    Previously a model was developed whereby the evolution of dogmatic legal theory design can be made more explicit. This concerns, amongst other aspects, the application of the empirical cycle constructed by De Groot, which forms the final element of an evolution of the application of mundane knowledge to theory design. The starting point of this article is that this evolution must be ‘repeated’ during an academic study in empirical subjects. The objective is to investigate how this is done in the legal dogmatic education.

How to Develop a Critical Attitude?

    Law teachers at the university want students to develop a critical attitude. But what exactly does it mean to be critical and why is it important to be critical? How can a critical attitude be promoted? In this article we intend to elucidate the role that critical thinking may play in legal education. We will introduce the idea of skeptical legal education, which is to a large extent based on Michael Oakeshott’s understanding of liberal learning but which relativizes its insistence on the non-instrumentality of learning and reinforces its critical potential. Subsequently, the article presents a teaching experiment, where students, based on self-organization, study and discuss basic texts in order to encourage critical thinking.

    This article examines the importance of the social evidence base in relation to the development of the law. It argues that there is a need for those lawyers who play a part in law reform (legislators and those involved in the law reform process) and for those who play a part in formulating policy-based common law rules (judges and practitioners) to know more about how facts are established in the social sciences. It argues that lawyers need sufficient knowledge and skills in order to be able to critically assess the facts and evidence base when examining new legislation and also when preparing, arguing and determining the outcomes of legal disputes. For this reason the article argues that lawyers need enhanced training in empirical methodologies in order to function effectively in modern legal contexts.

    How can we teach critical legal education? The article tackles this key question by focusing on the role of methodology in legal education and research. I argue that critical legal education requires marketing methodology as a ‘skill’, thereby freeing it from what students and researchers in Law often view as the negative connotations of ‘theory’. This skill requires exploring ‘alternative methodologies’ – those critical perspectives that depart from legal positivism and which Law traditionally regards as ‘peripheral’. As an example, the article explores the Foucauldian concept of governmentality as a useful methodological tool. The article also discusses the difference between theory, methodology and method, and reviews current academic contributions on law and method(ology). Ultimately, it suggests a need for a ‘revolt of conduct’ in legal education. Perhaps then we might hope for students that are not docile and disengaged (despite being successful lawyers) but, rather, able to nurture an attitude that allows for ‘thinking’ (law) critically.

    This contribution explores the possibility of teaching international law in a critical fashion. I examine whether the training which is taking place at law schools is establishing and sustaining a cultural hegemony (a term borrowed from Antonio Gramsci). I ask whether the current focus on technical practice-oriented teaching is a condition which should be questioned, even disrupted? In my thoughts on reorientations of this culture, a central term is the German word Bildung. Bildung refers to knowledge and education as an end in itself (John Dewey) as well as an organic process (Hegel), and therefore incorporates a wider understanding than the English word ‘education’. In terms of international law, a notion of Bildung allows us to acknowledge the political nature of the discipline; it may even allow us to ‘politicize’ our students.

    Could one imagine that up until the mid-1940s international treaties had been ratified on postal services, copyright protection, and whale hunting, but not on genocide? It was only after the Second World War that the deliberate and systematic destruction of groups was recognised as an international crime. There had not even been a name for this practice, which has existed since the beginning of humanity. The 1948 Genocide Convention, the first human rights treaty adopted by the United Nations, was a milestone in the international protection of human rights, although several tragedies have shown that mere law is not sufficient to relegate genocide to the scrapheap of history. The initiator of the Convention was not a very well-known man. This article is about the struggle of Raphael Lemkin, who had, with unflagging zeal, devoted his life to the elimination of genocide.

    Derkje Hazewinkel-Suringa entered law studies only after marriage and fulfilling about fifteen years of motherhood duty. Once at the university however, she rapidly became a student-researcher, delivered a PhD dissertation on ownership transfer and was appointed as the first female law professor in 1932, at the age of 42. Her professorship was in a remarkably different field, namely criminal law. Twenty years later she published the Introduction to the Study of Criminal Law, which would become the basis for criminal law teaching in the Netherlands for decades. A major reason behind this success was that the book, emphasizing active study of the law rather than passive reproduction, coincided with the general sprit of the post war era. Besides her scholarly work in which balance and synthesis were the major features, Hazewinkel-Suringa was a very outspoken actor in matters political. In 1936, when virtually the whole country was trying to accommodate the rise of fascism in the mighty neighbouring country, she became member of an anti-fascism committee. In 1938 she wrote a plea to the minister of Justice to allow entry of German-Jewish children into the country. During the German occupation (1940-1945) she proposed to close the university because of the dismissal of Jewish professors. She continued her protests against the social mainstream after the war, e.g. writing against the reintroduction of the death penalty (primarily focused on collaborators with the German regime). Hazewinkel-Suringa’s acts of individual courage could not make a difference in the overall political atmosphere of these times.

