Becker’s own words to demystify the ethnographic practice of Outsiders and describe its mundane backstage reality, which is described by Fine as ‘the underside’ of ethnography (1993).

    The social history of jazz music in America since 1880 has been described as a movement out of the inauspicious background of night clubs and brothels in the urban underworld. In 1980 Ronald L. Morris has published a book, Wait until dark, fostering a contrary view (that should inspire criminology). Morris claimed that until 1940 the ‘mob’ had promoted jazz music as gangsters hired black musicians without concern for the law and the conventions of racial segregation. There is some evidence that even during the 1950s the jazz scene of New York City and Las Vegas had also been partly organized by the mafia.

    This essay analyses the shareholder role in corporate governance in terms of Albert Hirschman's Exit, Voice, and Loyalty. The term 'exit' is embedded in a law & economics framework, while 'voice' relates to a corporate constitutional framework. The essay takes an eclectic approach and argues that, in order to understand the shareholder role in its full breadth and depth, the corporate law & economics framework can 'share the analytical stage' with a corporate constitutional framework. It is argued that Hirschman's concept of 'loyalty' is the connecting link between the corporate law & economics and corporate constitutional framework. Corporate law is perceived as a Janus head, as it is influenced by corporate law & economics as well as by corporate constitutional considerations. In the discussion on the shareholder role in public corporations, it is debated whether corporate law should facilitate loyalty-promoting instruments, such as loyalty dividend and loyalty warrants. In this essay, these instruments are analysed based on the eclectic approach. It is argued that loyalty dividend and warrants are law & economics instruments (i.e. financial incentives) based on corporate constitutional motives (i.e. promoting loyalty in order to change the exit/voice mix in favour of voice).

    Providing access to justice is a major challenge for any judicial system. Canada has gone to great lengths to meet this challenge over the past thirty years, in part by developing alternative dispute resolution methods. Unfortunately, results have been mixed. Canadian society is currently preparing to renew its vision of access to justice and the contribution of dispute resolution methods in meeting that challenge. What lessons can we learn from Canada’s experience? What are the new directions and initiatives for access to justice? Our paper suggests that the Canadian experience can make two contributions to the access to justice debate. First, we suggest that the notion is evolving in the legal community from an institutional perspective to a contextual vision of access to justice. Second, we point out an evolution of alternative or appropriate dispute resolution methods toward a participatory justice movement. Our paper proposes a new Canadian perspective on access to justice and dispute resolution methods.

    In The Voice of Liberal Learning, Michael Oakeshott characterizes learning as a strictly non-instrumental activity. In schools and universities, knowledge is acquired for its own sake. Obviously, this liberal understanding of education differs fundamentally from a ‘critical’ notion of education as advocated by Duncan Kennedy and other members of the CLS movement. From a ‘critical’ perspective, Oakeshott’s conception may be seen as yet another attempt – typical for liberalism and conservatism alike – to depoliticize the process of knowledge production and reproduction and to conceal (and thereby to strengthen and legitimize) its effects on the distribution of power, wealth, status and so forth in society. In this paper, the author will confront both views with each other, especially within the context of legal education. The general purpose is to develop a notion of skeptical legal education, which is to a large extent based on Oakeshott’s understanding of liberal learning but which relativizes its insistence on the non-instrumentality of learning and reinforces its critical potential.

    Within the Dutch National police force, the central security and protection division is responsible for the protection of the royal family, (foreign) heads of state and certain people who are threatened. During the past few years, the division has undergone a focus shift towards a more proactive service, based on intelligence. The main priority is to prevent attacks instead of the classical view of resisting and/or withstanding attacks. To make this development possible, the division has had to evolve into a learning organisation. The article focuses on the learning process and the challenges that have been overcome. Furthermore, future developments, that can either pose a chance or a possible threat to the on-going process, are taken into account.

    Als het gaat om zorg voor minderjarigen, worden de uitgangspunten uit het familie- en jeugdrecht – de ouderlijke autonomie staat voorop en de belangen van het kind zijn een bepalende factor – in het gezondheidsrecht niet altijd voldoende gewaarborgd. Toestemming van beide ouders met gezag, ook na scheiding, levert voor artsen soms knelpunten op. Bij vermoedens van kindermishandeling of ‘niet-pluis’ gevoelens heeft de arts vanuit een zorgrelatie met het kind een bijzondere verantwoordelijkheid. Bepleit wordt dat het (gezondheids)recht op bepaalde punten aanpassing behoeft en dat de wetgever bij wijzigingen en vernieuwingen in het jeugdzorg- en jeugdbeschermingsdomein het gezondheidsrecht uit boek 7 BW niet vergeet.
