This article presents an overview of the legal regime provided in the Spanish system of criminal sanctions regarding the control of dangerous sex offenders in the community. It focuses on the introduction, in 2010, of a post-prison safety measure named supervised release. We describe the context of its introduction in the Spanish Criminal Code, considering the influence of societal upheaval concerning dangerous sex offenders in its development, and also the historical and theoretical features of the Spanish system of criminal sanctions. We also analyse the legal framework of supervised release, the existing case law about it and how the legal doctrine has until now assessed this measure. After this analysis, the main aim of this article consists in evaluating the effectiveness and the proportionality of the measure, according to the principle of minimal constraints and the rehabilitative function of the criminal sanctions in Spanish law, stated in Article 25.2 of the Spanish Constitution. |

Bedrijven die onder het zwaarste regime van het nieuwe Besluit risico’s zware ongevallen 2015 (hierna Brzo 2015) vallen, hadden vóór 1 juni 2016 een veiligheidsrapport moeten indienen dat aan de eisen van het Brzo 2015 voldoet. Dat was in de praktijk problematisch omdat inwerkingtreding van de Regeling risico’s zware ongevallen 2015 lang op zich heeft laten wachten en de PGS 6-richtlijn nog niet definitief is aangepast. Om die reden hebben de Brzo-omgevingsdiensten aan bestaande inrichtingen laten weten dat een ‘begunstigingstermijn’ zal worden geboden tot en met 1 januari 2017 om te voldoen aan het Brzo 2015. Wij hebben onderzocht of Brzo-bedrijven op basis van de brief inderdaad langer de tijd mochten nemen om een nieuw veiligheidsrapport in te dienen, of dat zij daardoor op het verkeerde been zijn gezet. |

The focus in this article is the ‘criminalisation’ of youth hanging around with the emergence of bans on hanging around. A critical social constructivist approach is used in this study, which draws predominantly on qualitative primary data collected between the late 1980s and 2010s. The article compares indigenous with immigrant youth, which coincides with, respectively, youth in rural communities and youth in urban communities. This study shows that there is discrimination of immigrant youth, which is shaped by several intertwining social phenomena, such as the ‘geography of policing’ – more police in urban areas – familiarity, sharing biographical information (in smaller communities), and the character of the interaction, normalising versus stigmatising. In further research on this topic we have to study (the reaction to) the transgressions of immigrant youth, and compare it with (the reaction to) the transgressions of indigenous youth, which is a blind spot in Dutch criminology. |

In the Netherlands two experiments are conducted with a new kind of collaboration between probation and prosecution. The experiments aimed for the development of meaningful, contextual and tailor-made sanctioning. As a result, the experiments reached a new group of citizens that probation nor social services ever reached before, people who commit very light offenses, but struggle with heavy social problems. The new method of working resembles short intensive case management (hit and run) and includes commitment of social context and close collaboration with social work and care. Based on the results, probation and prosecution decided to implement this method in all Dutch regions and the Ministry of Safety and Justice adapted their financing structure. |

Cannabis Social Clubs (CSCs) are a model of non-profit production and distribution of cannabis among a closed circuit of adult cannabis users. The CSC model can thus be seen as a middle-ground option between prohibition and full (legal) commercialization. Initially founded in Spain during the 1990s, this form of collectives has emerged elsewhere in Europe (notably in Belgium), mainly as a result of grassroots initiatives and self-regulation. Uruguay remains the only jurisdiction to have legalized and regulated the CSC model. This paper discusses the goals and practices of CSCs against the backdrop of the drug user movement. Our goal is to draw a comparison to other drug users’ organizations and to identify knowledge gaps to be addressed in future research into CSCs. In this analysis, we rely on a review of the relevant literature in this field and on preliminary findings from an ongoing study examining CSCs in Belgium. A preoccupation with reducing the harms associated with drug use seems to be an underlying guiding principle for CSCs and other drug users’ organizations, but further research into CSCs’ practices is needed to understand whether and how those are implemented. We found other common points between the broader drug user movement and the efforts of CSCs, both in terms of potential pitfalls and areas for positive impact. We suggest that the model warrants additional attention from both the research and policy-making community. |

While in the sixties hackers were the heroes of cyberspace, they are nowadays often perceived as the archetype cybercriminal. From the perspective of labelling theory, this empirical study examines how hackers feel perceived by society at large, how they perceive themselves as ‘others’ and how they view themselves in relation to ‘others’. Our research shows that hackers – despite of an experienced negative labelling – view themselves as positive ‘others’. We conclude that the features of the hacking phenomenon itself (skillset, mindset, own morality) in combination with the digital context in which they operate, enable hackers to avoid a ‘spoiled identity’. |

The article examines mechanisms of othering the refugees illustrated on one refugee camp in Germany. Based on the theoretical strand of the foreigner dispositif, I analyze spatial and architectural compositions of the camp to outline the differentiation of ‘we’ (nation state) and ‘others’ (refugees). In the process of othering space excludes, controls and identifies refugees as ‘others’. However, being identified as the other, space can also be conceived as a specific space of hope. The findings shed some light on the link between othering, space and identity. |

This article is based on ethnographic research over recent years in eight Dutch police teams. It focuses on the othering process in which police officers define ‘crooks’ as the Other and chase, catch and arrest them. Catching crooks is perceived as an assignment as well as a game. Street cops construct detailed subcategories of the crook which influence their daily practices. They select crooks by recognition (the permanent suspects), by abnormalization (out of placeness) and by profiling (regardless of place). In addition to the discussion on ethnic profiling, we argue that profiling is a contextual practice. The contents of the profiles depend on the demographic characteristics of the district in which a police team operates. Interacting mediaframes of both the crook and the police reinforce the mutual caricatures and tense relationships. |

Herman Bianchi, who passed away on the 30th of December 2015, has been a true ‘significant other’ for cultural criminologists. This article is a ‘criminological Verstehen’ of Bianchi’s work. His general attitude towards criminology is characterised by a mix of academic analysis, emotional outrage and incongruities. In order to understand this, his contributions to criminology are linked to biographical notes and to the mixed reactions he got on his work. Bianchi played an important role in the establishment of criminology as an autonomous academic discipline, yet he was very critical of this ‘discipline of shame’ because it has always served the exclusion of the most vulnerable members of society. He has been one of the frontmen of critical criminology, but he was not a Marxist. His concern for the despised other is related to his eternal fear, as a gay man in a ‘closet with a revolving door’, of new waves of discrimination against gays, and his rigorous abolitionism to his experience as a prisoner in a Nazi-concentration camp in 1944. Bianchi’s historical interest led him at the end of his career in the 1980s to support the emergence of strong historical criminology, but his utilitarian use of historical studies, also resulted in some clashes with professional historians. |
