States apply different material conditions to attract or restrict residence of certain types of migrants. But states can also make use of time as an instrument to design more welcoming or more restrictive policies. States can apply faster application procedures for desired migrants. Furthermore, time can be used in a more favourable way to attract desired migrants in regard to duration of residence, access to a form of permanent residence and protection against loss of residence. This contribution makes an analysis of how time is used as an instrument in shaping migration policy by the European Union (EU) legislator in the context of making migration more or less attractive. This analysis shows that two groups are treated more favourably in regard to the use of time in several aspects: EU citizens and economic- and knowledge-related third-country nationals. However, when it comes to the acquisition of permanent residence after a certain period of time, the welcoming policy towards economic- and knowledge-related migrants is no longer obvious. |

In de Nederlandse rechtspraktijk kan de rechter een beroep op een strafuitsluitingsgrond verwerpen als blijkt dat de verdachte een zekere mate van eigen schuld heeft, ondanks dat de (overige) voorwaarden zijn vervuld. In de literatuur worden bezwaren aangevoerd tegen deze pragmatische benadering en zijn alternatieve aansprakelijkheidsmodellen tot stand gekomen: eigen schuld als zelfstandig strafbaar feit en de actio libera in causa. In deze bijdrage worden beide modellen beschreven en vergeleken met de Nederlandse benadering. |

Het Nederlandse strafrecht is gebaseerd op de idee van ultimum remedium. Strafrecht kan grote gevolgen hebben voor de verdachten. Of en op welke wijze bepaald ongewenst gedrag moet worden strafbaar gesteld, vereist daarom een gedegen afweging tussen de voor- en nadelen van het strafrecht. Criteria voor strafbaarstelling bieden de wetgever een argumentatiekader aan de hand waarvan strafbaarstelling kan worden gelegitimeerd en gerechtvaardigd. In dit artikel worden de huidige strafbaarstellingtheorieën aangevuld met wetgevingsbeleid. |

In de onderhavige prejudiciële zaak is het Hof van Justitie voor het eerst verzocht om een uitspraak over de uitlegging van de bepalingen van Verordening (EU) nr. 1169/2011 over de vermelding van het ‘land van oorsprong’ en de ‘plaats van herkomst’ met betrekking tot levensmiddelen die uit de door Israël sinds 1967 bezette gebieden afkomstig zijn. In het op 12 november 2019 gewezen arrest in de de zaak Organisation juive européenne en Vignoble Psagot heeft het Hof van Justitie geoordeeld dat uit deze verordening volgt dat op levensmiddelen die afkomstig zijn uit een door Israël bezet gebied, niet alleen dit gebied maar tevens, wanneer die levensmiddelen afkomstig zijn uit een plaats die of een geheel van plaatsen dat een Israëlische nederzetting binnen dat gebied vormt, deze herkomst moet worden vermeld. In deze bijdrage worden de achtergronden en gevolgen van deze uitspraak nader toegelicht. |

Similar to pharmaceutical products, medical devices play an increasingly important role in healthcare worldwide by contributing substantially to the prevention, diagnosis and treatment of diseases. From the patent law perspective both, pharmaceutical products and a medical apparatus, product or device can be patented if they meet the patentability requirements, which are novelty, inventiveness and entail industrial applicability. However, regulatory issues also impact on the whole cycle of the innovation. At a European level, enhancing competitiveness while ensuring public health and safety is one of the key objectives of the European Commission. This article undertakes literature review of the current and incoming regulatory framework governing medical devices with the aim of highlighting how these major changes would affect the industry at issue. The analysis is made in the framework of an on-going research work aimed to determine whether SPCs are needed for promoting innovation in the medical devices industry. A thorough analysis the aforementioned factors affecting medical device’s industry will allow the policymakers to understand the root cause of any optimal patent term and find appropriate solutions. |

Criminologists have by and large sought to explain crime by the deficiencies people may have. It took till the 1970s until the idea that crime can also be caused by structural power inequalities got an actual name in criminology: crimes of the powerful. Starting with the works of Willem Bonger and Edward Ross in the early 20th century, the author analyses how critical criminologists like Frank Pearce introduced the term ‘crimes of the powerful’ in the 1970s and how this concept was subsequently applied to gender- and racial inequalities, state crime, corruption et cetera, whilst pointing at the topical relevance of using a lens of ‘crimes of the powerful’ as a sensitising concept to analyse present-day problems, ranging from sexual abuse in the Roman Catholic church to the banking sector or indeed the expropriation of indigenous lands in the Amazon by soy-farmers and timber traders. |

Multi-national corporations are increasingly facing attention and disapproval by different actors, including authorities, public and (non-) commercial organizations. Digital globalization and especially social media as a low-cost, highly interactive and multidirectional platform shape a unique context for this rising attention. In the literature, much attention has been devoted to top-down approaches and strategies that corporations use to avoid stigmatization and sanctioning of their behaviour. Reactions to corporate harm are, however, seldom researched from a labelling perspective. As a result, corporations are not considered as objects towards whom labelling is targeted but rather as actors who hamper such processes and who, as moral entrepreneurs, influence which behaviour is labelled deviant. Based on theoretical analysis of literature and case studies, this article will discuss how the process of labelling has changed in light of the digitalized, late-modern society and consequently, how the process should be revisited to be applicable for corporate deviance. Given a diversification of moral entrepreneurs and increasingly dependency of labelling and meaning-making on the online sphere, two new forms of labelling are introduced that specifically target institutions; that is bottom-up and horizontal labelling. |

