The distance between the public and the judiciary takes two forms: a punitivity gap and an accessibility gap. This article discusses both types of gap and elaborates on the issue of whether the existence of these gaps influences confidence in the judiciary. From the literature, it appears that the public is generally of the opinion that courts sentence too leniently. However, experiments show that when citizens receive information on a specific case, they become less punitive. Information provision may also help to bridge an accessibility gap, as does actual citizen involvement in the administration of justice. The relation between the gaps discussed and confidence in the judiciary is not clear as yet. The article discusses methods generally used to assess confidence and suggests that confidence may be increased by a reduction of the two gaps. |

Derkje Hazewinkel-Suringa entered law studies only after marriage and fulfilling about fifteen years of motherhood duty. Once at the university however, she rapidly became a student-researcher, delivered a PhD dissertation on ownership transfer and was appointed as the first female law professor in 1932, at the age of 42. Her professorship was in a remarkably different field, namely criminal law. Twenty years later she published the Introduction to the Study of Criminal Law, which would become the basis for criminal law teaching in the Netherlands for decades. A major reason behind this success was that the book, emphasizing active study of the law rather than passive reproduction, coincided with the general sprit of the post war era. Besides her scholarly work in which balance and synthesis were the major features, Hazewinkel-Suringa was a very outspoken actor in matters political. In 1936, when virtually the whole country was trying to accommodate the rise of fascism in the mighty neighbouring country, she became member of an anti-fascism committee. In 1938 she wrote a plea to the minister of Justice to allow entry of German-Jewish children into the country. During the German occupation (1940-1945) she proposed to close the university because of the dismissal of Jewish professors. She continued her protests against the social mainstream after the war, e.g. writing against the reintroduction of the death penalty (primarily focused on collaborators with the German regime). Hazewinkel-Suringa’s acts of individual courage could not make a difference in the overall political atmosphere of these times. |

Today’s risk based criminal justice policy leaves but little room to tune sentencing decisions to the individual offender’s mental capacities. As a result, sanctioning has become one-sided, being directed towards retribution. However, in the long run such a non-reciprocal concept of sanctioning, implying a denial of the need to facilitate rehabilitation, weakens the social fabric. Moreover, it holds a denial of citizenship towards (mentally ill) offenders. For the past decades, restorative justice has offered alternative solutions to deal with delinquency. Using informal procedures, taking into account peculiarities of the case, including the offender’s mental capacities, offenders are invited to take accountability for wrongful acts. A similar approach has been introduced within the field of mental health services, including the sector of the forensic mental health care. In response to the popular social biological model, a model of restorative treatment has been introduced, implying treatment to be directed towards reintegration, requiring active participation of the patient/offender. Bearing in mind the communalities between both models, we explore the potential of such a restorative citizenship based approach to better the integration of mentally disturbed offenders. |

On the one hand Bogazianos examines the profound symbolic consequences of America’s reliance on the paradoxical punishment structure of crack; on the other hand the author focuses on the multiple ways crack appeared as a symbolical reference in the lyrics of rap artists. |

Early studies of female drug dealers suggest that women are marginalized, passive victims. In contrast, more recent studies describe women as skilful and competent dealers. In a Bourdieu-inspired theoretical framework of ‘street capital’, the authors suggest that the truth is somewhere in between. Female dealers can be successful, but they face more obstacles than men do. The illegal hard drug economy is gendered and favours men. In this paper the authors discuss how female drug dealers develop particular strategies to prove they still belong in ‘the game’. Four such strategies are emphasized: desexualization, violent posture, emotional detachment and service-mindedness. These are common strategies for all drug dealers, but the gendered economy forces female dealers to be particularly careful about their business and self-presentation. |

Since 1988 the Dutch entrustment order for dangerous mentally disordered offenders (TBS) is organised around three basic principles: treatment, legal protection and social security. In 2006 the Parliamentary Inquiry Commission ‘Visser’ reviewed the TBS order and made seventeen recommendations. This article seeks to investigate to what extent the implementation of these recommendations contributed to developments like the increasing restraints on leave permits and a lengthened average stay. Since 2006 there has been a strong emphasis on security. For a balanced execution of the TBS order more attention is needed for treatment and legal protection. |

In het Coma-arrest bepaalde de Hoge Raad dat comateuze slachtoffers recht hebben op smartengeld. Er bleef echter onduidelijkheid bestaan over de vraag of dergelijke slachtoffers slechts vergoedbaar nadeel hebben geleden wanneer bij hen achteraf sprake is geweest van een zekere mate van bewustzijn (de ‘beperkte opvatting’), of dat zij levensvreugde derven ongeacht de vraag of zij zich ooit nog bewust zullen zijn van het feit dat zij in coma hebben gelegen (de ‘ruime opvatting’). De Rechtbank Utrecht toont zich in haar vonnis van 6 februari 2013 (LJN BZ0813) voorstander van de ruime opvatting door smartengeld toe te kennen aan een comateus slachtoffer dat zich niet (aantoonbaar) bewust is (geweest) van het feit dat hij in coma ligt. Deze uitspraak strookt niet met de functies die met het toekennen van smartengeld worden geacht te worden verwezenlijkt. |

For the past few weeks, young Muslims from Belgium and the Netherlands leaving for Syria to join the armed struggle against the Assad regime have been dominating the local news. This is especially remarkable in light of the fact that it would appear that, until very recently, jihadists from Belgium and the Netherlands were far and few between. The armed struggle is a topic that is widely discussed among young Muslims on social media such as Facebook. During the research on which this article is based, we conducted an analysis of conversations between young Muslims on Facebook and held interviews with a number of them. The key question was: why is it that so many young people use social media to profess their willingness to sacrifice their lives in armed struggle while at the same time most of them are not prepared to put action to their words? Despite all the media reports, the fact remains that of the large number of young Muslims who are potentially ready to go into battle, the vast majority prefer to stay at home for the time being. When we confronted the participants in these discussions with this inconsistency, they offered a number of reasons and considerations as to why martyrdom was not yet granted to them. The way in which these considerations shape their lives and the role played by their religious convictions form the subject of this article. |

