    ‘Illiberal’ is an adjective that is commonly used by scholars. For example, they might speak of ‘illiberal cultures’, ‘illiberal groups’, ‘illiberal states’, ‘illiberal democracies’, ‘illiberal beliefs’, and ‘illiberal practices’. Yet despite its widespread usage, no in-depth discussions exist of exactly what it means for someone or something to be illiberal, or might mean. This article fills this lacuna by providing a conceptual analysis of the term ‘illiberal practices’, which I argue is basic in that other bearers of the property of being illiberal can be understood by reference to it. Specifically, I identify five ways in which a practice can be illiberal based on the different ways in which this term is employed within both scholarly and political discourses. The main value of this disaggregation lies in the fact that it helps to prevent confusions that arise when people use the adjective ‘illiberal’ in different ways, as is not uncommon.

    A revision of the Dutch vice law is to be expected, amongst others with regard to sex between minors. The current standard requires such contacts to be in violation with the social view, indicating that the minor’s perspective is subdue to the majority opinion. Applying the legal standard of ‘indeceny’ (‘ontuchtig’), the judiciary are left with room for interpretation. In order to grant minors more sexual autonomy and to further legality, the legislator wants to change the criterion, opting for the standard of ‘other than in an equal relationship’. This begs the question whether this will solve the interpretive issues that flow from such open criteria. In order to predict whether the standard of ‘other than in an equal relationship’ will contribute to clarify the issues of legality, the jurisprudence with regard to the standard of ‘indecency’ was analyzed in order to learn which variables are applied by the magistracy.

    In the Netherlands, the use of involuntary treatment in the mental health care sector is governed by the Dutch Care and Compulsion Act (Wzd). This study examines the legal position of persons with intellectual disabilities under this Act. The Wzd is analyzed in light of the human rights standards of Article 12 of the Convention on the Rights of Persons with Disabilities (CRPD). The findings of this study show that the Wzd does not meet the standards of Article 12 in several cases. The Wzd does not recognize the legal capacity of persons with intellectual disabilities, it continues to allow for substituted decision-making and support measures are not complemented by adequate safeguards. From a theoretical point of view, an imbalance between the protection of and the respect for the autonomy of persons with intellectual disabilities can be observed. This article formulates several recommendations in order to restore this balance.

    De Nederlandse Wet zorg en dwang (Wzd) ziet toe op de rechten van mensen met een verstandelijke beperking bij onvrijwillige zorg of onvrijwillige opname. Dit artikel onderzoekt de juridische positie van mensen met een verstandelijke beperking ten aanzien van deze wet. De Wzd wordt geanalyseerd in relatie tot artikel 12 van het Verdrag inzake de Rechten van Personen met een Handicap (VRPH). De bevindingen van dit onderzoek laten zien dat de Wzd in verschillende gevallen niet voldoet aan de normen van artikel 12 VRPH. Zo wordt onder andere de handelingsbekwaamheid, ofwel ‘legal capacity’, van mensen met een verstandelijke beperking niet erkend en blijft plaatsvervangende besluitvorming mogelijk. Vanuit theoretisch oogpunt is er sprake van een disbalans tussen de bescherming van en het respect voor de autonomie van mensen met een verstandelijke beperking. Dit artikel doet daarom meerdere aanbevelingen om dit evenwicht te herstellen.

    In this article you will be introduced to Martha. Martha will turn eighteen in a couple of weeks and is afraid of losing her foster family when she becomes an adult (I). You will be taken on a journey through the Dutch child protection system and recent research on the desirability of forging an additional legal instrument, such as the introduction of simple adoption, for children like Martha and her two families. The following questions will be answered: How do children like Martha end up in a foster family (II)? Who is responsible or who makes decisions about Martha’s care and future and what problems may occur? Five possible situations in long-term foster care will be discussed in this context on the basis of current law and research (III). Would simple adoption (eenvoudige adoptie) solve some of the problems discussed in the earlier section and thus be a feasible and desirable option for long-term foster children and their foster parents (IV)? At the end of this journey you will be invited to take a brief glance into the future in the hope that Martha’s voice will be heard (V).

Aan de hand van het verhaal van Martha nemen we u mee op een reis langs het Nederlandse jeugdbeschermingsstelstel en langs recent onderzoek naar de wenselijkheid van de introductie van een nieuwe juridische mogelijkheid waarmee een band tussen Martha en haar beide families kan worden gevestigd: eenvoudige adoptie.     In our research project ‘Living on the Other Side’, we aim to understand how (ir)regular migrants from the Middle East and West/Central Africa deal with the legal and formal aspect of their lives in Morocco by focusing on major life events, such as marriage, divorce, birth and death. Life does not simply stand still when residing in a foreign country – people continue to marry, divorce, have children and die. However, there is little empirical knowledge on what migrants actually do when faced with such events. Registering major life events secures a migrant’s legal identity and protects their human rights. Having a legal identity, most likely, influences the daily lives of migrants. A migrant, who does not formally exist in the eyes of the state, might not be able to access basic services, like health care and education. From a legal pluralist perspective, we aim to investigate how migration and family law intersect by conducting online and offline ethnographic fieldwork.

