Hungarian succession law is regulated by the Hungarian Civil Code (HCC), Act No V of 2013 which contains certain new rules in comparison to the former Hungarian Civil Code, Act IV of 1959. The article gives a short overview on the law of intestacy succession in Hungary and a broad introduction into two important fields of Hungarian succession law. The legal status of the surviving spouse is analysed in details while explaining the content of the widow’s usufruct rights, the surviving spouse’s succession with the decedent’s descendants and with the parents of the decedent. The spouse’s debarment is discussed such as the spouse’s usufruct right in the legal order of lineal succession and the legal position of partners outside marriage. The compulsory share’s meaning, its traditional character, the disinheritance, and the basis and extent of compulsory share are also discussed.

This contribution seeks to bring together three themes in a descriptive and exploratory manner: (a) community service orders, (b) traffic offences and (c) restorative justice; the Dutch situation is central. To this end, the Dutch legal regulation regarding community service orders is first explained. Attention is also paid to existing empirical research on the effectiveness of community service orders in terms of reduction of recidivism (section 2). Furthermore, the sanctioning of traffic offences is discussed as well as the consequences for this of the current bill that seeks to sharpen criminal liability for serious traffic offences (section 3). Subsequently, it is examined which restorative justice provisions or modalities are available and how restorative community service orders are and can be designed (section 4). Finally, I describe my ideal when it comes to the sanctioning of traffic offences in the form of a continuum in which a special role is reserved for restorative community service orders (section 5). The contribution ends with a conclusion (section 6).

As a reaction to the perceived enforcement deficit of criminal law in the field of drug control, several countries implemented alternative regulatory strategies. One such strategy is the reregulating drugs, especially cannabis. Another strategy is the use of civil or administrative law to address drug-related crime. Especially the use of eviction to combat drug activities has become increasingly popular.
My PhD research focuses on these two developments within the field of drug control. More specifically, on the underlying rationales for the policies on recreational cannabis, the possibilities that international law provide to regulate recreational cannabis, the legal protection against drug-related evictions, and the explanation for the use of eviction to fight drug-related activities.

The increasing volume of waste generated globally is one of the most prominent environmental issues we face today. Companies responsible for the treatment or disposal of waste are therefore among the key actors in fostering a sustainable future. Yet the waste industry has often been characterised as a criminogenic one, causing environmental harm which disproportionately impacts the world’s most vulnerable regions and populations. In this article, we illustrate how companies operating in global supply chains exploit legal and enforcement asymmetries and market complexities to trade waste with countries where facilities for environmentally sound treatment and disposal of waste are lacking. We draw on two contemporary cases of corporate misconduct in the Global South by companies with operating headquarters in the Global North: Seatrade and Probo Koala. We compare these cases building on theories about corporate and environmental crime and its enforcement. This explorative comparative analysis aims to identify the key drivers and dynamics of illegal waste dumping, while also exploring innovative ways to make the waste sector more environmentally responsible and prevent the future externalisation of environmental harm.

In the past twenty-five years, a lot of attention is paid to a more victim-aware and restorative justice focused policy in prisons in Belgium and The Netherlands, striving for a restorative culture and climate in the institutions (among prisoners and staff) and for more restorative practices like victim-awareness programs and mediation. The focus is primarily on the prison structure and culture, striving to create a more restorative prison culture and climate in the institutions. In this article we argue for a shift from this system-focused pursuit of ‘estorative detention’ to the restorative reintegration of prisoners at the individual level, and by this supporting their desistance from crime. We present a conceptual framework for restorative reintegration in and outside prison as a strengths-based approach, with attention to the structural and individual elements that supports their desistance from crime.

Little is known about how ex-prisoners’ parole supervision experiences relate to desistance. The aim of this article therefore is to gain insight into the nature of release conditions and parole supervision of ex-prisoners and parolees’ perceptions of their supervision related to the desistance process. A total of 23 Dutch parolees were interviewed in depth at three waves starting in prison up to one year after their release, and the 69 interviews were combined with their parole files containing information about conditions, violations and sanctions. Parole files revealed the practice of highly engaged parole officers, who worked with parolees to strengthen factors known to foster desistance. However, the interviews showed that most parolees found their parole experience predominantly surveillance-oriented and not very helpful for desistance. Parole was experienced as most beneficial when parole officers used their discretionary power to adjust conditions creating ‘space’ for trial-and-error.

Previous research on intergenerational continuity of crime is primarily focused on transmission from fathers to children. In this article, we aim to give insight in the role of mothers in (the prevention of) continuity of organized crime. The results of our explorative study on 25 organized crime offenders based in Amsterdam and their partners and children, show that parenting skills and norms and values of mother seem to have an important role in both the intergenerational continuity of organized crime and the prevention of the transmission.

A well-established body of epidemiological research suggests that the prevalence of mental health problems (mental disorders, psychological distress, and substance use) in prisoner populations far exceeds that of non-incarcerated people in the surrounding community. Poor mental health in prisoners is associated with multiple adverse outcomes, including suicidal behaviour. In the past decade, novel data in Belgium and the Netherlands have been published on this topic, which have not been synthesized to date. The aim of the current systematic literature review was to provide an up-to-date overview of the mental health of prisoners in Belgium and the Netherlands. Based on 24 empirical studies conducted in 1997-2018, the authors conclude that people with mental health problems are overrepresented in Belgian and Dutch prisons, providing both a challenge and a public health opportunity to address the mental health care needs of a vulnerable and hard-to-engage population. Investing in the prevention and treatment of mental health problems not only benefits the prisoners concerned, but equally, society at large.

The Life In Custody-study is a large scale, prospective panel study, aimed to examine the quality of prison life in The Netherlands. This paper describes the LIC-study by giving a detailed overview of the data collection procedure, and strategies to optimize response, and presents the first nationwide results on prison climate in The Netherlands. Results show that the data collection procedures utilized were successful in obtaining a high response rate (which was an exceptional 81%) and reaching a representative group of prisoners. Furthermore, results show that the perceptions of prison climate vary across prison regimes, and to a lesser extent across age groups and time spent in detention.