    The German lawyer / labour law professor Hugo Sinzheimer (1875-1945) has, in the first two decades of the twentieth century, contributed significantly to the legal recognition of the ‘collective labour agreement’. The imperative character of CLA provisions, now widely accepted all over the world, required a paradigmatic turn in the dominant private law perspective on labour relations. The paper tries to specify what made him able and prone to do this, both by reconstructing the legal and political discussion in Germany and the Netherlands and by relating elements of the process to social-scientific theories of institutional and intellectual innovation. I argue that his combination of commitments in various fields (legal practice, science, politics) allowed him to span the gap between the fields of labour relations and state law and to contribute to the constitutionalisation of labour relations.

Hij doet daar onderzoek naar de praktijk van arbeidsrechtelijke regelingen (ontslagrecht, flexwerk, arbeidstijden) en werkt aan een bij uitstek interdisciplinair project over ‘langetermijnontwikkelingen in de regulering van arbeid’.     In this essay, I provide a historical and theoretical framework for understanding the imaginative relation between the liberal rule of law and the kin-based form of socio-legal organization I call ‘the rule of the clan’ – a classic example of law created ‘from below’. Specifically, I believe that a culturalist disciplinary perspective reveals that the modern liberal state and its more centralized rule of law always stand in an ironic, dialectical relation to the rule of the clan as a legal form. Liberal society, that is, nurtures itself through an anti-liberal utopian imaginary. This article provides an intellectual history backdrop for theorizing that dialectical relationship by examining two contrasting ways in which nineteenth-cen‍tu‍ry British intellectuals imagined the rule of law. Following the work of Charles Taylor and, more specifically in the legal field, Paul Kahn, my goal is to depict a social imaginary of modern liberalism that has been neglected within contemporary liberal theory – and, in doing so, pro‍vi‍de a way to appreciate the cultural foundations of liberal legality. The article considers the stories that nineteenth-century British intellectuals told about the relation between the rule of law and the rule of the clan as a way to think about the rule of law today. It thus tacks between three different shores: the world of legal pluralism (the rule of the clan), the world of nineteenth-cen‍tu‍ry British analysis of the rule of the clan and the contemporary relation between culture and modern liberal society.

    In de zaak Prinz en Seeberger spreekt het Hof van Justitie zich (opnieuw) uit over de vraag of een woonplaatseis als voorwaarde voor een recht op export van studiefinanciering, verenigbaar is met de verdragsbepalingen over het vrij verkeer van EU-burgers (art. 20 en 21 VWEU). De twee betrokkenen, Duitse onderdanen, wilden in Nederland respectievelijk Spanje gaan studeren met Duitse studiefinanciering. Zij voldeden echter niet aan de in het Duitse recht vastgelegde zogenoemde driejaarregel: recht op Duitse studiefinanciering voor een volledige hogeronderwijsstudie in een andere EU-lidstaat bestaat alleen indien betrokkene direct voorafgaand aan die buitenlandse studie minstens drie jaar in Duitsland heeft gewoond. Volgens Prinz en Seeberger vormt deze driejaarregel een niet te rechtvaardigen beperking van het recht van Unieburgers op vrij verkeer en verblijf. Na een korte schets van de feitelijke en juridische achtergronden van de zaak wordt het arrest van het Hof van Justitie thematisch besproken, in welke thema’s het commentaar van de auteur is verwerkt, en vervolgens wordt afgesloten met de gevolgen van het arrest voor Nederland.

    In this article on the social production of the book Outsiders, I will situate its production in the daily practice of the social worlds in which Becker was involved. Therefore I focus on the relations, interactions and situations which were relevant for the form, content and success of Outsiders. For data, I use fragments from my email communication with Howard Becker, the collected interviews and other publications which show that Becker seeks to demystify Outsiders. My main contribution is that I use Becker’s own words to demystify the ethnographic practice of Outsiders and describe its mundane backstage reality, which is described by Fine as ‘the underside’ of ethnography (1993).

    In this article I will explore the concept of transgression within the realm of rock music using the biography of Lou Reed, known for such songs as ‘Walk on the Wild Side’ and ’I’m Waiting for the Man’. I discuss Lou Reed’s social transgressions as a reaction to and resistance toward institutions of social control such as family, media and the music industry, which stigmatized him as an outsider. This study, which is based on secondary material, such as biographies, interviews and songs, shows how Lou Reed transgressed social norms with respect to drugs, sex, and gender.

