Qualitative research in an immigration detention center in the Netherlands shows that detained unauthorized migrants consider the entry procedure in Immigration Centre Rotterdam procedurally just. These migrants are generally positive on the fairness of the entry procedure as their safety and welfare are guaranteed and existing procedural justice criteria are respected. However, they believe that immigration detention in itself is illegitimate and that they do not deserve to be detained. This shows that the focus on procedures and interactions is insufficient to understand the perceived legitimacy of immigration detention if shared values and consent with the legal basis of immigration detention are lacking. |

The current study investigates the relationship between the Dark Triad personality traits (consisting of narcissism, psychopathy and Machiavellianism) and three different forms of aggression: online aggression, overt aggression and relational aggression. The sample consisted of 1,051 adolescents between 12 and 16 years old. Results show that psychopathy and Machiavellianism are positive predictors of the three forms of aggression, while narcissism is a positive predictor of online aggression only. |

After establishing its complex and sensitive nature, a first assessment containing types of iconoclasm and various motives of iconoclasts is presented. Different forms of iconoclasm are distinguished, explained and illustrated using examples. Special attention is given to the subject’s sensitivity in modern society while establishing the connection of the topic with identity in multiple shapes and forms. The article aims at contributing to a future multi-disciplinary debate. |

Since the beginning of 2020 mediation in penal cases (mediation in strafzaken) has officially become the preferred intervention for victim-offender mediation in the criminal procedure in the Netherlands. Although mediation in general has a sound theoretical framework, the methodological elaboration appears pluriform and somewhat limited. In practice mediators in penal cases operate conform their own personal and professional standards and preferences, apparently without tailor made methodology. This article describes the current methodological directions such as transformative or narrative mediation and seeks for useful references. As a part of restorative practice, mediation in penal cases seems to remain secluded from insights and methodology developed in the domain of restorative justice practices. Educational institutes providing trainings for mediators barely refer to this theoretical framework. Besides a methodological reconnaissance this article offers a fundamental comparison of mediation styles and interventions, but is above all an incentive to further methodological research and development. |

This article critically examines the prospects of restorative justice in Brussels from the perspective of urban youth work. The insights issue from action research on the topic of ‘radicalisation’. The authors develop two arguments. The first tempers restorative optimism. It shows how restorative interventions are not necessarily the most adequate response to tensions and conflicts in urban settings. The second argument points out that resistance from urban youth workers regarding the implementation of restorative interventions should not be seen as a regrettable obstacle for academics who are eager to experiment with these interventions. Such a resistance can lead to new insights and fresh opportunities to radically rethink Restorative Justice. One of the ideas that the article brings to the surface comes down to this. In a city like Brussels, characterised by superdiversity, and clearly marked by social inequalities, academic researchers only gain credibility in initiating restorative interventions if they undeniably denounce these inequalities and fully express their engagement for social justice. |

The contribution of sport to reintegrating offenders receives limited attention, both in science and in the practice of probation and the prison system. From the perspective of desistance, this literature study concluded that sport can contribute to the development of individual capital, social capital and an alternative identity. However, the effect of sport is not necessarily positive. There are risks of negative influence or the reinforcement of problem behaviour. In counselling offenders, sport should be combined with other interventions to reduce recidivism. A personalized approach is required, based on the risk-need-responsivity model. |

This article contains a plea for a further operationalization of the subsidiarity principle (penal law and punishment as ultimum remedium) through a maximalist restorative justice, i.e. a restorative justice that not only offers space for ‘voluntary processes’ and agreed restoration, but also for ‘compulsory procedures’ and imposed restoration. An attempt is made to make the maximalist arsenal of restorative sanctions as concrete as possible. Two examples of sanctions that are ‘constructed’ in a restorative way in this article, are restorative community service and restorative electronic home detention. This article is based on work by John Blad and Lode Walgrave that has previously appeared in Tijdschrift voor Herstelrecht. |

