    Within orthodox-protestant schools in The Netherlands there is growing diversity and uncertainty about internal religious, cultural and social norms. Though orthodox-protestant schools are among the strongest semi-autonomous social fields, where it is difficult for equal treatment law to pervade, this growing diversity and uncertainty about internal norms can make this pervasion possible. The uncertainty about the meaning of the exception clause in equal treatment legislation for the appointment policy of religious schools also affects this.
    Because of the uncertainty about the meaning of the exception clause the position of the school board was strengthened in comparison to the employee, even though the intention of the equal treatment law was the opposite. At a later stage the clarification of the anti-discrimination norm by changing the exception clause has strengthened the position of the employee. Though this is only possible when religious, cultural and social norms are changing. In that case orthodox-protestant schools, as semi-autonomous fields, are more open for the effects of this legal norm.
    Uncertainty about the meaning of the requirement of a consistent appointment policy has led both to tightening as well as relaxation of the policy. In the first place tightening or relaxation of policies depends on the development of religious, cultural and social norms within different school denominations. Thus, uncertainty about internal norms works both contrary as well as strengthening to uncertainty about equal treatment legislation.

    This article collects publications in this journal about the emergence and effects of legislation. It covers the developments and results of research of the last four decades. First it is concluded that there has been considerable attention to the subject. Second a clear broadening and (theoretical) deepening from different perspectives can be observed. Social-legal research of legislation also appears to have specific characteristics. Subsequently, various points of attention are pointed out, such as more attention to the relationship between legal characteristics and effects, more variation in research methods and more systematic theory-driven research. Finally, attention is drawn to the relationship between (the working of) legislation and social transformations such as globalization, digitization and the increasing and profound influence of social media in society.

    Because of the sharp contrast between the law-in-the-books and the law-in-action regulatory enforcement has always been a popular subject in socio-legal research. This paper looks back at forty years of Dutch research on regulatory enforcement, using several key publications in this journal from each decade. First, it is argued that these Dutch studies reveal three general themes: this research can be seen as a time machine that takes us back to some of the most important social and political events of the past decades, these studies emphasize the crucial role of individual enforcement officials, and in everyday enforcement state law only plays a limited role. Next, this review also discusses some of the strengths and weaknesses of Dutch research. Most studies on regulatory enforcement are more interested in the role of the state than in the role of citizens and businesses. As a result, research focuses more on issues of effectiveness and less on questions of legitimacy. Finally, empirical research is seen as more important than theory development. Based on this overview, the author introduces a new research agenda for future research on regulatory enforcement.

    From day one of the journal Recht der Werkelijkheid (Journal of Living Law) the Legal Anthropology was welcomed. What once started as the jurisprudential study on Folk Law on the one hand and the cultural anthropological study of law on the other hand, evolved into an intensive collaboration among the researchers. Even more intensive under the subject Legal Pluralism. The legal anthropological studies extended over the years to subjects closer to the First World legal practices, i.e. the studies of social groups like the one on migrants. Under the concept of semi autonomous social fields many contributions on cultural versus legal norms were published. Later on, the legal anthropological expertise that sustained the comparative studies for international and supranational law was welcomed. The article thus shows that the journal provided room for the socio legal studies of law practices in other continents, expanded to those of other continents in the home continent as well as to those in all continents.

    The article presents the status quo of the law of retrial in Germany and gives an overview of the law and practice of the latter in favour of the convicted and to the disadvantage of the defendant. Particularly, the formal and material prerequisites for a successful petition to retry the criminal case are subject to a detailed presentation and evaluation. Because no official statistics are kept regarding successful retrial processes in Germany, the actual number of judicial errors is primarily the subject of more or less well-founded estimates by legal practitioners and journalists. However, there are a few newer empirical studies devoted to different facets of the subject. These studies will be discussed in this article in order to outline the state of empirical research on the legal reality of the retrial procedure. Against this background, the article will ultimately highlight currently discussed reforms and subject these to a critical evaluation as well. The aim of the recent reform efforts is to add a ground for retrial to the disadvantage of the defendant for cases in which new facts or evidence indicate that the acquitted person was guilty. After detailed discussion, the proposal in question is rejected, inter alia for constitutional reasons.

    The Dobersberger decision of the Court of Justice of the European Union deals with the legal situation of posted workers on an international train. These workers, employed by a Hungarian company and based in Hungary, operate on a train connecting Budapest with Salzburg and Munich. The Court concludes against their inclusion under the Posting of Workers Directive, considering their connection to the Austrian territory as too limited. This decision is based on a selective representation of the facts and sits difficultly with the letter of the law and the intention of the legislator.

    Whether homosexual teachers can work at an orthodox Protestant school in The Netherlands is regularly subject of societal debate. The Equal Treatment Law (1994) prohibits discrimination on the ground of homosexual orientation. How this works out in practice differs per denomination (type of school) and shifts over time in the direction of increasing acceptance. Within orthodox Protestant schools room is increasing to come out of the closet. Within certain schools there is increasing room for homosexual relationships, although opinions within these schools often differ and hence may also lead to conflict.

    The Employment Appeal Tribunal (EAT) has ruled that the provision under the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE) which renders changes to employees’ terms and conditions void if they are made because of the transfer applies to changes that are advantageous as well as detrimental to employees. On the facts of the case, this meant that owner-directors who had made significant improvements to their own employment terms before a TUPE transfer could not enforce these against the transferee employer.