    This is a case study in ‘new legal pluralism’ which is interested in the operation of plural legal orders in countries of the global North. It considers the way in which the Nigerian Igbo living in Antwerp, Belgium settle their disputes. It first presents the Antwerp Igbo’s organisation in a Union possessing a constitution with precise legal stipulations. It then finds that the Igbo take the law with them from their home region into a diasporic community. Next it looks into the concrete organisation of dispute settlement and presents five cases as exemplars. It then discusses the advantages and drawbacks of applying Igbo law and justice, the issue of women’s rights, and the plurality and flexibility of the system. The conclusion underscores the fact that legal pluralism is a universal empirical reality.

Access_open Teaching Technology to (Future) Lawyers

    The article offers a reflection on how applications of computer technology (including data analytics) are and may be taught to (future) lawyers and what are the benefits and limitations of the different approaches. There is a growing sense among legal professionals and law teachers that the technological changes in the practice of law are likely to promote the kind of knowledge and skills that law graduates often do not possess today. Teaching computer technology can be done in various ways and at various depths, and those different ways and levels have different cost and benefit considerations. The article discusses four models of teaching technology: (1) teaching basic technological literacy, (2) more advanced but general technology teaching, (3) teaching computer programming and quantitative methods and (4) teaching a particular aspect of technology – other than programming (e.g. cybersecurity). I suggest that there are strong reasons for all current and future lawyers to acquire proficiency in effective uses of office and legal research software and standard means of online communication and basic cybersecurity. This can be combined with teaching of numerical and informational literacy. I also claim that advanced technology topics, like computer programming, should be taught only to the extent that this is justified by the direct need for such skills and knowledge in students’ future careers, which I predict to be true for only a minority of current lawyers and law students.

What makes a sex crime?

A fair label for image-based sexual abuse

    This article considers why image-based sexual abuse (‘ibsa’) should be classified as a sexual offence. The article briefly considers harmfulness, and then moves to discuss the principle of fair labelling. Classification of offences should be informed by the wrongdoing they address. A conceptual analysis of sexual offences shows that sexual wrongs warrant labelling as sexual offences. The infringement of the right to sexual autonomy in ibsa means the nature of the wrong is sexual. Ibsa should be a sex crime.

    On 16 December 2020, the Supreme Court of Lithuania (Cassation Court) delivered a ruling in a case where an employee claimed that the employer, JSC ‘Lithuanian Railways’, did not apply the regulations of the company’s employer-level collective agreement and did not pay a special bonus – an anniversary benefit (i.e. a benefit paid to employees on reaching a certain age) – because the employee was not a member of the trade union which had signed the collective agreement. According to the employee, she was discriminated against because of her membership of another trade union, i.e membership of the ‘wrong’ trade union.
    The Supreme Court held that combatting discrimination under certain grounds falls within the competence and scope of EU law, but that discrimination on the grounds of trade union membership is not distinguished as a form of discrimination. Also, the Court ruled that in this case (contrary to what the employee claimed in her cassation appeal) Article 157 of the Treaty on the Functioning of the European Union (TFEU) is not applicable because it regulates the prohibition of discrimination on other (sex) grounds. Moreover, the Court found that there was no legal basis for relying on the relevant case law of the ECJ which provides clarification on other forms of discrimination, but not on discrimination based on trade union membership.

    According to German law, leave entitlements of an employee shall in principle expire at the end of the calendar year or a permissible carryover period. However, based on the case law of the ECJ, this shall only apply if the employer has previously enabled and summoned the employee to take leave and the employee has nevertheless not taken it. But what happens if an employee is incapacitated for work for a longer period of time and therefore is unable to take his or her annual leave? Does the employer also have to inform this employee about their leave entitlement? The Federal Labour Court (Bundesarbeitsgericht, ‘BAG’) recently had to deal with this question in two cases and now the ECJ will have to address this matter. This is because the BAG has asked the ECJ to decide whether and when an employee’s entitlement to paid leave can expire if an employee loses their ability to work during the course of the leave year, while the employee could have taken at least part of the annual leave before becoming incapacitated for work, but the employee was not properly informed by the employer about their leave entitlement.

2021/2 Warning strike timing (HU)

    This case involved an employer who claimed that a trade union organised an unlawful warning strike. The Curia (the highest judicial authority in Hungary) found that the trade union violated its obligation to cooperate with the employer according to Act No. 7 of 1989 on Strikes. The Curia and also the Regional Courts made some clear points on the question of the timing of a warning strike. The employer must be notified of a planned strike in sufficient time, which requirement also applies in the case of warning strikes. The time can be considered as sufficient if the employer is able to fulfil its rights to protect its property, prevent damage resulting from the strike, to carry out its duties to protect life and property, and to organise work accordingly. Failing this obligation, the warning strike is unlawful. The notice shall state the date and time that such action will commence.

    The adoption of big data analysis in the legal domain is a recent but growing trend that highlights ethical concerns not just with big data analysis, as such, but also with its deployment in the legal domain. This article systematically analyses five big data use cases from the legal domain utilising a pluralistic and pragmatic mode of ethical reasoning. In each case we analyse what happens with data from its creation to its eventual archival or deletion, for which we utilise the concept of ‘data life cycle’. Despite the exploratory nature of this article and some limitations of our approach, the systematic summary we deliver depicts the five cases in detail, reinforces the idea that ethically significant issues exist across the entire big data life cycle, and facilitates understanding of how various ethical considerations interact with one another throughout the big data life cycle. Furthermore, owing to its pragmatic and pluralist nature, the approach is potentially useful for practitioners aiming to interrogate big data use cases.