This article explores the themes of injustice and dehumanization in Aeschylus’ Oresteia and Yael Farber’s Molora, in which the story of the Oresteia is dramatized against the backdrop of post-apartheid South Africa. It is argued that both plays depict wrongdoers and victims alike as social outcasts. Thus, they can both be described with Paul Ricoeur as ‘sketches of a man,’ not being able to live up to their full human potential. Borrowing from Ricoeur’s legal philosophy, it is then explained how public trials and hearings help them to reintegrate into society, in which they can regain their full humanity. |

In 1870 in the Netherlands the death penalty was replaced by the sanction nearest to that effect: lifelong imprisonment. For the government though this penalty was acceptable only in connection with the possibility of mercy. The sanction was to be executed humanely and should not result in torture. The way the sanction was executed since, the administration developed a policy of mercy taking into account the devastating effects of the sanction. This policy resulted in mental care for the convicted and his release after approximately twenty years imprisonment. More than hundred years later, about 2004, the policy of mercy changed. Since then, according to the responsible ministers, life imprisonment should end by the onset of death. In this article the practice under the old and the new policy is illustrated by a case study. The conclusion is that like the death penalty lifelong imprisonment corrodes the prestige of the State. |

Life imprisonment is difficult to define. Sentences that are not called life imprisonment may also be indefinite sentences of detention which may result in the detention of offenders in prison until they die there. Even where a sentence is called ‘life imprisonment’ it may be difficult to ascertain for how long the offender will actually be held and what criteria will be applied to considering his eventual release. This paper sketches some recent developments in respect of indeterminate sentences that are not called life imprisonment, even though they amount to it in practice. It then turns to the question of life sentences that are imposed without provision for any fixed period after which they should be reconsidered. Questions are raised about the extent to which such sentences are acceptable in Europe, the United States and elsewhere, particularly in instances where at sentence there is an indication that the offenders may not be considered for release at all. It is argued that human rights law is moving towards requiring that all persons sentenced to life imprisonment should have a reasonable prospect of release. Given the widespread support for life imprisonment this paper seeks to raise some human rights concerns that arise with the use of this sentence. The concerns are essentially twofold. First, the sentence may be imposed in instances where it would be disproportionate punishment to do so. Secondly, the procedures for its implementation, in particular those that relate to the potential release of persons serving life sentences, may not be adequate to meet the requirement of a realistic prospect of release. |

This article focuses on the ‘de iure’ and ‘de facto’ possibilities in Dutch penal law to reduce a life sentence. The question is whether the current legal framework offers sufficient perspective to life prisoners as required by the European Court of Human Rights. It also addresses the disadvantages of the current procedures. The authors argue that it is desirable that a legal possibility for release on probation of life prisoners is introduced in the Netherlands. They will set out a bill written by the NGO ‘Forum Levenslang’ that would make this possible. |

A comparison between life prisoners and long-term forensic psychiatric inpatients shows, besides differences in legal position, important similarities. Therefore the results of an experiment with regime changes in the long-term ward of Dutch forensic psychiatric institutions might also be relevant for the regime of life prisoners. The experiments are partly based on the ideas of Andrews, Ward and Bonta. The fundamental idea is to give inpatients a sense of control over their life environment by granting them as much responsibility as possible for practicalities, by communicating with their representatives regularly and taking a positive attitude towards inpatients’ preferences and requests. First experiences show that the new approach seems to have a positive impact on inpatients. They suffer less from depression as well as aggressive moods, which contributes to a better atmosphere in the institution. Stressing the tentative nature of this observation the author indicates that the hypothesis on the beneficial effects of active influence on the life environment might be verified by research currently in progress. |

Some ten years ago, victim-offender mediation was introduced for the first time in EU-legislation through article 10 of the 2001 framework decision on the standing of victims in criminal proceedings. In 2012 this framework decision was replaced by a more extensive directive establishing minimum standards for victims of crime. This article examines the position of restorative justice in this new legal instrument. The outcome is mixed. The emphasis on safeguards in case restorative justice is applied is a positive move towards good practices, but it is disappointing that a right to access restorative justice services was not adopted. |

In the Netherlands penal interventions aimed at the reduction of recidivism are progressively executed according to the ‘what works’ approach, a research tradition that tries to articulate the conditions under which penal interventions can be effective in preventing offenders to relapse into crime. The ideas on ‘what works’ originate from international studies, but what about the Dutch research itself? Which interventions have proved to be successful in the Netherlands and which have had adverse results? The WODC has carried out a meta-analysis of all relevant studies that have been published in the Netherlands and the Dutch-speaking part of Belgium since the early seventies of the previous century. 141 evaluations were identified, 83 of which contained some sort of comparison with a control group. Results indicate that programmes aimed at adult offenders were more successful than interventions for youth and young adults. Programmes based on the idea of rehabilitation appeared to have been more successful than sanctions based on deterrence. |

Annually hundreds of victims make use of their right to speak in court. Victims often expect this will result in more punitive sentences. According to judges this is unlikely. This experiment among law students examines the influence of victim impact statements (VIS) on the sentencing outcome. Furthermore the effect of how the statement is delivered is examined. Is there a difference between the VIS as document in the case file and one delivered by the victim in court? Does it matter if the victim still has visible injuries? Study findings indicate that neither the presence of a VIS, nor the mode of delivery and visible injuries affect sentence length. |