    In a summary proceeding, the Court of Rotterdam has held that it is not clear whether the Non-Seafarers Work Clause, prohibiting lashing work on board of container ships being carried out by the crew, does indeed contribute to better employment and/or working conditions of seafarers. As a result of which the Clause – at this time – cannot be held to be outside the scope of competition law and the claim for compliance with the provision has been rejected. In the media, unions have stated that they will continue to enforce compliance with the Non-Seafarers Work Clause. It remains to be seen whether a court in main proceedings will reach a similar verdict.

    This article focuses on the posting of workers in the aviation industry. The main problem is that it is not clear in which situations the Posting of Workers Directive should be applied to aircrew (i.e. cabin crew and pilots). The aviation sector is characterised by a very mobile workforce in which it is possible for employees to provide services from different countries in a very short timeframe. This makes it, to a certain extent, easier for employers to choose the applicable social legislation, which can lead to detrimental working conditions for their aircrew. This article looks into how the Posting of Workers Directive can prevent some air carriers from unilaterally determining the applicable social legislation and makes some suggestions to end unfair social competition in the sector. This article is based on a research report which the authors drafted in 2019 with funding from the European Commission (hereafter the ‘Report’)

    On 13 December 2019 the European Free Trade Association (EFTA) Court held that a national provision that renders a father’s entitlement to parental benefits during a shared period of leave dependent on the mother’s situation, but not vice versa, fell outside the scope of Directive 2006/54/EC (the Equal Treatment Directive) since it did not concern “employment and working conditions” within the meaning of Article 14(1)(c) of that Directive. The action brought by the EFTA Surveillance Authority (ESA) was thus dismissed. The Court consequently did not consider whether the Norwegian rules amounted to unlawful discrimination under the Directive. Furthermore, no assessment was made as to the potential breach with the general principle of equality of gender under EEA law, as this had not been pleaded by ESA.

    This case involved an employee who claimed that he was unfairly dismissed for using a trade union to bring a grievance over measures his employer had taken on account of the coronavirus pandemic. The Employment Tribunal (ET) found that he was likely to be able to show at the full hearing of the case that this was an automatically unfair dismissal on grounds of his trade union membership or activities. It awarded the remedy of ‘interim relief’, ordering the employer immediately to reinstate him pending the full trial of the matter. The ET’s decision might signal a potential rise in claims for interim relief in future cases.

    Wrongful convictions and miscarriages of justice, their reasons and effects, only rarely become the subject of academic debate in Poland. This article aims at filling this gap and providing a discussion on the current challenges of mechanisms available in Polish law focused on the verification of final judgments based on innocence claims. While there are two procedures designed to move such judgment: cassation and the reopening of criminal proceedings, only the latter aims at the verification of new facts and evidence, and this work remains focused exactly on that issue. The article begins with a case study of the famous Komenda case, which resulted in a successful innocence claim, serving as a good, though rare, example of reopening a case and acquitting the convict immediately and allows for discussing the reasons that commonly stand behind wrongful convictions in Poland. Furthermore, the article examines the innocence claim grounds as regulated in the Polish criminal procedure and their interpretation under the current case law. It also presents the procedure concerning the revision of the case. The work additionally provides the analysis of the use of innocence claim in practice, feeding on the statistical data and explaining tendencies in application for revision of a case. It also presents the efforts of the Polish Ombudsman and NGOs to raise public awareness in that field. The final conclusions address the main challenges that the Polish system faces concerning innocence claims and indicates the direction in which the system should go.

    The Belgian Code of criminal procedure provides the possibility to revise final criminal convictions. This procedure had remained more or less untouched for 124 years, but was finally reformed by the Act of 2018, after criticism was voiced in legal doctrine concerning its narrow scope and possible appearances of partiality and prejudice. The Act of 2018 therefore broadened the third ground for revision, the so-called novum, and defined it as an element that was unknown to the judge during the initial proceedings and impossible for the convicted person to demonstrate at that time and that, alone or combined with evidence that was gathered earlier, seems incompatible with the conviction, thus creating a strong suspicion that, if it had been known, it would have led to a more favourable outcome. Thereby, this ground for revision is no longer limited to factual circumstances, but also includes changed appreciations by experts. To counter appearances of partiality and prejudice, the Act of 2018 created the Commission for revision in criminal matters, a multidisciplinary body that has to give non-binding advice to the Court of Cassation on the presence of a novum. However, the legislature also introduced new hurdles on the path to revision, such as the requirement for the applicant to add pieces that demonstrate the ground for revision in order for his or her request to be admissible. For that reason, the application in practice will have to demonstrate whether the Act of 2018 made the revision procedure more accessible in reality.

    The Italian Constitution expressly contemplates the possibility of a wrongful conviction, by stating that the law shall determine the conditions and forms regulating damages in case of judicial error. Therefore, it should come as no surprise that many provisions of the Italian Code of Criminal Procedure (CCP) deal with the topic. The aim of this article is to provide an overview of the post-conviction remedies in the Italian legal system by considering the current provisions of the CCP, on the one hand, and by exploring their practical implementation, on the other.

    This article reviews exoneration in Sweden, with a focus on the procedure of applying for exoneration. First, it highlights some core features of Swedish criminal procedural law, necessary to understand exoneration in the Swedish context. Secondly, it outlines the possibilities in Swedish law to apply for exoneration, both in favour of a convicted person and to the disadvantage of a previously acquitted defendant. Thirdly, it identifies some challenges with the current Swedish model of administering applications for exoneration. Fourthly, it argues that the current system should be reformed by introducing into Swedish law a review committee that administers applications for exoneration.