Is the concept of ‘retribution’ compatible with restorative justice? Starting from the perspective that retribution is an imperative given and that restorative justice should be a preferent option in coping with crime, the concept of retribution needs to be redesigned. Rethinking retribution needs to take into account the hypersensitive nature and complexity of modern society. Apparently incompatible interests need to be reconciled, paying tribute to the citizenship of both the victim and the perpetrator. Notwithstanding censure to be in place, implying the infliction of ‘pain’, the aim must lie in a reconstruction of civil relationships affirming the victim and the perpetrator to be part of the community. Standards applied must reflect objectivity, implying proportionate punishment, with a preference towards restorative justice because it is the more subsidiary option. Thus, retribution notwithstanding the imperative and painful nature of retribution, the execution should pursue the reconstruction of (civil) relationships. |

Op die manier wordt een tweesporenbeleid gevolgd, waarbij de strafrechtelijke reactie afhankelijk is van de emotionele impact van de noodweersituatie op de betrokkene. In het kader van de mogelijke invoering van een nieuw Strafwetboek in België wordt wel voorzien in een bepaling inzake noodweerexces. Het gevoerde tweesporenbeleid blijft daarbij evenwel behouden. |

Public values and citizen participation are key terms in smart city discourse that are propagated by all its actors, from governments to corporations and civil society. Nevertheless, the design and development of smart cities are hardly ‘public’ as some publics and some forms of participation are never included. This is particularly visible in current protests against a key enabling technology for smart cities, 5G. These contestations tend to be considered ill-informed and irrational, while their methods are seen as conflictual rather than helpful. In this article the author argues that the public value approach to smart cities is rooted in a deliberative perspective of democracy, while the tensions that are produced by 5G and other forms of anti-technological protest are better understood as part of agonistic democracy. Such conflicts about the new smart technologies that are currently hidden from public sight need to be articulated and constructed as contentious issues for electoral politics, in order for the smart city to acquire its democratic legitimacy. |

This paper examines moral injury, in relation to recovery from this kind of psychic damage and to restorative justice. In recent research the concept is developed in distinction from the psychiatric diagnosis PTSD. Whereas PTSD is rooted in anxiety, as it occurs during or after life-threatening situations, people suffering from moral injury are disruptively affected by guilt and shame, in the slipstream of which they may be tormented by remorse, self-loathing, anger and self-disgust – with symptoms similar to PTSD. Unlike PTSD, however, the risk of moral injury is part of ordinary life. It may happen to anyone. Therefore, this paper takes an ‘existential’ perspective by relating moral injury to the fundamental human condition of relationality. Moral injury is interpreted as the disturbance of the responsibility, the confidence and the security that fundamentally sustain the human relationships to the world, to each other, and to oneself. One way of recovering from moral injury is through empathy, primarily performed by caregivers or chaplains who guide the morally injured, and consequently accomplished by the injured themselves, in a narrative way. |

This contribution advocates a fresh look at counteracting radicalization. Two frameworks are used for this. In the first place, that is the restorative justice that we have coined here as ‘making amends’. We need this normative framework because it provides clues for the prevention of ‘transgressing’ forms of radicalization, which can lead to extremism and terrorism. Secondly, we use an Activism of Hope framework, which states that we may and must resist social deprivation and injustice. After all, deprivation and injustice are the breeding ground for radicalization. |

In the Internet era, banking fraud has become a common way of stealing money. According to victim surveys, this offense has already led to significant numbers of victims. In this article, the authors focus on illegal bank account withdrawals, which are an indication of identity fraud. For this they use data on 636 victims who were surveyed in the LISS panel. Using the concept of ‘capability to act’, as used in the WRR report Why knowing what to do is not enough (2017), the authors model which type of victim takes action to get the stolen amount reimbursed and which type of victim succeeds in doing so. They expect that the less educated and people with low self-control more often refrain from contact with authorities (bank, police) and therefore more often receive no compensation and remain with higher residual damage. The results show that approximately four in five victims of unauthorized bank debits are fully compensated. For the group of victims for whom this is not the case – remaining with residual damage – most of the hypotheses are confirmed. |

Romance scams have seen a worldwide increase and are one of the most financially damaging forms of cybercrime. In addition, victims suffer strong emotional impact and are confronted with victim blaming. Research shows how the combination of various emotional and financial impact can induce a ‘double-hit’ on victims. Knowledge and possibilities for law enforcement are insufficient, which leads to a lack of financial compensation and support for victims. |
