Access_open Private International Law: An Appropriate Means to Regulate Transnational Employment in the European Union?

Tijdschrift Erasmus Law Review, Aflevering 3 2014
Trefwoorden private international law, applicable law, overriding mandatory provisions, transnational employment relations, posting of workers
Auteurs Prof.dr. Aukje A.H. Ms van Hoek
SamenvattingAuteursinformatie

The regulation of transnational employment in the European Union operates at the crossroads between private international law and internal market rules. The private international law rules are currently laid down in the Rome I Regulation. This regulation is complemented by the Posted Workers Directive, a directive based on the competences of the EU in the field of free movement of services. The current contribution first describes the rules which determine the law applicable to the employment contract under Article 8 Rome I Regulation and the way these rules are interpreted by the CJEU before critically analysing these rules and the reasoning that seems to lie behind the court’s interpretation (section 2). The law applying to the contract is, however, only of limited relevance for the protection of posted workers. This is due inter alia to the mandatory application of certain rules of the country to which the workers are posted, even if a different law governs their contract. This application of host state law is based on Article 9 Rome I Regulation in conjunction with the Posted Workers Directive. Section 3 describes the content of these rules and the – to some extent still undecided – interaction between the Rome I Regulation and the PWD. The conclusion will be that there is an uneasy match between the interests informing private international law and the interests of the internal market, which is not likely to be resolved in the near future.

Draaideurvreemdelingen in de strafrechtsketen?

Tijdschrift PROCES, Aflevering 5 2014
Trefwoorden VRIS, illegale immigranten, strafrecht, terugkeer, migratie

SamenvattingAuteursinformatie

Irregular immigration is considered a big problem to Western societies. In the Dutch political discourse much attention is being attributed to dealing with a specific group of irregular immigrants: those who commit crimes and cause nuisance. Despite firm migration policies focusing on catching and deporting criminal undocumented immigrant, many seem to be coming back. By means of a exploratory study this article empirically explores the underlying rationales and traits of illegal immigrants returning to the Netherlands after they have been deported.

Een kritische reflectie op het Nederlandse beleid

Tijdschrift Justitiële verkenningen, Aflevering 5 2014
Trefwoorden Roma, Europeanization, European minority policies, securitization, the Netherlands
Auteurs Dr. H. van Baar
SamenvattingAuteursinformatie

This article critically evaluates the recent developments in Dutch policy formation regarding Roma minorities from the perspective of the increased attention paid to their position at European level. First, the author discusses the so-called ‘Europeanization of Roma representation’, that is the post-1989 representation of the Roma as a European minority and the simultaneous large-scale, Europe-wide devising of development, inclusion, and empowerment programs meant for them. Thereafter, the author argues that some of the risks of the Roma’s Europeanization – such as the isolation and culturalization of policy formation and the diminishing of democratic accountability – have also and ambiguously affected Dutch policies meant for Roma, Sinti and caravan dwellers. By means of a brief analysis of recent policy developments, the author demonstrates that the Dutch shift towards a policy that, at least in name, encourages social participation, has actually tended to result into a one-sided focus on the Roma as a ‘problem group’ and ‘security threat’.

Het onderscheidende karakter van profielen bij vreemdelingentoezicht

Tijdschrift PROCES, Aflevering 1 2014
Trefwoorden etnisch profileren, vreemdelingentoezicht, discriminatie, crimmigratie
Auteurs Prof. mr. Peter Rodrigues
SamenvattingAuteursinformatie

The main question of this contribution is whether the use of ethnic profiling in migration control is an infringement of the prohibition of racial and religious discrimination. To answer this question, the regulation on migration control is analyzed and the trend of mixing criminal law with migration law is criticized. The influence of quota of irregular migrants who should be expelled and penalizing of illegal residence is studied. Taken into account the jurisprudence on the issue, the author argues that profiling based on race and religion is forbidden, which is also the case if nationality is used in profiles against EU-citizens.