This contribution discusses the supplementary value of media analyses to understanding the relationship between media and crime. Analyses of media framing and media hypes are discussed on the basis of two cases: the case of New Years Eve in Cologne in 2015 and the “bus incident” of Moroccan Dutch youngsters in Gouda in 2008. The two cases presented here illustrate the significance of media analysis in criminology and its relevance in a media society. Analyses of the media representation and the societal reactions show the influence of media on the image building about crime. Since media are a predominant force of modern society and mediatization is a characteristic of the present tense, media representation has a great impact on the perceptions of crime and punishment, and our reality. |

In criminology, it is generally assumed that the high social status of white-collar offenders prevents them of being targeted by criminal law enforcement. But when they do, they suffer greater social and economic damage because of this high social status. Empirical research on the consequences of criminal law enforcement and conviction for white-collar offenders is scarce, and limited to the US and the UK. This paper used biographies of convicted former executives in business and public office in the Netherlands, to analyse these consequences and the process of the ‘fall from grace’ of white-collar offenders. The consequences are described in four life-domains: health, the private sphere, the occupational sphere and the social sphere. The results show that Dutch executives, in line with findings for the Anglo-American white-collar offenders, experience status degradation and suffer much collateral damage of criminal law enforcement. After the initial horror of imprisonment, they endure prison life fairly well. Individual competences and remaining social and economic capital enable them to return to normal life, although they cannot return to pre-conviction levels of social status. |

In Confédération paysannes oordeelde het Hof dat mutagenesetechnieken ontwikkeld na het vaststellen van de doelbewuste introductie van GGO Richtlijn, waaronder bijvoorbeeld CRISPR/CAS9, binnen de werkingssfeer van de GGO Richtlijn vallen. Tegelijkertijd concludeerde het dat de uitzondering voor GGO’s verkregen door ‘mutagenese’, vervat in Annex I B, niet geldt voor deze nieuwe technieken, en daarom aan een risicobeoordeling moeten worden onderworpen. Deze oudere en zich als veilig bewezen GGO’s mogen volgens het Hof van Justitie echter wel aan nadere nationale regels worden onderworpen (partiële harmonisatie). De resulterende uitbreiding van de reikwijdte van deze kaderrichtlijn naar GGO’s verkregen door gerichte mutagenese heeft repercussies voor alle wetgeving waarin het begrip ‘GGO’ centraal staat. |

In this article, I am using Becker’s concept of moral entrepreneur to analyse the role of pain specialists in the labelling process, which has led to the normalisation of the use of opioid painkillers in the United States and ultimately to the death over 200.000 Americans. In general, the literature on labelling centres on crusading reformers, and the criminalisation and stigmatisation of transgressive behaviour. Here I will focus on the moral entrepreneurship of medical experts. What was their role in the normalisation process of opioid painkiller use and are there any similarities with the strategies of crusading reformers? My findings, based on qualitative analysis of documents such as newspaper articles and academic publications, show that, with two exceptions, pain specialists use the strategies of moral crusaders. First, in their narratives, pain specialists represented themselves as neutral objective experts without the emotional stance of moral crusaders. The second exception, which is related to the first, is that there was less emphasis in their narrative on creating villains, as they could not blame openly standard medical practice because they needed the support of the established medical world in order to normalise and legalise opioid painkillers. |

Early literature on female perpetrators of World War II focused on labelling the accused as deranged psychopaths, thereby distinguishing the group of perpetrators from the vast subdued and ‘normal’ population. While this perception has changed over the past decades, the perception of female perpetrators has remained limited either way, women are denied having a lot of agency when perpetrating crimes in conflict. Similar to the ‘mad Nazi’-theory these narratives imply that female perpetrators are different from ‘ordinary’ women, as their actions collide with notions of ideal femininity. This empirical research has shown that in the case of female perpetrators of World War II in the Netherlands it seems that they can be seen as ordinary women operating in extraordinary circumstances. In this study, a special group of female war criminals is described. Against the background of early post-war imaging of such women and more recent research on female perpetration during wartime, an analysis of Dutch perpetrators who received severe punishments after the War, is made. Based on unique historical data, the criminal career of these women as World War II perpetrators is analysed. The outcomes show that a notable part already had a criminal record before the war and that the perception of who they were and why they acted the way they did needs reconsideration, since they were not psychologically weak and incompetent. They were generally young, unemployed and low educated and they planned and committed their crimes of treasons in order to create better living conditions for themselves. In fact, one can claim that these women are likely to be ordinary people influenced by dispositional and situational factors. |

This article starts off with an exposé of what ‘theoretical innovation’ means in the social sciences. The development of criminology is considered to be a result of (1) historical and cultural developments, (2) political-economic developments, (3) developments in other academic disciplines and (4) reactions to or specifications of other theoretical perspectives in criminology itself. Paradigm shifts in criminology are characterised by an individualistic and positivist aetiological turn in its early days; a sociological turn towards a ‘criminology of the lawmaker’ from the late 1950s on; and a return to positivism in the neoliberal and neoconservative turn of the 1990s. The new century ushers in a new epistemological break in criminology, in which globalisation, global warming, migration, human rights and the implications of cyberspace ‘force’ criminologists to overcome their anthropocentric and colonial character biases. |