    This article uses a generally accepted conceptualisation of sustainable development that can be operationalized in a judicial context. It focuses on the individual and collective dimensions of the environmental, economic and social pillars, as well as the consideration of inter-generational and intra-generational equity. Case law from the European, African and American systems is analysed to reveal if the elements of sustainable development have been incorporated in their jurisprudence. The analysis reveals that the human rights bodies have used different interpretative methods, some more progressive than others, in order to incorporate the elements of sustainable development in the scope of their mandate, even if they do not mention the concept as such. The overall conclusion is that sustainable development has been operationalized through human rights courts to a certain extent. Sometimes, however, a purely individualised approach to human rights creates a hurdle to further advance sustainable development. The conclusion creates the impression that sustainable development is not just a concept on paper, but that it in fact can be operationalized, also in other courts and quasi-courts. Moreover, it shows that the institutional structure of human rights courts has been used in other areas than pure human rights protection, which means that other areas of law might make use of it to fill the gap of a non-existing court structure.

Mentorschap: onbekend maakt onbemand

    Dit artikel geeft het resultaat weer van een evaluatieonderzoek naar de toepassing van de Wet mentorschap in Aruba. Deze wet biedt bescherming aan meerderjarigen die tijdelijk of duurzaam niet in staat zijn hun niet-vermogenrechtelijke belangen behoorlijk waar te nemen. In een onderzoek gaf het merendeel van de respondenten aan geen of weinig kennis te hebben van de Wet mentorschap. Advocaten en de civiele rechter hebben de Wet mentorschap niet toegepast in de eerste tien bestaansjaren van deze wet. Toch onderkennen alle geïnterviewde vertegenwoordigers van hulpverlenende organisaties dat er behoefte is aan mentorschap in de thuiszorg van bejaarden en andere meerderjarige hulpbehoevenden met lichamelijke of geestelijke beperkingen. Mentorschap wordt ook beschouwd als een alternatieve beschermingsmaatregel voor drugsverslaafden. De onbekendheid met het mentorschap werkt belemmerend op de toepassing van de Wet mentorschap. Nadere regels betreffende de taken en bevoegdheden van de mentor, onder supervisie van een coördinatiecentrum, zullen de benoemingen van mentoren gunstig beïnvloeden.

    Deze bijdrage behandelt de functie die het evenredigheidsbeginsel speelt als toetsingsmaatstaf voor de instellingen van de Europese Unie wanneer zij bindende regelgeving uitvaardigen. Daartoe wordt eerst de omschrijving van dit beginsel in het Europese recht onderzocht, alsmede de verhouding van het evenredigheidsbeginsel tot de nauw verwante beginselen van toedeling van bevoegdheden en subsidiariteit. Daarna gaat het om de vraag wie, tijdens het totstandkomingproces van EU-regelgeving, invloed hebben op de beslissing of EU-regelgeving ‘evenredig’ is. Vervolgens wordt uitvoerig gekeken naar de rechtspraak van het Hof van Justitie van de EU over toetsing van Europese regelgeving aan het evenredigheidsbeginsel. Daarna kunnen conclusies worden getrokken over de van die rechtspraak uitgaande normerende werking op de besluitvormende EU-instellingen.

    The article deals with an unknown chapter of the history of Muslims in the Netherlands in the interwar period. It follows the public debate about the construction of the first mosque in The Hague before the Second World War. The first initiative was made in 1929 by the Dutch convert to Islam Mohammed Ali van Beetem, who played a leading role among the Indonesian Muslim community in the Netherlands. After more than two decennia of debate and negotiations with the municipal authorities in The Hague, the first mosque was finally built by the Ahmadiyya-mission in 1955.

    Over the past couple of decades, the Netherlands unmistakably has developed into a Garlandian style culture of control. A distinct feature of this Dutch culture of control is the increasing interconnectedness between crime and migration in both public and political discourse. As a result of the growing urge to control potential dangerous others, various stop & search powers have been implemented. Besides by their proactive nature, these powers are defined by the fact that they give a fair amount of discretion to individual police officers in deciding who to stop. In this article, while drawing on criminological, sociological and social psychological literature on stereotyping and the rise of a crime complex, the authors will argue that the structural and cultural changes fuelling the emergence of a the typical Dutch culture of control might also affect the individual choices made by police officers in such a way that it fosters ethnic profiling.
