    In contrast to the societal debate, the topic of religion and crime is only scarcely present in contemporary criminological research. A special issue on this theme hence seemed very relevant. Even though the editors launched an open call, the submitted proposals were almost always related to Islam. In this introduction we therefore reflect on questions and themes that, in our opinion, should be included in this special issue on religion and crime. First, we give a short overview of Belgian, Dutch and American research on the missing theme of sexual abuse in the church. Second, we discuss the complex concept of ‘religion’. Third, we assess the complex relationship between religion and crime and reflect on the question of whether and when religion leads to more or, on the contrary, less crime. We end this introduction with a brief overview of the selected contributions for this special issue.

    This article explores the themes of injustice and dehumanization in Aeschylus’ Oresteia and Yael Farber’s Molora, in which the story of the Oresteia is dramatized against the backdrop of post-apartheid South Africa. It is argued that both plays depict wrongdoers and victims alike as social outcasts. Thus, they can both be described with Paul Ricoeur as ‘sketches of a man,’ not being able to live up to their full human potential. Borrowing from Ricoeur’s legal philosophy, it is then explained how public trials and hearings help them to reintegrate into society, in which they can regain their full humanity.

    Victims of crime entertain various wishes regarding the criminal justice system. This paper present the results of a study that made use of vignettes. Victim wishes regarding the goals of punishment were examined, and the relation with degree offender intent (intent, negligence) has been established. The results show that when the perpetrator acted intentionally, victims have a greater wish for retribution and the other punishment goals, but they have a smaller need for restoration. Victims wish to be compensated and to receive apologies from the offender, but generally are reluctant to meet with the perpetrator in person.

    In the contemporary reform of the Dutch welfare state, civil society plays a prominent role in the solution of individual needs. This article investigates, from a normative point of view, the consequences for the churches as part of civil society. The outline of this policy is decentralization of welfare to local communities, saving of money, and a more active role of citizens in need to solve their problems alone. Then the normative framework is sketched with the help of the basic principles of Catholic Social Teaching (personality, subsidiarity, solidarity and common good), as well as ‘caritas’. The consequences for the churches are analyzed, first from the perspective of their participation in this legal and policy-framework. There is a great complementarity in theory and practice, but research shows that local governments are reluctant in cooperating with churches, which have to be careful that their own identity will be instrumentalized. Second, the consequences are analyzed for the core business of churches: it appears that the government wants to have an insight in the processes of giving meaning to life of individuals to give the help (financially), efficiently and effectively, according to the policy goals. Thus, although the government wants to appeal to civil society and calls upon the churches explicitly, the paradoxical consequence will be that the free expression of religion will be limited in the functioning of the future welfare state.

    Criminal justice is oriented at retrospective responsibility: examining whether the defendant is guilty and imposing a punishment that fits the crime. In this article it is argued that prospective responsibility needs more attention: taking responsibility. We have to remind the offender of his obligations: pay his debt, repair the harm done, work to change his behaviour and enhancing his situation. We should also take account of the interests and needs of the persons concerned. It is also argued that stimulating active responsibility should take place within the logics of ‘doing justice’. Criminal justice cannot respond to the imperatives of care, well-being and problem-solving.
